Thereafter, as the husband of the<br \/>\n\tcomplainant was out of station from the previous day the complainant<br \/>\n\twas alone at her house, at about 11.00 hours the accused came and<br \/>\n\ttook the complainant in his arm and demanded for sexual intercourse.<br \/>\n\tHowever, the complainant escaped from the grip of accused. It is<br \/>\n\talleged that at that time the husband of the complainant came and<br \/>\n\tintervened. The accused started beating the husband of the<br \/>\n\tcomplainant and thereafter, after giving threats, he went away.<br \/>\n\tThereafter, the complaint for the offences under Sections 354, 448,<br \/>\n\t323 of I.P. Code has been lodged against the accused   respondent<br \/>\n\twith Mendarda Police Station.\n<\/p>\n<p>Thereafter,<br \/>\n\t necessary investigation was carried out and statements of witnesses<br \/>\n\twere recorded. During the course of investigation, respondent was<br \/>\n\tarrested and, ultimately, charge-sheet was filed against him before<br \/>\n\tthe court  and thereafter the trial was initiated against the<br \/>\n\trespondent.\n<\/p>\n<p>To<br \/>\n\tprove the case against the present accused, the prosecution has<br \/>\n\texamined the witnesses  and also produced documentary evidence.\n<\/p>\n<p>At<br \/>\n\tthe end of trial,  after recording the statement of the accused<br \/>\n\tunder section 313 of Cr.P.C.,  and hearing arguments on behalf of<br \/>\n\tprosecution and the defence, the learned Magistrate acquitted the<br \/>\n\trespondents   accused of all the charges leveled against them by<br \/>\n\tjudgment and order dated 13.03.2003.\n<\/p>\n<p>Being<br \/>\n\taggrieved by and dissatisfied with the aforesaid judgment and order<br \/>\n\tpassed by the trial Court the appellant State has preferred present<br \/>\n\tappeal.\n<\/p>\n<p>Heard<br \/>\n\tlearned P.P. Mr. Jani, appearing on behalf of  the appellant<br \/>\n\tState It has been contended by learned PP that the judgment and<br \/>\n\torder of the trial Court is against the provisions of law; the trial<br \/>\n\tCourt has not properly considered the evidence led by the<br \/>\n\tprosecution and looking to the provisions of law itself it is<br \/>\n\testablished that the prosecution has proved the whole ingredients of<br \/>\n\tthe offence against the present respondents. Learned PP has also<br \/>\n\ttaken this court  through the oral as well  as the entire<br \/>\n\tdocumentary evidence. Learned PP has also taken this Court through<br \/>\n\tthe entire oral as well as documentary evidence.\n<\/p>\n<p>At<br \/>\n\tthe outset it is required to be noted that the principles which<br \/>\n\twould govern and regulate the hearing of appeal by this Court<br \/>\n\tagainst an order of acquittal passed by the trial Court have been<br \/>\n\tvery succinctly explained by the Apex Court in a catena of<br \/>\n\tdecisions. In the case of<br \/>\n\tM.S. Narayana Menon @ Mani Vs. State of Kerala &amp; Anr, reported<br \/>\n\tin (2006)6 SCC, 39,<br \/>\n\tthe Apex Court has narrated about the powers of the High Court in<br \/>\n\tappeal against the order of acquittal. In para 54 of the decision,<br \/>\n\tthe Apex Court has observed as under:\n<\/p>\n<p> 54.<br \/>\n In any event the High Court entertained an appeal treating to be an<br \/>\nappeal against acquittal, it was in fact exercising the revisional<br \/>\njurisdiction. Even while exercising an appellate power against a<br \/>\njudgment of acquittal, the High Court should have borne in mind the<br \/>\nwell-settled principles of law that where two view are possible, the<br \/>\nappellate court should not interfere with the finding of acquittal<br \/>\nrecorded by the court below.\n<\/p>\n<p>Further,<br \/>\n\tin the case of Chandrappa<br \/>\n\tVs. State of Karnataka, reported in (2007)4 SCC 415<br \/>\n\tthe Apex Court laid down the following principles:\n<\/p>\n<p> 42.\tFrom<br \/>\nthe above decisions, in our considered view, the following general<br \/>\nprinciples regarding powers of the appellate court while dealing with<br \/>\nan appeal against an order of acquittal emerge:\n<\/p>\n<p>[1]\tAn<br \/>\nappellate court has full power to review, reappreciate and reconsider<br \/>\nthe evidence upon which the order of acquittal is founded.\n<\/p>\n<p>[2]\tThe<br \/>\nCode of Criminal Procedure, 1973 puts no limitation, restriction or<br \/>\ncondition on exercise of such power and an appellate court on the<br \/>\nevidence before it may reach its own conclusion, both on questions of<br \/>\nfact and of law.\n<\/p>\n<p>[3]\tVarious<br \/>\nexpressions, such as,  substantial and compelling reasons ,  good<br \/>\nand sufficient grounds ,  very strong circumstances ,<br \/>\n distorted conclusions ,  glaring mistakes , etc. are not<br \/>\nintended to curtain extensive powers of an appellate court in an<br \/>\nappeal against acquittal. Such phraseologies are more in the nature<br \/>\nof  flourishes of language  to emphasis the reluctance of an<br \/>\nappellate court to interfere with acquittal than to curtail the power<br \/>\nof the court to review the evidence and to come to its own<br \/>\nconclusion.