Justice J.M.JAMES\n\n Dated :25\/08\/2006\n\n O R D E R\n                            J.M.JAMES, J.\n\n                              --------------\n\n                           B.A. 5227\/2006\n\n                            ------------------\n\n    DATED THIS THE 25TH DAY OF AUGUST, 2006\n\n\n\n\n                              O R D E R\n<\/pre>\n<p>             The   petitioners   are   accused,   in   crime<\/p>\n<p>No.167\/2006   of   Erumeli   police   Station,   under   Sections<\/p>\n<p>452,   341,   323,   294(b)   and   326   IPC   read   with   Section   34<\/p>\n<p>IPC.  It is alleged by the prosecution that,   because of the<\/p>\n<p>previous enimity,  the petitioners had trespassed into a tea<\/p>\n<p>shop,   where   the   defacto   complainant   was   sleeping,     and<\/p>\n<p>caused   injury   on   the   left   side   of   the   tenth   rib   of   the<\/p>\n<p>injured,   by   hitting   with   a   soda   bottle,   causing   fracture.<\/p>\n<p>The   petitioners   are   before   this   Court,   under   Section   438<\/p>\n<p>Cr.P.C.\n<\/p>\n<\/p>\n<p>      2.     I heard the submissions made by either side.  In<\/p>\n<p>the   above   facts   situation,   I   direct   the   petitioners   to<\/p>\n<p>surrender   before   the   Investigating   Officer,   who   is<\/p>\n<p>investigating   crime   No.   167\/2006   of   Erumeli   Police<\/p>\n<p>Station, on 1.9.2006, between 10.30 a.m and 11.00 a.m.<\/p>\n<p>      3.     The   Investigating   Officer   shall   interrogate   the<\/p>\n<p>B.A.5227\/2006<\/p>\n<p><span class=\"hidden_text\">                                2<\/span><\/p>\n<p>petitioners,   and   thereafter,   produce   them   before   the<\/p>\n<p>Court below, as per the law.   The petitioners may move<\/p>\n<p>application(s) for bail, before that Court and the learned<\/p>\n<p>Magistrate shall consider the same and pass appropriate<\/p>\n<p>orders, on the date of production itself.<\/p>\n<p>        4.
