On the same day, the learned J.M.F.C. passed<br \/>\norder to hold inquiry under Section 202 of Criminal Procedure Code<br \/>\nand the complainant was directed to remain present along with the<br \/>\nwitnesses, if any, on 14.3.2011. On the same day i.e. on 28.2.2011,<br \/>\nthe complainant filed a pursis and declared that he does not want to<br \/>\nexamine any witnesses at this stage. In spite of this declaration<br \/>\nfiled by the complainant, the trial Court has not passed any order on<br \/>\nthe complaint and simply adjourned the matter to 9.5.2011. Hence,<br \/>\nthis petition is filed seeking some order or direction.\n<\/p>\n<p>\t\tThe<br \/>\nlearned J.M.F.C., Prantij is hereby directed to decide and dispose of<br \/>\nthe matter being Inquiry Case No.1 of 2011 as early as possible after<br \/>\nexamining the complainant, as the complainant is not inclined to<br \/>\nexamine any witnesses, on its own merits, in accordance with law and<br \/>\nwithout being influenced by the order passed by this Court. It is<br \/>\nclarified that if any application for preponing the date is made by<br \/>\nthe applicant, the trial Court will consider the same and dispose of<br \/>\nthe matter as directed hereinabove.\n<\/p>\n<p>\t\tWith<br \/>\nthe above direction, this petition is disposed of.
