Dabhi, learned APP appears and waives service of notice of Rule<br \/>\n\ton behalf of the respondent &#8211; State of Gujarat.\n<\/p>\n<p>Having<br \/>\n\tregard to the facts of the case, the application is taken up for<br \/>\n\thearing today.\n<\/p>\n<p>The<br \/>\n\tapplicant &#8211; convict prisoner, who, vide judgment and order<br \/>\n\tdated 29\/10\/2004 rendered in Sessions Case No. 122 of 2000 by the<br \/>\n\tLd. Addl. Sessions Judge, Court No. 5, District Rajkot at  Gondal,<br \/>\n\thas been convicted for the offence punishable under Sections 302,<br \/>\n\tetc. of the Indian Penal Code and sentenced to imprisonment for<br \/>\n\tlife, has filed this application through  jail authority, praying to<br \/>\n\tenlarge him on temporary bail of 60 days to enable him to get<br \/>\n\trenovation of his house which has become dilapidated.\n<\/p>\n<p>We<br \/>\n\thave considered submissions advanced by Mr. L.B. Dabhi, Ld. APP for<br \/>\n\tthe respondent &#8211; State of Gujarat. We  have also perused the<br \/>\n\taverments made in the application and also the supporting documents<br \/>\n\tthat form part of the application and the jail remark sheet<br \/>\n\tforwarded by the jail authority along with the application.\n<\/p>\n<p>Upon<br \/>\n\tperusal of the jail remark sheet, we have noticed that the applicant<br \/>\n\thas undergone total period of   9 years and 6 months&#8217; imprisonment<br \/>\n\tand during that period, he  was released on furlough leave on five<br \/>\n\toccasions. While enjoying last furlough leave I.e. in the year 2008,<br \/>\n\the has not surrendered before the jail authority and he has<br \/>\n\tabsconded for a period of 34 days and thereafter,  he has<br \/>\n\tsurrendered. Beside this, the conduct in the jail is also not<br \/>\n\tsatisfactory and he was convicted under the Prisons Act and sentence<br \/>\n\tof fine of Rs.400\/-, indefault of payment of fine, simple<br \/>\n\timprisonment for 60 days was awarded.\n<\/p>\n<p>In<br \/>\n\tview of the aforesaid, we are not inclined to enlarge the applicant<br \/>\n\ton temporary bail for a period of 60 days for the ground stated by<br \/>\n\thim.  However, since the applicant has undergone  total period of 9<br \/>\n\tyears and 6 months&#8217; imprisonment as against the life imprisonment,<br \/>\n\tso also the paper book is ready,  according to us,  if the hearing<br \/>\n\tof the appeal is expedited,  the  same would meet the ends of<br \/>\n\tjustice.\n<\/p>\n<p>For<br \/>\n\tthe foregoing reasons, the Application fails and accordingly it is<br \/>\n\trejected. However, on the facts and circumstances emerging on the<br \/>\n\trecord of the case,  Registry is directed to notify the above<br \/>\n\tnumbered Criminal Appeal on final hearing board in seriatim.
