\nalong    Jsresiding at Savadi Village. As<\/p>\n
aec\ufb01d\u00e9rxi respbndeet dssaulted her, she came to her parental<\/p>\n
  a month prior to the incident in question<\/p>\n

”  house of Dawalbi with an intention of taking his<\/p>\n
Adfwife back with him to the matrimonial home. Not only the<\/p>\n
” parents of Dawalbi said Bawalbi also refused ta go back with<\/p>\n
the accused. In that quarrei, he is said to have assaulted
\nhm’ by a pounding stalk on her head as a result she died at<\/p>\n
the spot.\n<\/p>\n<\/p>\n
3. A case came to be registered for the ‘Jo\ufb01ence<\/p>\n
punishable imdm Smtion 302 IPC against <\/p>\n
accused on the basis of the complaint of  <\/p>\n

 one  was gven on the head of the deceased by the<\/p>\n
A “ii po\ufb01nding stalk, the learned Judge properly opined that<\/p>\n
 :\u00a7%11g1*a\u00a3i;iet1ts to form the o\ufb01ence punishable under Section<\/p>\n
302 of IPC Wm: absent as there was no intention to kill the
\ndeceased wife and also having rmard. to the fact of one single
\nblow being given, concluded that offence was punishabie
\nunder Section 30441 of EPC. The observations of the learned<\/p>\n
Sessions Judge and the quantum of sentence irrmosed is<\/p>\n
appmprhtc to the o\ufb01cxzce established by the prosmution, <\/p>\n
