MUKHOPADHAYA)<\/p>\n<p>\tWhen<br \/>\nthe case was taken up on 6th April, 2011, the  Court passed following<br \/>\norder:-\n<\/p>\n<p>&#8220;Pursuant<br \/>\nto the Court&#8217;s order dated 9.3.2011, Ms Sonal Mishra, IAS, Director<br \/>\nof Municipalities, Gujarat State appeared in person and explained the<br \/>\nmatter.  It was pointed out that after the show cause notice under<br \/>\nSection 37 of the Gujarat Municipalities Act, 1993 was issued on<br \/>\n15.9.2009, certain clarifications were called for from the Collector,<br \/>\nBanaskantha at Palanpur.  While the officer was awaiting for the<br \/>\nreport of the Collector, the President ceased to be a Councillor on<br \/>\n8.11.2010 and the 6th respondent ceased to be a Councillor<br \/>\non 23.10.2010.  In this background, the proceedings under Section 37<br \/>\nhaving become infructuous, the show cause notice was withdrawn.\n<\/p>\n<p>2.\tThe<br \/>\nlearned counsel appearing on behalf of the 6th respondent<br \/>\nsubmits that the 6th respondent ceased to be a Councillor<br \/>\npursuant to the earlier election.  Now pursuant to the recent<br \/>\nelection, he has again been elected as a Councillor of the Palanpur<br \/>\nMunicipality.  He could understand the mistake committed by<br \/>\nconstructing a school building over the panchayat land and,<br \/>\ntherefore, the said building has been handed over to the State.\n<\/p>\n<p>3.\tThe<br \/>\nlearned counsel appearing on behalf of the State produced the<br \/>\nproceeding dated 28.3.2011 of the Palanpur Municipality to suggest<br \/>\nthat the charge of the building has already been taken over and a<br \/>\nschool is being run thereon.\n<\/p>\n<p>4.\tThe<br \/>\nlearned counsel for the petitioner sought for and is allowed to<br \/>\nobtain instructions and file rejoinder, if any.\n<\/p>\n<p>5.\tThe<br \/>\nMunicipality and the State will file affidavit giving status report<br \/>\nof the building and specifically state as to who is in charge of the<br \/>\nbuilding as was constructed by the 6th respondent on the<br \/>\nland of the Municipality.\n<\/p>\n<p>\tAppearance<br \/>\nof  Ms Sonal Mishra, IAS, Director of Municipalities, Gujarat State<br \/>\nis dispensed with.\n<\/p>\n<p>\tPost<br \/>\nthe matter on 11th May, 2011.&#8221;\n<\/p>\n<p>2.\tNow<br \/>\none affidavit in reply has been filed by the Chief Officer, Palanpur<br \/>\nMunicipality, Palanpur, wherein it is stated that on 3.5.2011 at 6.30<br \/>\nP.M the actual physical possession of the building has been handed<br \/>\nover to the Municipality and at present the building is in possession<br \/>\nand in the charge of the Municipality.\n<\/p>\n<p>3.\tIn<br \/>\nthe affidavit filed by the Deputy Director, Directorate of<br \/>\nMunicipalities, Gujarat State it has been stated that  by<br \/>\ncommunication dated 18th April, 2011 addressed to the Collector,<br \/>\napproval was sought for resuming the possession of the land along<br \/>\nwith the building constructed thereon.  Thereafter, pursuant to the<br \/>\nCollector&#8217;s  reply dated 2nd May, 2011 that no such permission is<br \/>\nrequired for taking over possession, the Nagar Palika has taken over<br \/>\npossession of the land along with the constructions made thereon.\n<\/p>\n<p>4.\tIn<br \/>\nview of such stand taken by the respondents, we hold that the<br \/>\nbuilding in question constructed over the land of the Palanpur<br \/>\nMunicipality now belongs to the said Municipality and neither 6th<br \/>\nrespondent, nor Sagar Education and Charitable Trust or any other<br \/>\nindividual can claim any right over the said property.  The writ<br \/>\npetition stands disposed of with the aforesaid observations.
