Heard the parties.\n<\/p>\n<p>                                 In a criminal prosecution for offences under Sections<\/p>\n<p>                     147, 148, 149 and 307 of the Indian Penal Code as also under<\/p>\n<p>                     Section 27 of the Arms Act,      there appears to be case and counter<\/p>\n<p>                     case Vide Annexure 1 and 2 from both sides.\n<\/p>\n<p>                                 It is submitted by the learned counsel for the petitioner<\/p>\n<p>                     that entire occurrence had taken place because of bonafide land<\/p>\n<p>                     dispute between the parties. A case from the side of the petitioner<\/p>\n<p>                     vide Annexure-2 was lodged earlier and thereafter, the present case<\/p>\n<p>                     vide Annexure-1 has been lodged. It is further submitted that both<\/p>\n<p>                     sides have sustained injury on their person and co-accused Vikash<\/p>\n<p>                     Kumar with almost similar and identical allegation has been granted<\/p>\n<p>                     bail by a Bench of this Court by order dated 12. 10. 2009, passed in<\/p>\n<p>                     Cr. Misc. 34277\/09.\n<\/p>\n<p>                                 In the aforesaid facts and circumstances of the case, the<\/p>\n<p>                     above named petitioner is directed to be released on bail in<\/p>\n<p>                     connection with Atri P.S. Case No. 43\/08, on furnishing bail bond of<\/p>\n<p>                     Rs. 10,000\/- (Ten thousand) with two sureties of the like amount<\/p>\n<p>                     each to the satisfaction of the Chief Judicial Magistrate, Gaya,<br \/>\n<span class=\"hidden_text\">                              2<\/span><\/p>\n<p>       subject to the condition ;\n<\/p>\n<blockquote><p>                                    (a) That If the petitioner is found<\/p>\n<p>                                       involved in same and similar nature<\/p>\n<p>                                       of cases in future, then in that case the<\/p>\n<p>                                       informant\/prosecution shall be at<\/p>\n<p>                                       liberty   to   file   a   petition   for<\/p>\n<p>                                       cancellation of the bail of the<\/p>\n<p>                                       petitioner, and if such a petition is<\/p>\n<p>                                       filed, the court below would be<\/p>\n<p>                                       obliged to dispose of the same in<\/p>\n<p>                                       accordance with law after giving<\/p>\n<p>                                       opportunity    of     hearing   to    all<\/p>\n<p>                                       concerned.\n<\/p><\/blockquote>\n<blockquote><\/blockquote>\n<pre>m.p.
