Justice K.SURENDRA MOHAN\n\n Dated :30\/04\/2010\n\n O R D E R\n                K.SURENDRA MOHAN, J.\n             -------------------------------------------\n                W.P.(C) No.14038 of 2010\n             -------------------------------------------\n          Dated this the 30th day of April, 2010\n\n                          JUDGMENT\n<\/pre>\n<p>    The petitioner is an Association of apartment owners<\/p>\n<p>who are occupying a building complex by name &#8216;Krishna<\/p>\n<p>Manor Apartments&#8217;.        There are 11 apartments in the<\/p>\n<p>building complex. The petitioner association is registered<\/p>\n<p>under the Travancore Cochin Literary, Scientific and<\/p>\n<p>Charitable Societies Registration Act.<\/p>\n<p>      2. The petitioner association has filed this Writ<\/p>\n<p>Petition challenging the exorbitant bills issued to them by<\/p>\n<p>the Kerala Water Authority. It is their specific contention<\/p>\n<p>that water charges are being demanded after issuing bills<\/p>\n<p>in violation of Ext.P6 judgment of this Court. In Ext.P6<\/p>\n<p>judgment, this Court had directed the third respondent to<\/p>\n<p>receive the current bi-monthly water charges from the<\/p>\n<p>petitioner association.      As per Ext.P6, this Court had<\/p>\n<p>further directed the petitioner association to file an appeal<\/p>\n<p>challenging the arrears of water charges fixed by the<\/p>\n<p>Kerala Water Authority.           Accordingly, the petitioner<\/p>\n<p>association has filed an appeal, a copy of which is Ext.P7.<\/p>\n<p><span class=\"hidden_text\">wpc No.14038\/2010          2<\/span><\/p>\n<p>   However, Ext.P7 appeal is still pending consideration of<\/p>\n<p>   the second respondent.       The petitioner&#8217;s association<\/p>\n<p>   complains that in spite of the direction contained in<\/p>\n<p>   Ext.P6, the third respondent has refused to accept the<\/p>\n<p>   current water charges from the petitioner association from<\/p>\n<p>   February 2006.     Thereafter, the second respondent is<\/p>\n<p>   issuing bills claiming exorbitant amounts as interest and<\/p>\n<p>   surcharge. Therefore, the petitioner association contends<\/p>\n<p>   that the bills are liable to be quashed.       The third<\/p>\n<p>   respondent has also threatened to disconnect the supply of<\/p>\n<p>   water to the apartment complex.     Therefore, they seek<\/p>\n<p>   appropriate directions from this Court.<\/p>\n<p>         3. The counsel for the Water Authority opposes the<\/p>\n<p>   contentions of the petitioner association.  According to<\/p>\n<p>   him, Ext.P7 has already been disposed of and thereafter,<\/p>\n<p>   Ext.P10 bill has been issued. Exts.P12 and P14 show the<\/p>\n<p>   amounts that are due and payable by the petitioner<\/p>\n<p>   association.   According to the counsel for the Water<\/p>\n<p>   Authority, unless the amount in Ext.P14 bill is paid,<\/p>\n<p>   further action as contemplated by law would be initiated.<\/p>\n<p>         4. Having considered the rival contentions of the<\/p>\n<p><span class=\"hidden_text\">wpc No.14038\/2010           3<\/span><\/p>\n<p>   parties and the documents produced in support thereof, I<\/p>\n<p>   am of the opinion that since Exts.P7 and P11 are pending<\/p>\n<p>   consideration of the second respondent, it is better that<\/p>\n<p>   the issue is initially decided by the said authority.<\/p>\n<p>   However, for the issue of such a direction to the 5th<\/p>\n<p>   respondent, payment of a portion of the amount claimed in<\/p>\n<p>   Ext.P14 bill is also necessary.\n<\/p>\n<p>         5. In the above circumstances, this writ petition is<\/p>\n<p>   disposed of directing the petitioner to pay an amount of<\/p>\n<p>   Rs.32000\/-, which represents 50% of the total amount<\/p>\n<p>   claimed in Ext.P14 bill, within a period of two weeks from<\/p>\n<p>   the date of receipt of a copy of this judgment.
