                    learned counsel for the State.\n<\/p>\n
                                The petitioner is aggrieved by the order dated<\/p>\n
                    29.1.2011 passed by the District Teachers Employment<\/p>\n
                    Appellate Authority, Sitamarhi in Case No. 98 of 2010, by<\/p>\n
                    which the appeal filed by respondent No.9, Gunjan<\/p>\n
                    Kumari, has been allowed and the appointment of the<\/p>\n
                    petitioner has been cancelled and it has been directed to
\n                    2<\/span><\/p>\n
appoint the respondent No.9 on the post of Panchayat<\/p>\n
Teacher.\n<\/p>\n
            The petitioner along with others had applied<\/p>\n
for appointment on the post of Panchayat Teacher. Out of<\/p>\n
a total of seven posts, two were reserved for unreserved<\/p>\n
Female Category, against which the petitioner as also<\/p>\n
respondent No.9 along with others had applied. It is not in<\/p>\n
dispute that respondent No.9 was higher on the merit list<\/p>\n
but ultimately the petitioner was appointed against the<\/p>\n
second post of unreserved Female Category. On learning<\/p>\n
about the selection of the petitioner, respondent No.9<\/p>\n
approached the respondent authorities and thereafter filed<\/p>\n
a writ petition before this Court. The writ petition, being<\/p>\n
C.W.J.C. No.5619\/2008, was disposed of with liberty to<\/p>\n
the petitioner to approach the Appellate Authority. On the<\/p>\n
appeal so filed by respondent No.9, the impugned order<\/p>\n
has been passed.\n<\/p>\n
            Learned counsel for the petitioner assails the<\/p>\n
order of the Appellate Authority that no clear-cut finding<\/p>\n
has been given as to whether the respondent No.9 was<\/p>\n
present at the time of counseling or not and thus it was not<\/p>\n
open to the Appellate Authority to cancel the appointment
\n                   3<\/span><\/p>\n
of the petitioner and direct the appointment of respondent<\/p>\n
No.9 merely on the ground that respondent No.9 had<\/p>\n
higher marks than the petitioner. It is submitted that the<\/p>\n
communication for appearing at the counseling was given<\/p>\n
to all the candidates Under Certificate of Posting on the<\/p>\n
basis of which the petitioner had appeared for counseling;<\/p>\n
if the respondent No.9 had not taken any heed of the said<\/p>\n
communication, then she was not entitled to be appointed.<\/p>\n
            Learned counsel for the State, on the other<\/p>\n
hand, submits that the communication Under Certificate of<\/p>\n
Posting is not a proper mode of communication and is<\/p>\n
open to gross misuse unlike communication through<\/p>\n
registered post with A\/D. It is thus submitted by him that<\/p>\n
the order of the Appellate Authority is not fit to be<\/p>\n
interfered with as it has come to the conclusion that the<\/p>\n
documents relating to the appointment process had not<\/p>\n
been published as per the materials available on the<\/p>\n
record.\n<\/p>\n
            On   a    consideration   of   the   facts   and<\/p>\n
circumstances of the case and the submissions of learned<\/p>\n
counsels for the petitioner and for the State, this Court is<\/p>\n
of the view that any communication to appear at the
\n                         4<\/span><\/p>\n
      counseling under Certificate of Posting is not a reliable or<\/p>\n
      valid mode of communication and is open to grave<\/p>\n
      misuse. It is the admitted position that respondent No.9<\/p>\n
      had higher marks on the merit list and thus she was<\/p>\n
      entitled to proper communication for appearing at the<\/p>\n
      counseling. Admittedly, the same was not done by sending<\/p>\n
      a notice to appear under registered post with A\/D, rather it<\/p>\n
      is claimed to have been sent Under Certificate of Posting.<\/p>\n
                  In that view of the matter, this Court is of the<\/p>\n
      view that the communication for counseling was not sent<\/p>\n
      to the respondent No.9 under a valid mode<\/p>\n
                  The   aforesaid   being    the   position,   the<\/p>\n
      impugned order of the Appellate Authority is not fit to be<\/p>\n
      interfered with in the opinion of this Court, as it has<\/p>\n
      directed the appointment of a person having admittedly<\/p>\n
      more marks than the petitioner and who had not been<\/p>\n
      communicated about the date of counseling in a proper<\/p>\n
      manner.\n<\/p>\n
                  The writ application, being devoid of merit, is<\/p>\n
      accordingly dismissed.\n<\/p>\n<\/p>\n
