Sheetal Dubey, G.A. for the respondent.<\/pre>\n<p>      This appeal is directed under Section 454 of Cr.P.C.<br \/>\nseeking refund of the amount directed to be forfeited, as per<br \/>\nSection 452 of Cr.P.C. while pronouncing the judgment dated<br \/>\n7.8.1995 in Special Case No.23 of 94.      The appellant charge<br \/>\nsheeted for an offence under Section 20(B)(II) of the Narcotic<br \/>\nDrugs and Psychotropic Substances Act,1985 but the charge<br \/>\nwas not found proved beyond the reasonable doubt, as the<br \/>\nprocedure prescribed       has not been followed by the<br \/>\nInvestigating Officer, however, acquitted by the trial Court<br \/>\nfrom the said charge. While acquitting the appellant at the<br \/>\ntime of pronouncing the judgment, the cannabis and the<br \/>\namount of Rs.5014\/- seized has been directed to be<br \/>\nconfiscated with an observation that such an amount may<br \/>\nhave been earned by appellant on selling cannabis.\n<\/p>\n<p>      Being aggrieved by such a judgment of confiscation of<br \/>\nthe amount recovered from the appellant, this appeal has<br \/>\nbeen filed.\n<\/p>\n<p>      Learned counsel appearing on behalf of the appellant<br \/>\nsubmitted that once the charge under Section 20(B)(II) of<br \/>\nthe Act has not been established by the prosecution beyond<br \/>\ndoubt, and the appellant has been acquitted, the confiscation<br \/>\nof the amount which is recovered from him by seizer memo<br \/>\nAnnexure P-3, is wholly unwarranted. However, cash amount<br \/>\nas seized and confiscated under Section 452 Cr.P.C. may be<br \/>\ndirected to be released in his favour.\n<\/p>\n<p>      On the other hand Smt. Sheetal Dubey, learned<br \/>\nCounsel appearing on behalf of the respondent opposed the<br \/>\n                      Cr. Appeal No.1385 of 1995<\/p>\n<p>Satish Chandra Agrawal                  State of M.P. And others<\/p>\n<p>25.6.2010<\/p>\n<p>prayer as made by the appellant but she is not in a position<br \/>\nto demonstrate the fact that even on acquittal from the said<br \/>\ncharge, how the cash amount        which is recovered from the<br \/>\nappellant may be ordered to be confiscated by the Court<br \/>\nconcerned.\n<\/p>\n<p>      After having heard the learned counsel appearing on<br \/>\nboth sides and considering the facts that the charge under<br \/>\nSection 20(B)(II) which was framed against the appellant was<br \/>\nnot found proved because of non-following the procedure as<br \/>\nprescribed under the Narcotic Drugs and Psychotropic<br \/>\nSubstances Act,1985, therefore, he was acquitted from the<br \/>\nsaid charge. The amount of Rs.5014\/- was seized from him<br \/>\nas per the seizure memo Ex.P-3. In absence of proving the<br \/>\ncharge for which the said amount was recovered, the<br \/>\ndirection to confiscate the said amount as issued by the trial<br \/>\nCourt is not in accordance with law. Accordingly, this appeal<br \/>\nis allowed. The direction of confiscation of the seized amount<br \/>\nof Rs.5014\/- issued by the trial Court is set aside and the<br \/>\nappellant is held entitled to receive such an amount of<br \/>\nRs.5014\/- by moving an appropriate application before the<br \/>\ncompetent authority.\n<\/p>\n<p>      Accordingly the appeal is allowed.\n<\/p>\n<p>                                     (J.K.
