Sahran for the respondents.\n<\/p>\n<\/p>\n<p>       By this petition for writ, a direction is sought by the<\/p>\n<p>petitioner for respondents to allow her family pension being<\/p>\n<p>widow of late Shri Bheru Singh, who died on 02.07.1985 while in<\/p>\n<p>services of respondent Irrigation Department.<\/p>\n<p>       Facts necessary to be noticed are that late Shri Bheru<\/p>\n<p>Singh &#8211; husband of the petitioner entered in the services of the<\/p>\n<p>respondents as a work charge employee on 08.03.1969. Semi<\/p>\n<p>Permanent Status and Permanent Status were conferred to him<\/p>\n<p>on 28.03.1971 and 27.09.1979 respectively. After death of Shri<\/p>\n<p>Bheru Singh on 02.07.1985, appointment was given to his son<\/p>\n<p>Shri Bhanwar Singh on compassionate grounds and a payment in<\/p>\n<p>tune   of   Rs.3092.50   was   made      to   the   petitioner   against<\/p>\n<p>Contributory Provident Fund.           By an application dated nil<\/p>\n<p>(Annexure 2), son of the present petitioner claimed family<\/p>\n<p>pension for his mother and that was forwarded to the competent<\/p>\n<p>authority i.e. The Assistant Director, State Insurance-cum-<\/p>\n<p>Provident Fund Department, Government of Rajasthan, Jaipur.<\/p>\n<p>The Assistant Director, State Insurance-cum-Provident Fund<br \/>\n<span class=\"hidden_text\">                                       2<\/span><\/p>\n<p>Department, Jaipur vide letter dated 25.10.1993, instructed the<\/p>\n<p>Assistant Engineer, IGNP, District Sub Division I, Mahajan,<\/p>\n<p>Bikaner that pension can be given to the present petitioner, if<\/p>\n<p>she   deposits    State    Government&#8217;s        contribution    relating    to<\/p>\n<p>Provident Fund.     The petitioner accordingly deposited a sum of<\/p>\n<p>Rs.1,458\/- vide receipt No.C 000065\/211664 dated 15.03.1995.<\/p>\n<p>The petitioner also completed all necessary formalities for the<\/p>\n<p>grant of family pension and she also opted for pension. A<\/p>\n<p>decision was also taken by the respondents to allow her pension,<\/p>\n<p>however, subsequent thereto, the Joint Director, Department of<\/p>\n<p>Pension and Pensioners Welfare, Bikaner vide letter Annexure 12<\/p>\n<p>conveyed that in light of the communication dated 23.01.2006<\/p>\n<p>from the office of the Dy. Secretary to the Government of<\/p>\n<p>Rajasthan, Department of Finance (Revenue), the pension case<\/p>\n<p>already settled earlier cannot be reopened.                 By an another<\/p>\n<p>communication dated 31.10.2006, it was also communicated to<\/p>\n<p>the petitioner that Shri Bheru Singh died on 02.07.1985 and as<\/p>\n<p>such the Circular dated 01.10.1986 relating to grant of pension<\/p>\n<p>after completion of 10 years of service and opting for pension at<\/p>\n<p>subsequent       stage    was   not       applicable   to   him.   In     the<\/p>\n<p>circumstances above, this petition for writ is preferred.<\/p>\n<p>      In reply to the writ petition, sole contention of the<\/p>\n<p>respondents is that husband of the petitioner was a member of<\/p>\n<p>Contributory Provident Fund Scheme, as such he was not entitled<\/p>\n<p>for any pensionary benefits and for the same reason no family<\/p>\n<p>pension can be given to the present petitioner.<br \/>\n<span class=\"hidden_text\">                                    3<\/span><\/p>\n<p>      Heard learned counsel for the parties and considered the<\/p>\n<p>rival contentions.\n<\/p>\n<\/p>\n<p>      It is not in dispute that husband of the petitioner late Shri<\/p>\n<p>Bheru Singh entered in services of the respondents as a work<\/p>\n<p>charge employee on 08.03.1969 and Permanent Status was<\/p>\n<p>confirmed to him on 27.09.1979.           Shri Bheru Singh died on<\/p>\n<p>02.07.1985 i.e. after completing services for a term of more<\/p>\n<p>than 15 years.       True it is, no option was given by Shri Bheru<\/p>\n<p>Singh for accepting pension in his life time as at that time, no<\/p>\n<p>opportunity in this regard was available to him. It is the position<\/p>\n<p>admitted that after death of Shri Bheru Singh, the present<\/p>\n<p>petitioner submitted an option form in prescribed proforma for<\/p>\n<p>pension and that was as per the instructions given by the<\/p>\n<p>Assistant   Director,      State   Insurance-cum-Provident       Fund<\/p>\n<p>Department.          The   petitioner   also   deposited   the   State<\/p>\n<p>Government&#8217;s contribution as per the directions given by the<\/p>\n<p>competent authority for receiving family          pension.   In such<\/p>\n<p>circumstances, there was no occasion for denying family pension<\/p>\n<p>to the petitioner.      So far as the Circular dated 04.09.2006<\/p>\n<p>(Annexure 13) is concerned, it certainly refers for grant of<\/p>\n<p>pension to the persons, who have completed 10 years of service<\/p>\n<p>on opting the same and admittedly no option was submitted by<\/p>\n<p>Shri Bheru Singh before his death. As a matter of fact, there was<\/p>\n<p>no opportunity available to him to do so, as the circular in this<\/p>\n<p>regard was issued after his death.       In such circumstances, the<\/p>\n<p>opportunity to opt for pension was availed by the present<\/p>\n<p>petitioner and once she was permitted to opt for pension, there<br \/>\n<span class=\"hidden_text\">                                              4<\/span><\/p>\n<p>        was no ground available to the respondents to deny family<\/p>\n<p>        pension to her. the petitioner. Beside, this Court in the case of<\/p>\n<p>        Sujan Singh vs. State of Rajasthan reported in 1991 WLR(s) 340<\/p>\n<p>        held that an employee declared permanent under the Rajasthan<\/p>\n<p>        &#8220;Work Charged Rules, 1964 is to be treated as a regular<\/p>\n<p>        Government servant and is entitled for all benefits for which a<\/p>\n<p>        regular Government servant is entitled. In view of the law laid<\/p>\n<p>        down by this Court in the case of Sujan Singh (supra), the<\/p>\n<p>        petitioner&#8217;s husand is to be treated as Permanent government<\/p>\n<p>        servant and on that count too, she is to be treated as a widow of<\/p>\n<p>        regular     government     servant       and,   therefore,     entitled   for<\/p>\n<p>        pensionary benefits as available to other regular government<\/p>\n<p>        servants.\n<\/p>\n<\/p>\n<p>             Accordingly,   this    petition      for   writ   is   allowed.      The<\/p>\n<p>        respondents are directed to accept the petitioner&#8217;s case for grant<\/p>\n<p>        of family pension from the date of death of her husband late Shri<\/p>\n<p>        Bheru Singh. The pensionary benefits accorded to the petitioner<\/p>\n<p>        as a consequent to the directions above are to be applied and<\/p>\n<p>        given to her within a period of three months from today, failing<\/p>\n<p>        to which the petitioner shall further be entitled for interest @<\/p>\n<p>        8.5% per annum on the amount due.\n<\/p>\n<p>             No order to cost.\n<\/p>\n<p>                                                         (GOVIND MATHUR)J.\n<\/p>\n<p>\nAnil\/\n <\/p>\n","protected":false},"excerpt":{"rendered":"<p>Rajasthan High Court &#8211; Jodhpur Smt.
