DAVE\n\t\t\n\t\n\n \n\n \n \n\n\n \n\nDate\n: 15\/12\/2010 \n\n \n\n \n \nORAL\nORDER<\/pre>\n<p>1.<br \/>\nThis application is filed under Section 438 of the Code of Criminal<br \/>\nProcedure in connection with first information report registered<br \/>\nbeing CR No.I-190 of 2010 with Rander Police Station for the offences<br \/>\npunishable under Sections 406, 420 and 114 of the Indian Penal Code.\n<\/p>\n<p>2.<br \/>\n\t\tLearned Advocate for the applicant submits that the applicant is a<br \/>\nlady and was employed by the travel agency and at the most, the<br \/>\nallegations are of not providing the facilities to the<br \/>\ntourists\/travellers as per the assurance and the amount was collected<br \/>\nby her. However, it is further submitted that the applicant had not<br \/>\npocketed any amount on her own and considering the above aspects, the<br \/>\napplication may be considered.\n<\/p>\n<p>3.<br \/>\nHeard the learned APP for the State. She has vehemently opposed the<br \/>\napplication and submitted that the applicant had collected the money<br \/>\nand therefore, she may not be enlarged on bail.\n<\/p>\n<p>4.\t\tHaving<br \/>\nheard learned counsel for the parties and perusing the record of the<br \/>\ncase and considering the overall facts and circumstances and the role<br \/>\nattributed to the applicant-female employee, I am inclined to grant<br \/>\nAnticipatory Bail on imposing suitable conditions:\n<\/p>\n<p>Learned counsel for the parties do not press for further reasoned<br \/>\norder.\n<\/p>\n<p>5.<br \/>\nIn the result, this application is allowed by directing that in the<br \/>\nevent of the applicant herein being arrested pursuant to FIR being CR<br \/>\nNo.I -190 of 2010 registered with Rander Police Station, the<br \/>\napplicant shall be released on bail on furnishing a bond of<br \/>\nRs.5,000\/- (Rupees Five Thousand only) with one surety of like amount<br \/>\non following conditions :-\n<\/p>\n<p>shall<br \/>\n\tcooperate with the investigation and make available for whenever<br \/>\n\trequired;\n<\/p>\n<p>shall<br \/>\n\tremain present at the concerned Police Station on  22.12.2010 at<br \/>\n\t11.00 a.m.;\n<\/p>\n<p>shall<br \/>\n\tnot hamper the investigation in any manner nor shall directly or<br \/>\n\tindirectly make any inducement, threat or promise to any witness so<br \/>\n\tas to dissuade them for disclosing such facts to the Court or to any<br \/>\n\tPolice Officer;\n<\/p>\n<p>at<br \/>\n\tthe time of execution of bond, furnish the address to the<br \/>\n\tInvestigating Officer and the court concerned and shall not change<br \/>\n\tthe residence till the final disposal of the case of till further<br \/>\n\torders;\n<\/p>\n<p>will<br \/>\n\tnot leave India without the permission of the Court and, if is<br \/>\n\tholding a passport, shall surrender the same before the trial Court<br \/>\n\twithin a week;\n<\/p>\n<p>it<br \/>\n\twould be open to the Investigating Officer to file an application<br \/>\n\tfor remand, if he considers it just and proper and the concerned<br \/>\n\tMagistrate would decide it on merits;\n<\/p>\n<p>this<br \/>\n\torder will be operative if the applicant is arrested at any time<br \/>\n\twithin a period of 90 days;\n<\/p>\n<p>within<br \/>\n\ta period of ten days from the date of arrest, the applicant shall<br \/>\n\tapply for regular bail which application shall be decided by the<br \/>\n\tcompetent Court in accordance with law without being influenced by<br \/>\n\tthe fact that anticipatory bail was granted.\n<\/p>\n<p>6.<br \/>\nWith these directions, this Criminal Misc. Application is disposed<br \/>\nof. Rule is made absolute. Direct Service is permitted.\n<\/p>\n<p>(ANANT<br \/>\nS.
