The&#039;    ufheappe\ufb01ant was a pillion rider of\nthe Motor   with an accident resulting in injury\n\nto the appellal\u00e9zlthll   was admiited in hospital and even\n\n~af_te:r hfeatn3_ent,,_ waa&quot;fo1::2.d&#039; to have su\ufb02ered permanent disability. in\n\n  -he had appmached Meter Accidents Claims\n\nV  ~:el.aimed for compensation. The Tribunal on\n\n consiiefa\ufb01da  the petition and on contest by the insurer, has\n\n  total sum of Rs.1,8{},(){)O\/ ~. It is contended that the appellant has been  just\namount of cmnpensation, having regard to the  &#039;sf\npermanent disabiiity, which has been\u00bb..\u00bbig13Q;e+-\u00e9idd \nproceeding is make an assessment     5\nincome attributed to compute tl1\u00a2:&#039;:_ss1;.1e.  is \nmedical certi\ufb01cate with Iegaxd    su\ufb02ereci\nfrom a disability of 60%   limbs resulting in a\nlarge disability to the_whmpe;nsa\ufb02on under the several heads.\n\n  V The comes} for the respondent on the other hand would point<\/pre>\n<p> out that the primary contention of the sppe\ufb01ant as regards disability,<\/p>\n<p><span class=\"hidden_text\">6<\/span><\/p>\n<p>4 NWA 1938552006<\/p>\n<p>is not supported by evidence. In this regard the counsel points out<br \/>\nthat the medical practitioner has merely stated that the  in<br \/>\nrelation to the lower limbs was 60 to 65%. in :&#8221;\u00a5,_l16<br \/>\nTribunal llas, therefore, questioned the xxaeziical<br \/>\nto ascertain as to the percentage of<br \/>\nlimbs and lower limbs separately. ,e&#8221;i&#8217;c_. whiclllthe<br \/>\nhas zeplied that the disability to the tc:\u00a71(l&#8217;l\u00b0\/o and the<br \/>\nremaining percentage of  ~- to the lower<br \/>\nlimbs. If this is taken m;g%~l~.%:he Tribunal having<\/p>\n<p>adopted a percentage&#8217; 011 a speculative basis<\/p>\n<p>and   -d\ufb02i\ufb02sa\ufb01ility is to a larger extent,<br \/>\nwhich has ntl\ufb01been  cannot be accepted.
