L. Jani waives service of rule for the respondent &#8211;<br \/>\nState.\n<\/p>\n<p>[2]\tThe<br \/>\npresent revision application has been filed by the applicant for the<br \/>\nprayer regarding the suspension of the sentence imposed by the<br \/>\nlearned Chief Judicial Magistrate, Gandhinagar in Criminal Case<br \/>\nNo.9853 of 2009, pending hearing of Criminal Appeal No.23 of 2011<br \/>\nbefore the Court of Sessions, Gandhinagar, on the grounds stated in<br \/>\nthe memo of application.\n<\/p>\n<p>[2]\tHeard<br \/>\nlearned advocate Mr.Jayesh A. Dave for the applicant.\n<\/p>\n<p>[3]<br \/>\nLearned advocate Mr.Jayesh A. Dave for the applicant has stated that<br \/>\nagainst the judgment and order passed by the Chief Judicial<br \/>\nMagistrate, Gandhinagar in Criminal Case No.9853 of 2009 regarding<br \/>\nconviction of the present applicant &#8211; appellant-accused,<br \/>\nCriminal Appeal No.23 of 2011 has been preferred before the Court of<br \/>\nSessions, Gandhinagar, which is pending. However, pending the appeal,<br \/>\napplication for suspension of the sentence and to release the<br \/>\napplicant on bail has been turned down by the learned Additional<br \/>\nSessions Judge, Gandhinagar vide order dated 06.07.2011. Therefore,<br \/>\nthe revision application has been filed. Learned advocate for the<br \/>\napplicant has stated that out of total sentence of seven years, he<br \/>\nhas already undergone more than two and half years. He has referred<br \/>\nto and relied upon the decision of the Apex Court in the case of<br \/>\nBhagwan Rama Shinde Gosai and others Vs. State of Gujarat, reported<br \/>\nin (1999) 4 SCC 421.\n<\/p>\n<p>[4]\tIn<br \/>\nview of the submissions made by the learned advocate for the<br \/>\napplicant and learned APP for the respondent &#8211; State and<br \/>\nconsidering the provisions of Section 389 of the Criminal Procedure<br \/>\nCode and observations made by the Apex Court regarding suspension of<br \/>\nthe sentence including the judgment reported in (1999) 4 SCC 421, the<br \/>\npresent revision application deserves to be allowed and accordingly<br \/>\nstands allowed. The prayer in terms of paragraph No.8(a) is granted.<br \/>\nThe impugned judgment and order dated 06.07.2011 passed by the<br \/>\nAdditional Sessions Judge,  Gandhinagar below Ex.4 in Criminal Appeal<br \/>\nNo.23 of 2011 refusing to release the applicant on bail is hereby<br \/>\nquashed and set aside. The applicant is ordered to be released on<br \/>\nbail on executing a personal bond of Rs.5,000\/-  with<br \/>\none surety of the like amount to the satisfaction of the trial Court.<br \/>\nThe applicant shall not leave India without prior permission of this<br \/>\nCourt and shall surrender passport before the trial Court. Rule is<br \/>\nmade absolute.
