Justice ANTONY DOMINIC\n\n Dated :20\/08\/2008\n\n O R D E R\n                        ANTONY DOMINIC, J.\n\n                       ===============\n                   W.P.(C) NO. 25065 OF 2008 H\n                  ====================\n\n              Dated this the 20th day of August, 2008\n\n                           J U D G M E N T\n<\/pre>\n<p>      Petitioner was one of the Abkari contractors during the year<\/p>\n<p>1980-81. In this writ petition, what is claimed by the petitioner<\/p>\n<p>is the benefit of Ext.P5, Amnesty scheme announced by the<\/p>\n<p>Government       of  Kerala.   Exts.P6   and   P7   are   the   two<\/p>\n<p>representations made by the petitioner for the aforesaid benefit.<\/p>\n<p>However, it is seen that in these representations, petitioner is<\/p>\n<p>also claiming that liability is to be apportioned among the other<\/p>\n<p>co licencees as well. This is not a benefit which the petitioner can<\/p>\n<p>claim while claiming the benefit of Amnesty scheme, which only<\/p>\n<p>provides for settlement of liability in the manner provided<\/p>\n<p>therein.\n<\/p>\n<p>      2.    It is pointed out by the learned senior counsel for the<\/p>\n<p>petitioner that the petitioner is reserving his liberty for claiming<\/p>\n<p>apportionment of liability and recovery of individual contribution<\/p>\n<p>from the other licencees and that the same will be pursued<\/p>\n<p>independently. All that he now wants is that the claim made by<\/p>\n<p>WPC 25065\/08<br \/>\n<span class=\"hidden_text\">                                 :2 :<\/span><\/p>\n<p>him in Exts. P6 and P7 for the benefit of Ext.P5 Amnesty Scheme<\/p>\n<p>should be directed to be considered.\n<\/p>\n<p>      3.    Accordingly, the writ petition is disposed of directing<\/p>\n<p>that the 2nd respondent shall consider the eligibility of the<\/p>\n<p>petitioner for the benefit of Amnesty scheme as announced by<\/p>\n<p>the Government of Kerala in Ext.P5 ignoring the claim for<\/p>\n<p>apportionment of the liability.
