Justice S.S.SATHEESACHANDRAN\n\n Dated :\/  \/\n\n O R D E R\n                  S.S.SATHEESACHANDRAN, J.\n                 ----------------------------------------\n                      C.R.P.No.674 OF 2009\n                     --------------------------------\n         Dated this the 21st day of December 2009\n         ----------------------------------------------------------\n\n                                 ORDER\n<\/pre>\n<p>     Revision is directed against the judgment dated<\/p>\n<p>30\/11\/2009 in C.M.A No.17 of 2009 passed by the learned<\/p>\n<p>District Judge, Manjeri. The above appeal was filed against<\/p>\n<p>an order passed by the learned Munsiff in an interlocutory<\/p>\n<p>application for injunction directing the parties to maintain<\/p>\n<p>status quo. The dispute related to construction of a building<\/p>\n<p>in a property over which rival claims were set up by the<\/p>\n<p>parties. Suit was filed before the vacation judge and after<\/p>\n<p>hearing both sides, an order was passed that further<\/p>\n<p>construction will be at the risk of the present revision<\/p>\n<p>petitioner\/defendant       in    the    suit.       Pursuant       thereto,<\/p>\n<p>construction of the building continued and according to the<\/p>\n<p>learned counsel for the revision petitioner\/defendant, it has<\/p>\n<p>been completed and ready for occupation. In the appeal<\/p>\n<p>preferred by him against the order passed by the learned<\/p>\n<p>C.R.P.No.674 OF 2009          Page numbers<\/p>\n<p>Munsiff directing the maintaining of status quo, an<\/p>\n<p>undertaking is stated to have been given by him that the<\/p>\n<p>construction put up would be subject to the decision of the<\/p>\n<p>suit after trial. The learned District Judge taking note of the<\/p>\n<p>undertaking given and also the submissions made, passed<\/p>\n<p>the impugned judgment whereby petitioner\/defendant has<\/p>\n<p>been permitted to carry out the work and complete the<\/p>\n<p>construction of the building.      But such permission was<\/p>\n<p>granted subject to the condition, the petitioner can use the<\/p>\n<p>building so completed for his own personal use or<\/p>\n<p>occupation, but cannot alienate the building or part of the<\/p>\n<p>same or induct any strangers on license or on lease or by<\/p>\n<p>any other arrangement. Revision is directed against that<\/p>\n<p>part of the order restraining the petitioner\/defendant from<\/p>\n<p>inducting strangers to the completed building on lease or<\/p>\n<p>license arrangement.\n<\/p>\n<\/p>\n<p>      2. I heard the learned counsel for the petitioner.
