MUKHTAR RASHID\n                                             Versus\n                                   THE STATE OF BIHAR\n                                           -----------\n<\/pre>\n<p>02\/   28.02.2011          Both the above stated criminal miscellaneous cases have<\/p>\n<p>                   arisen out of Gandhi Maidan P.S. Case no. 402\/2010 initially,<\/p>\n<p>                   registered under sections 379 of the IPC and subsequently, section 411<\/p>\n<p>                   of the IPC was added. Accordingly, both the above stated cases have<\/p>\n<p>                   been disposed of by this common order.\n<\/p>\n<p>                              Heard learned counsel for the petitioners as well as learned<\/p>\n<p>                   P.P. for the State.\n<\/p>\n<p>                              Although petitioners are not named in the FIR but during<\/p>\n<p>                   the course of investigation petitioner in Cr. Misc.no.1782\/2011 was<\/p>\n<p>                   apprehended and it appears from seizure list that one coupon through<\/p>\n<p>                   which stolen motorcycle had been parked at the motorcycle stand of<\/p>\n<p>                   Hajipur Railway Junction was recovered from the possession of the<\/p>\n<p>                   aforesaid petitioner and apart from this, some keys were also<\/p>\n<p>                   recovered from his possession. So far as petitioner in Cr.<\/p>\n<p>                   Misc.no.3444\/2011 is concerned, his name surfaced in this case in the<\/p>\n<p>                   confessional statement of co-accused Md Rashid who is petitioner in<\/p>\n<p>                   Cr. Misc.no.1782\/2011.\n<\/p>\n<p>                              The impugned order of the learned Addl. Sessions Judge<\/p>\n<p>                   does not disclose criminal antecedent of petitioner in Cr.<\/p>\n<p>                   Misc.no.1782\/2011.\n<\/p>\n<p>                    In view of the aforesaid facts and circumstances as well as<\/p>\n<p>         submissions of the parties, petitioners (Md Rashid and Md. Mukhtar<\/p>\n<p>         Rashid) are directed to be released on bail in connection with Gandhi<\/p>\n<p>         Maidan P.S.
