State of Maharstra &amp; Others<br \/>\nreported in (2004) 7<br \/>\nSCC 768 and <a href=\"\/doc\/325716\/\">Aleque<br \/>\nPadamse And others v. Union of India and Others<\/a> reported<br \/>\nin (2007) 6 SCC 171<br \/>\n as well as this<br \/>\nCourt in the case of <a href=\"\/doc\/1826647\/\">Kanubhai Shamjibhai Dayani &amp; Anr v. State<br \/>\nof Gujarat &amp; Ors<\/a> reported<br \/>\nin 2007 (3) GLR 2684, Shri Brahmbhatt, learned advocate<br \/>\nfor the petitioner seeks permission to withdraw the present petition<br \/>\nwith a liberty to file a private complaint under Section 154 of the<br \/>\nCode of Criminal Procedure. Shri Brahmbhatt, learned advocate for the<br \/>\npetitioner has stated at the bar that petitioner may pray for police<br \/>\ninvestigation under Section 156(3) of the  Code of Criminal<br \/>\nProcedure.\n<\/p>\n<p>2.0.\tIn<br \/>\nview of the above, without further entering into the merits of the<br \/>\ncase and \/ or expressing anything on merits, present application is<br \/>\ndismissed as not pressed with above liberty. As and when, any private<br \/>\ncomplaint is made, the same be considered in accordance with law and<br \/>\non merits and even prayer of the petitioner for sending the said<br \/>\ncomplaint for police investigation under Section 156(3) of the Code<br \/>\nof Criminal Procedure, be considered in accordance with law, for<br \/>\nwhich this Court has not expressed anything on merits.