\n<\/p>\n<p>[4]\tAn<br \/>\nappellate court, however, must bear in mind that in case of acquittal<br \/>\nthere is double presumption in favour of the accused. Firstly, the<br \/>\npresumption of innocence is available to him under the fundamental<br \/>\nprinciple of criminal jurisprudence that every person shall be<br \/>\npresumed to be innocent unless he is proved guilty by a competent<br \/>\ncourt of law. Secondly, the accused having secured his acquittal, the<br \/>\npresumption of his innocence is further reinforced, reaffirmed and<br \/>\nstrengthened by the trial court.\n<\/p>\n<p>[5]\tIf<br \/>\ntwo reasonable conclusions are possible on the basis of the evidence<br \/>\non record, the appellate court should not disturb the finding of<br \/>\nacquittal recorded by the trial court.\n<\/p>\n<p>Thus,<br \/>\n\tit is a settled principle that while exercising appellate power,<br \/>\n\teven if two reasonable conclusions are possible on the basis of the<br \/>\n\tevidence on record, the appellate court should not disturb the<br \/>\n\tfinding  of acquittal recorded by the trial court.\n<\/p>\n<p>Even<br \/>\n\tin a recent decision of the Apex Court in the case of State<br \/>\n\tof Goa V. Sanjay Thakran &amp; Anr. Reported in (2007)3 SCC 75,<br \/>\n\tthe  Court has reiterated the powers of the High Court in such<br \/>\n\tcases, more particularly in para 16 of the said decision.\n<\/p>\n<p>Similar<br \/>\n\tprinciple has been laid down by the Apex  Court  in the cases of<br \/>\n\tState<br \/>\n\tof Uttar Pradesh Vs. Ram Veer Singh &amp; Ors, reported in 2007 AIR<br \/>\n\tSCW 5553<br \/>\n\tand in Girja<br \/>\n\tPrasad (Dead) by LRs Vs. state<br \/>\n\tof MP, reported in 2007 AIR SCW 5589.\n<\/p>\n<p>\tThus, the powers which this Court may exercise against an order of<br \/>\n\tacquittal are well settled.\n<\/p>\n<p>It<br \/>\n\tis also a settled legal position that in acquittal appeal, the<br \/>\n\tappellate court is not required to re-write the judgment or to give<br \/>\n\tfresh reasonings, when the reasons<br \/>\n\tassigned by the Court below are found to be just and proper. Such<br \/>\n\tprinciple is laid down by the Apex Court in the  case of State<br \/>\n\tof Karnataka Vs. Hemareddy, reported in AIR 1981 SC 1417.\n<\/p>\n<p>Thus,<br \/>\n\tin case the  appellate court agrees with the reasons and the opinion<br \/>\n\tgiven by the lower court, then the discussion of evidence is not<br \/>\n\tnecessary.\n<\/p>\n<p>I<br \/>\n\thave gone through the judgment and order passed by the trial court.<br \/>\n\tI have also perused the oral as well as documentary evidence led by<br \/>\n\tthe trial court and also considered the submissions made by learned<br \/>\n\tPP for the appellant-State. From the deposition of the complainant<br \/>\n\tit appears that the complainant has narrated different facts which<br \/>\n\tis not stated in her complaint (Exh. 23).  The alleged incident has<br \/>\n\toccurred in a day time, but no neighbour or independent witness is<br \/>\n\texamined by the prosecution.\n<\/p>\n<p>The<br \/>\n\ttrial Court, after appreciating the oral as well as documentary<br \/>\n\tevidence has found that in Medical Certificate (Exh.35) there is no<br \/>\n\tmention about the injuries sustained by the witness. The trial Court<br \/>\n\talso found that there is contradiction in the evidence of injured<br \/>\n\twitness and the  Medical Certificate. The trial Court has also found<br \/>\n\tthat the panch witness has not supported the case of prosecution and<br \/>\n\the was declared hostile. The trial Court has also found that no<br \/>\n\tfurther statement of the complainant was recorded by the Police. The<br \/>\n\ttrial Court has also observed that the place of complainant where<br \/>\n\tthe alleged incident has occurred is on the road, but, the<br \/>\n\tprosecution has not examined any neighbour as an independent witness<br \/>\n\tto support its case. The trial Court has also found from the record<br \/>\n\tthat the complainant and her husband are going to do labour work at<br \/>\n\tthe place of accused and the accused is not paying money to them<br \/>\n\ttowards labour work. However, no notice for demanding their dues is<br \/>\n\tissued to the accused or no witness has been examined to support the<br \/>\n\tsay of complainant. The trial Court has also found that there are<br \/>\n\tserious lacunae in the evidence of witnesses. Nothing is produced on<br \/>\n\trecord to rebut the concret e findings of the trial Court.\n<\/p>\n<p>Learned<br \/>\n\tPP is not in a position to show any evidence to take a contrary view<br \/>\n\tof the matter or that the approach of the trial court is vitiated by<br \/>\n\tsome manifest illegality or that the decision is perverse or that<br \/>\n\tthe trial court has ignored the material evidence on record.\n<\/p>\n<p>In<br \/>\n\tthe above view of the matter, I am of the considered opinion that<br \/>\n\tthe trial court was completely justified in acquitting the<br \/>\n\trespondent of the charges leveled against him.\n<\/p>\n<p>I<br \/>\n\tfind that the findings recorded by the trial court are absolutely<br \/>\n\tjust and proper and in recording the said findings, no illegality or<br \/>\n\tinfirmity has been committed by it.\n<\/p>\n<p>I<br \/>\n\tam, therefore, in complete agreement with the findings, ultimate<br \/>\n\tconclusion and the resultant order of acquittal recorded by the<br \/>\n\tcourt below and hence find no reasons to interfere with the same.<br \/>\n\tHence the appeal is hereby dismissed. The Judgment and order dated<br \/>\n\t13.03.2003 passed by the learned Magistrate, in Criminal Case No.<br \/>\n\t3579 of 1997 is hereby conformed.
