\n\tlearned advocate Mr. PS Patel on behalf of petitioner, learned AGP
\n\tMr. AL Sharma appearing for respondent.\n<\/p>\n
According
\n\tto facts of present petition, Mamlatdar issued birth certificate,
\n\twhere date of birth is recorded as 17\/1\/1961 but in fact real date
\n\tof petitioner is 19\/1\/1961.  Therefore, date of birth recorded in
\n\tSchool Leaving Certificate, Passport and Pan card is  19\/1\/1961.\n<\/p>\n
Learned
\n\tadvocate Mr. Patel submitted that Mamlatdar has issued birth
\n\tregister certificate where date of birth of petitioner is wrongly
\n\trecorded, which would require correction, for that, let petitioner
\n\tmay make detailed representation to Mamlatdar, Taluka Siddhpur,
\n\tDistrict Patan within a period of fifteen days while annexing
\n\trelevant documents which has been relied by petitioner.\n<\/p>\n
As
\n\tand when Mamlatdar, Siddhpur receive representation from petitioner,
\n\tit is directed to Mamlatdar to consider representation made by
\n\tpetitioner in light of decision of Division Bench of this Court in
\n\tcase of Regional Passport Officer Vs. Jaswantlal Panchal & Ors
\n\treported in 2009 (2) GLR 1246.  The relevant para 9 to 12 are quoted
\n\tas under:\n<\/p>\n
 9.\tWe may
\nindicate that Registration of Births and Deaths Act, 1969 was enacted
\nto provide for births and deaths and matters connected therewith,
\nwhich came into force with effect from 1.4.1970.  Chapter 3 of the
\nAct provides for registration of births and deaths and Section 13 is
\npertaining to delayed registration of births and deaths.  Sub-section
\n(3) of Section 13 empowers a Magistrate of the First Class to pass an
\norder in case if birth or death is not registered within one year by
\nits occurrence.  Initial registration of births and deaths within a
\nperiod of one year remain with the authority as provided under
\nsub-section (1) and sub-section (2) of Section 13 of the Act.
\nSection 15 of the Act deals with correction or cancellation of
\nentries in the register of Births and Deaths.  Section 15 of the Act,
\nread with Rule 11 of the Gujarat Registration of Births and Deaths
\nRules, 2004 provides for detailed procedure to be followed.  It says
\nwhere it is proved to the satisfaction of the registrar that any
\nentry of a birth or death in any register kept by him under this Act
\nis erroneous in form or substance, or has been fraudulently or
\nimproperly made, he may, subject to such rules as may be made by the
\nState Government with respect to the conditions on which and the
\ncircumstances in which such entries may be or cancel the entry by
\nsuitable entry in original entry, and shall sign the marginal entry
\nand add thereto the date of the correction or cancellation.  Thus, it
\nis clear that if it is proved to the satisfaction of the Registrar
\nthat entry being erroneous in the register of births and deaths, and
\nit has been fraudulently or improperly made, he can make a report
\ngiving necessary details to the officer authorised by the Chief
\nRegistrar by general or special order in this behalf under Section 25
\nof the Act and on hearing from him, take necessary action in the
\nmatter.  Learned Single Judge of this Court in Nitaben Nareshbhai
\nPatel Vs. State of Gujarat   2008 (1) G.L.R 884 elaborately
\nconsidered the scope of above mentioned provisions, and the learned
\nSingle Judge also examined at length the provisions of Gujarat
\nSecondary Education Act, 1972 and Gujarat Secondary Education
\nRegulation, 1974.  With regard to the change of date of birth entered
\nin the school record, referring to Regulation 12(A), it was stated
\nthat if the student has actually left the school, no change can be
\neffected in the record of the school.  For making a change in the
\nname, as provided under Regulation 12(5)(1), an application in
\nprescribed proforma with certain documents as narrated in Regulation
\n5(1)(A) to (D) are required to be submitted.   Regulation 12(6) deals
\nwith correction of date of birth, which is permissible only when
\nstudent is studying in the school, and thereafter it can be corrected
\nby the concerned Magistrate of First Class, upon proof of correct
\nbirth date.\n<\/p>\n
10.\tReference may
\nalso be made to the order passed by the Division Bench of this Court
\nin Letters Patent Appeal No. 699 of 2003 in Special Civil Application
\nNo. 8122 of 2003, decided on 11.8.2003 (unreported). In Minor
\nJagdishbhai Prabhatbhai Gohil Vs. State of Gujarat and others,
\nreferring to Gujarat Secondary Education Regulation, this Court took
\nthe view that the only remedy available to the party with regard to
\ncorrection of date of birth\/place of birth is to approach the
\nauthority for redressal of his grievance as provided under Section 13
\nof the Act.\n<\/p>\n
11.\tThe above
\ndiscussion would amply show that for carrying out correction of date
\nof birth or place of birth or name, powers have been conferred under
\nthe Act on the Registrar as well as the Judicial Magistrate, as the
\ncase may be, and also Magistrate First Class when the correction is
\nsought to be made in school record, which is governed by Gujarat
\nSecondary Education Act, 1972 and Regulation framed thereunder.\n<\/p>\n
12.\tWe are
\ntherefore, clearly of the view that Passport Authorities are not
\nexpected to make their own independent enquiry when there is a
\ndispute or difference with regard to the date of birth, place of
\nbirth or name entered in the Passport, especially when entries were
\nonce made on the basis of records produced by  the Passport holder.
\nIf there is any mistake on the records already produced, based on
\nwhich entries were already made, then it is for the party who seeks
\ncorrection to produce documents after carrying out necessary
\ncorrection by the concerned statutory authorities, Judicial
\nMagistrate or the Civil Court, as the case may be.  Passport
\nAuthorities are always competent to direct the parties to produce
\nrelevant documents either from the authorities functioning under the
\nBirths and Deaths Register or from the Judicial Magistrate or from
\nthe Civil Court, as the case may be. On production of corrected
\ndocuments, Passport Authorities will immediately carry out necessary
\ncorrection in the Passport.\n<\/p>\n
Thereafter,
\n\tto pass appropriate reasoned order in accordance with law within a
\n\tperiod of three months from date of receiving copy of representation
\n\tfrom petitioner and communicate decision to petitioner immediately.\n<\/p>\n
In
\n\tview of above observation and direction, present petition is
\n\tdisposed of by this Court without expressing any opinion on merits.
\n\tDirect service is permitted.\n<\/p>\n
