PUBLIC PROSECUTOR\nfor Respondent(s) : 1, \n=========================================\n\n\n \n\t  \n\t \n\t  \n\t\t \n\t\t\t \n\nCORAM\n\t\t\t: \n\t\t\t\n\t\t\n\t\t \n\t\t\t \n\nHONOURABLE\n\t\t\tMR.JUSTICE Z.K.SAIYED\n\t\t\n\t\n\n \n\nDate\n: 06\/09\/2011\n \n\nORAL\nORDER<\/pre>\n<p>By<br \/>\n\tway of present application, filed under Section 439 of the Code of<br \/>\n\tCriminal Procedure, 1973, the applicant has prayed to release him on<br \/>\n\tregular bail in connection with the offence registered as CR No.I-75<br \/>\n\tof 2005 registered with Panshina Police Station, Surendranagar for<br \/>\n\tthe offences punishable under Sections 395 and 114 of the Indian<br \/>\n\tPenal Code.\n<\/p>\n<p>Heard<br \/>\n\tMr.Y.J. Patel, learned counsel for the applicant and Mr.Maulik<br \/>\n\tNanavati, learned Additional Public Prosecutor for the<br \/>\n\trespondent-State.\n<\/p>\n<p>Mr.Patel<br \/>\n\thas contended that the applicant is innocent and is not even<br \/>\n\tremotely connected with the offence in question. He has also<br \/>\n\tcontended that very small amount is involved in the matter. He has<br \/>\n\talso contended that the applicant is a very poor person and no<br \/>\n\tidentification parade is held. He has also contended that the<br \/>\n\tco-accused have already been released on bail and therefore, on the<br \/>\n\tground of parity also, present applicant may kindly be released on<br \/>\n\tbail. He, therefore, contended that looking to the overall facts and<br \/>\n\tcircumstances of the case, present applicant may be enlarged on<br \/>\n\tregular bail.\n<\/p>\n<p>Mr.Nanavati,<br \/>\n\tlearned Additional Public Prosecutor, has  vehemently opposed the<br \/>\n\tpresent application.\n<\/p>\n<p>Heard<br \/>\n\tlearned counsel for the respective parties and perused papers<br \/>\n\tproduced before me. It appears from the papers that this is a fit<br \/>\n\tcase to entertain.\n<\/p>\n<p>Considering<br \/>\n\tthe above, present application is allowed. The applicant is ordered<br \/>\n\tto be released on bail in connection with CR No.I-75 of 2005<br \/>\n\tregistered with Panshina Police Station, Surendranagar for the<br \/>\n\toffence alleged against him in this application on his executing a<br \/>\n\tbond of Rs.10,000\/- (Rupees ten thousand only) with one solvent<br \/>\n\tsurety of the like amount to the satisfaction of the trial Court and<br \/>\n\tsubject to the conditions that he shall &#8211;\n<\/p>\n<p>a)\tnot<br \/>\ntake undue advantage of his liberty or abuse\this liberty;\n<\/p>\n<p>b)\tnot<br \/>\nto try to tamper or pressurise the prosecution \twitnesses or<br \/>\ncomplainant in any manner;\n<\/p>\n<p>c)\tmaintain<br \/>\nlaw and order and should cooperate the \tInvestigating Officer;\n<\/p>\n<p>d)\tnot<br \/>\nact in a manner injurious to the interest of\tthe prosecution;\n<\/p>\n<p>e)\tnot<br \/>\nleave State without the prior permission\tof the concerned Court;\n<\/p>\n<p>f)\tmark<br \/>\nhis presence on every 1st and 15th day of \teach<br \/>\nCalender month before the Investigating \tOfficer between 09.00 hours<br \/>\nand 14.00 hours;\n<\/p>\n<p>g)\tfurnish<br \/>\nthe address of his residence to the\tInvestigating Officer\tand also to<br \/>\nthe Court at the \ttime of execution of \tthe bond and shall not\tchange<br \/>\nthe residence without prior permission of \tthis Court;\n<\/p>\n<p>h)\tsurrender<br \/>\nhis passport, if any, to the lower Court\twithin a week.\n<\/p>\n<p>If<br \/>\n\tthe breach of any of the above conditions is committed, the<br \/>\n\tconcerned Court will be free to issue warrant or take appropriate<br \/>\n\taction in the matter.\n<\/p>\n<p>Bail<br \/>\n\tbefore the lower Court having jurisdiction to try the case. It would<br \/>\n\tbe open to the trial Court concerned to give time to furnish the<br \/>\n\tsolvency certificate if prayed for.
