With the consent of learned counsel appearing for the<br \/>\n     parties, the petition is heard finally.\n<\/p>\n<p>2.   By this petition, the petitioner impugns the order<br \/>\ndated                       17-5-2007 (Annexure &#8211; P\/1) on<br \/>\nthe ground that an amount of Rs.84,598\/- has been directed<br \/>\nto be recovered from the retiral dues of the petitioner.\n<\/p>\n<p>3.   The indisputable facts, in brief, are that the<br \/>\npetitioner working as Lecturer in the Government Girls<br \/>\nHigher Secondary School retired from his service on<br \/>\nattaining the age of superannuation on 30-4-2007.  All of<br \/>\na sudden without assigning any reason and without<br \/>\naffording an opportunity of hearing, the impugned order<br \/>\ndated 17-5-2007 (Annexure &#8211; P\/1) was passed holding that<br \/>\nthe excess payment to the tune of Rs.84,598\/- has been<br \/>\nmade to the petitioner and no retiral dues could be<br \/>\nreleased unless the petitioner deposits a sum of<br \/>\nRs.84,598\/-.  Thus, this petition.\n<\/p>\n<p>4.   Learned counsel appearing for the petitioner submits<br \/>\nthat the issue asto whether recovery of excess payment for<br \/>\nno fault of the employee can be made without following<br \/>\nprinciples of natural justice is no longer res integra,<br \/>\nthe same has been settled by the Supreme Court in the<br \/>\nmatter of <a href=\"\/doc\/554818\/\">Sahib Ram v. State of Haryana and others<\/a>1, and<br \/>\nfurther followed by this Court in the matter of Vidyadhar<br \/>\nTiwari (Supra). In the instant case, the impugned order<br \/>\nhas been passed without affording any opportunity of<br \/>\nhearing to the petitioner.\n<\/p>\n<p>5.   Learned counsel appearing for the State submits that<br \/>\nat the time of submission of application for release of<br \/>\nretrial dues, the petitioner submitted an undertaking that<br \/>\nif any excess payment made to him that may be recoverable<br \/>\nby the Government from his retiral dues.  Learned counsel<br \/>\nrelies on Rule 65 of the Chhattisgarh Civil Services<br \/>\n(Pension) Rules, 1976 (for short `the Rules, 1976&#8242;) for<br \/>\nthe purpose of recovery and adjustment of Government dues.\n<\/p>\n<p>6.   The contention of the petitioner that even for<br \/>\nexercising power under Rule 65 of the Rules, 1976, basic<br \/>\nprinciples of natural justice and fair play in action are<br \/>\nrequired to be followed. In the present case, the<br \/>\nState\/authorities have not afforded any opportunity of<br \/>\nhearing to the petitioner to put forward his case asto why<br \/>\nthe deduction from the gratuity amount being excess amount<br \/>\ncannot be made. The contention of the learned counsel for<br \/>\nthe petitioner merits acceptance.\n<\/p>\n<p>7.   As far as the contention of the learned counsel<br \/>\nappearing for the State that the petitioner submitted<br \/>\nundertaking for recovery of excess payment from his<br \/>\nretiral dues is concerned, the same is noticed to be<br \/>\nrejected, as the undertaking was obtained by the State<br \/>\nGovernment after the petitioner had already retired from<br \/>\nhis service on 30-4-2007. <a href=\"\/doc\/652102\/\">(See Raghuveer Sai v. State of<br \/>\nChhattisgarh &amp; Others2).<\/a>\n<\/p>\n<p>8.   This Court, in Vidyadhar Tiwari (supra), has held<br \/>\nthat the excess payment, if any, made to the petitioner,<br \/>\nhe was not at fault and the amount received by him might<br \/>\nhave been used by adjusting himself accordingly treating<br \/>\nthe same as his salary. At this stage, directing recovery<br \/>\nof the alleged excess amount from the pensionary<br \/>\nbenefits\/gratuity amount of the petitioner will not be<br \/>\njust and proper.\n<\/p>\n<p>9.   <a href=\"\/doc\/1839402\/\">In Syed Abdul Qadir &amp; others v. State of Bihar &amp;<br \/>\nOthers3, the Supreme Court<\/a> observed that excess payment of<br \/>\nemoluments\/ allowances cannot be recovered if the excess<br \/>\namount was not paid on account of any mis-representation<br \/>\nor fraud on the part of the employee and if such excess<br \/>\npayment was made by the employer by applying a wrong<br \/>\nprinciple for calculating the pay\/allowances or on the<br \/>\nbasis of a particular interpretation of rule\/order, which<br \/>\nis subsequently found to be erroneous.\n<\/p>\n<p>10.  It is not the case of the respondents that the excess<br \/>\npayment has been made to the petitioner on account of any<br \/>\nmis-representation or fraud on the part of the petitioner.<br \/>\nThe excess payment might have been made by wrong<br \/>\ncalculation or wrong interpretation of the provisions of<br \/>\nlaw, if any.\n<\/p>\n<p>11.  The Supreme Court as well as this Court in a catena<br \/>\nof decisions, time and again reiterates that no recovery<br \/>\nof excess payment for no fault of the employee can be made<br \/>\nwithout following the principles of natural justice.  This<br \/>\nCourt in Ramchandra Kurup v. State of C.G. &amp; Others4 and<br \/>\nother connected matters, observed as under :\n<\/p>\n<blockquote><p>               &#8220;19.  A common thread running  into<br \/>\n               the  above decisions of the Supreme<br \/>\n               Court  is  that,  for  recovery  of<br \/>\n               excess          payment          of<br \/>\n               emoluments\/allowances,  there   are<br \/>\n               three conditions wherein the excess<br \/>\n               payment  may  be recovered,  namely\n<\/p><\/blockquote>\n<blockquote><p>               (i)  excess  payment  was  made  on<br \/>\n               account  of  misrepresentation   or<br \/>\n               fraud  on the part of the employee,\n<\/p><\/blockquote>\n<blockquote><p>               (ii)  the  employee  had  knowledge<br \/>\n               that  the payment received  was  in<br \/>\n               excess,  and  (iii) the  error  was<br \/>\n               corrected  within a short  span  of<br \/>\n               time of wrong payment..&#8221;\n<\/p><\/blockquote>\n<p>12.  In view of foregoing, this petition is allowed. The<br \/>\n     impugned order dated 17-5-2007 (Annexure &#8211; P\/1) regarding<br \/>\n     recovery of Rs.84,598\/- from the retiral dues of the<br \/>\n     petitioner is hereby quashed. The petitioner is entitled<br \/>\n     to full pensionary benefits\/gratuity amount without any<br \/>\n     deduction. If the said amount is already deducted, the<br \/>\n     same shall be payable to the petitioner with simple<br \/>\ninterest @ 6% per annum.
