Joshi appearing on behalf of petitioner.\n<\/p>\n<p>\t\tI<br \/>\nhave considered detailed submissions made by both learned advocates<br \/>\nappearing on behalf of respective parties and I have also perused all<br \/>\ndocuments which are annexed to present petition by petitioner.<br \/>\nAccording to my opinion, whatever grievance voiced in present<br \/>\npetition, if petitioner may approach the highest authority of<br \/>\ndepartment means Secretary, Finance Department, Sachivalaya,<br \/>\nGandhiangar who can look into matter and consider grievance of<br \/>\npresent petition and pass appropriate reasoned order which will meet<br \/>\nends of justice between both parties.\n<\/p>\n<p>\t\tTherefore,<br \/>\nlet petitioner may make detailed representation to Secretary, Finance<br \/>\nDepartment, Sachivalaya, Gandhiangar in respect of his grievance<br \/>\nvoiced in present petition within a period of one week from date of<br \/>\nreceiving copy of present order.\n<\/p>\n<p>\t\tAs<br \/>\nand when Secretary, Finance Department, Sachivalaya, Gandhiangar<br \/>\nreceived such representation from petitioner, it is directed to<br \/>\nSecretary, Finance Department, Sachivalaya, Gandhiangar to examine<br \/>\ngrievances of present petition independently and also to consider his<br \/>\ndifficulties which have been mentioned in representation and<br \/>\nthereafter to pass appropriate reasoned order in accordance with law<br \/>\nwithin a period of two months from date of receiving such<br \/>\nrepresentation from petitioner and communicate such decision to<br \/>\npetitioner immediately.\n<\/p>\n<p>\t\tIn<br \/>\nview of above observation and direction, present petition is disposed<br \/>\nof by this Court without expressing any opinion on merits.\n<\/p>\n<p>\t\tHowever,<br \/>\nin case, if ultimate decision is adverse to petitioner, then, it is<br \/>\nopen for petitioner to file appropriate proceedings before<br \/>\nappropriate forum in accordance with law.\n<\/p>\n<p>\t\tDirect<br \/>\nservice is permitted.\n<\/p>\n<p>[H.K.\n<\/p>\n<p>RATHOD, J.]<\/p>\n<p>#Dave<\/p>\n<p>\t\t   \u00a0\u00a0\u00a0<\/p>\n<p>\t\t   Top<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Gujarat High Court Kamlesh vs State on 7 July, 2011 Author: H.K.Rathod, Gujarat High Court Case Information System Print SCA\/7973\/2011 2\/ 2 ORDER IN THE HIGH COURT OF GUJARAT AT AHMEDABAD SPECIAL CIVIL APPLICATION No. 7973 of 2011 ========================================================= KAMLESH KISHANCHAND HINGORANI &#8211;
