DAVE\n\t\t\n\t\n\n \n\n \n \n\n\n \n\nDate\n: 02\/12\/2010 \n\n \n\n \n \nORAL\nORDER<\/pre>\n<p>\tThis<br \/>\napplication is filed under Section 439 of the Code of Criminal<br \/>\nProcedure in connection with first information report registered at<br \/>\nC.R.No.I-78 of 2010 with Chhani police station, District: Vadodara<br \/>\nfor the offences punishable under Sections 498(a), 306 and 114 of the<br \/>\nIndian Penal Code.\n<\/p>\n<p>\tHeard<br \/>\nlearned counsel for the parties and perused the record and the charge<br \/>\nsheet filed in the case.\n<\/p>\n<p>\tThe<br \/>\nlearned counsel for the applicant submits that the incident of<br \/>\naccident is converted into an offence punishable under Section 306 of<br \/>\nthe Indian Penal Code. He further submits that apart from vague and<br \/>\ngeneral allegations, no other specific allegation about cruelty or<br \/>\ndemand of dowry appears. Investigation is over and charge sheet is<br \/>\nfiled. He, therefore, submits that this application for bail may<br \/>\nkindly be considered.\n<\/p>\n<p>\tThe<br \/>\nlearned Additional Public Prosecutor has opposed grant of bail<br \/>\nlooking to the nature and gravity of offence.\n<\/p>\n<p>\tIn<br \/>\nthe facts and circumstances of the case and considering the nature of<br \/>\nallegations and  role attributed to the applicant and now charge<br \/>\nsheet is filed  without discussing the evidence in detail, prima<br \/>\nfacie, this Court is of the opinion that this is a fit case to<br \/>\nexercise the discretion to enlarge the applicant on bail.\n<\/p>\n<p>\tThe<br \/>\nparties do not press for further reasoned order.\n<\/p>\n<p>\tIn<br \/>\nthe facts and circumstances of the case, the application is allowed<br \/>\nand the applicant is ordered to be released on bail in connection<br \/>\nwith first information report registered at C.R.No.I-78 of 2010 with<br \/>\nChhani police station, District: Vadodara on his executing a bond of<br \/>\nRs.5,000\/- (Rupees five thousand only) with one surety of the like<br \/>\namount to the satisfaction of the trial court and subject to the<br \/>\nconditions that he shall<\/p>\n<p> i.\tnot<br \/>\ntake undue advantage of his liberty or misuse his liberty;\n<\/p>\n<p>not<br \/>\n\tact in a manner injuries to the interest of the prosecution;\n<\/p>\n<p>surrender<br \/>\n\this passport, if any, to the lower court within a week;\n<\/p>\n<p>not<br \/>\n\tleave the State of Gujarat without prior permission of the Sessions<br \/>\n\tJudge concerned;\n<\/p>\n<p>mark<br \/>\n\this presence at the concerned police station on the first Sunday of<br \/>\n\tevery month between 10 a.m. And 3 p.m for three months only;\n<\/p>\n<p>furnish<br \/>\n\tthe present  address of his residence to the I.O. and also to the<br \/>\n\tCourt at the time of execution of the bond and shall not change the<br \/>\n\tresidence without prior permission of this Court;\n<\/p>\n<p>\tThe<br \/>\nAuthorities will release the applicant only if he is not required in<br \/>\nconnection with any other offence for the time being.\n<\/p>\n<p>\tIf<br \/>\nbreach of any of the above conditions is committed, the Sessions<br \/>\nJudge concerned will be free to issue warrant or take appropriate<br \/>\naction in the matter.\n<\/p>\n<p>\tBail<br \/>\nbond to be executed before the lower court having jurisdiction to try<br \/>\nthe case.\n<\/p>\n<p>\tAt<br \/>\nthe trial, the trial court shall not be influenced by the<br \/>\nobservations of preliminary nature, qua the evidence at this stage,<br \/>\nmade by this Court while enlarging the applicant on bail.\n<\/p>\n<p>\tRule<br \/>\nis made absolute to the aforesaid extent.
