SEMA &amp; MARKAANDEY KATJU\n\nJUDGMENT:\n<\/pre>\n<p>JUDGMENT<br \/>\nO R D E R\t<\/p>\n<p>CONTEMPT PETITION (C) NO. 492 OF 2004<br \/>\nIN<br \/>\nCIVIL APPEAL NO.  5657   OF 2002<\/p>\n<p>\tThis Contempt Petition is initiated by the defendant in Suit No. 7934\/2001<br \/>\npending before the City Civil Court, Bangalore.  The petitioner has alleged<br \/>\nviolation of the order passed by this Court on 6.9.2002 in    C.A.No.<br \/>\n5657\/2002 arising out of SLP(C)No. 14649\/2002.  That appeal arose out of<br \/>\nan order of the Karnataka High Court dated 19.4.2002 by which the appeal<br \/>\nof the plaintiff (respondent herein) was allowed and a temporary<br \/>\ninjunction was granted in favour of the plaintiff restraining the defendants<br \/>\nor their agents from intefering with the peaceful possession and<br \/>\nenjoyment by the plaintiff of the suit properties i.e. Iskcon Temple Centre<br \/>\nat Bangalore.\n<\/p>\n<p>\tThis Court while granting leave passed the order on 6.9.2002.  To<br \/>\nappreciate the contentions in perspective, it is essential to quote the order<br \/>\nin extenso.  The order reads thus:\n<\/p>\n<p>\t\t&#8220;Leave granted.\n<\/p>\n<p>\t\tHeard counsel for the parties.\n<\/p>\n<p>\tIn view of the fact that the interim injunction<br \/>\norder has been passed pending hearing of the suit, we<br \/>\nare not inclined to interfere in the matter.\n<\/p>\n<p>\t\t\t\t\t2\/-\n<\/p>\n<p><span class=\"hidden_text\">-2-<\/span><\/p>\n<p>\tHowever, it is necessary to protect the interest<br \/>\nof the defendant-appellants.  We, therefore, direct that the<br \/>\nplaintiff-respondents herein shall not alienate or part with<br \/>\nmovable property (mentioned in Schedule B-properties,<br \/>\nexcluding free meal and prasadam), immovable property<br \/>\nor create any third party right in the same.  The plaintiff-<br \/>\nrespondents shall, however, carry on their religious and<br \/>\nother charitable activities and incur expenditure which<br \/>\nare essential. If any other major expenditure (exceeding<br \/>\nRupees five lacs) (excluding expenditure in connection<br \/>\nwith distribution of prasadam and free meal) is required,<br \/>\nthat would be subject to the approval of the trial court.<br \/>\nWe are further of the view that the suit requires early<br \/>\ndisposal.  Any observations made by the court below on<br \/>\nmerits of the case would not come in the way of the trial<br \/>\ncourt deciding the suit on merits.\n<\/p>\n<p>\tWith the aforesaid directions and modifications,<br \/>\nthe appeal stands disposed of.&#8221;\n<\/p>\n<p>\tMr. K.K.Venugopal, learned senior counsel for the petitioner invited our<br \/>\nattention to various items of expenditures and submits that all these<br \/>\nexpenditures incurred by the contemnor\/respondent (plaintiff)  exceeded<br \/>\nrupees five lacs, and thus are in violation of the order passed by this<br \/>\nCourt dated 6.9.2002 as noted above.\n<\/p>\n<p>\tHe particularly referred to the expenditure incurred by the contemnor for<br \/>\npurchase of the properties by the respondent after the order passed by<br \/>\nthis Court, which according to him exceeded rupees five lacs and no <\/p>\n<p>\t\t\t\t\t\t3\/-\n<\/p>\n<p><span class=\"hidden_text\">-3-<\/span><\/p>\n<p>permission was sought for from the Trial Court before the aforesaid<br \/>\nexpenditure.  Therefore, according to learned counsel, the order passed<br \/>\nby this Court has been flagrantly violated and calls for punishment.<br \/>\n\tOn the other hand, Shri Rakesh Dwivedi, learned senior counsel for the<br \/>\nplaintiff respondents has denied these allegations.\n<\/p>\n<p>\tIn view of the order that we propose to pass it is not necessary to deal<br \/>\nwith the  contentions advanced by the learned counsels for the parties.\n<\/p>\n<p>\tIt has been brought to our notice and not disputed that the suit has been<br \/>\nordered to be disposed of finally by August 2008. It is also not disputed<br \/>\nthat the trial of the suit is in progress and the Trial Court has determined<br \/>\nto dispose of the suit on merits latest by August, 2008.\n<\/p>\n<p>\tHaving regard to the contentions we dispose of the contempt petition by<br \/>\ndirecting the Trial Court to dispose of the suit peremptorily latest by<br \/>\nAugust 2008. We also direct that the suit be proceeded by day-to-day trial<br \/>\ntill the suit is finally disposed of latest by August 2008.   We further  direct<br \/>\nthe respondent\/plaintiff to file income and expenditure accounts since<br \/>\n6\/9\/2002 till date before the Trial Court within <\/p>\n<p>\t\t\t\t\t\t4\/-\n<\/p>\n<p><span class=\"hidden_text\">-4-<\/span><\/p>\n<p>a month from today, after serving copy thereof on the defendant. It is also<br \/>\nopen to the petitioner to file an application before the Trial Court to pass<br \/>\nan appropriate order to protect the properties of the Bangalore Iskcon<br \/>\ntemple centre and the interest of the petitioner till the pendency of the suit,<br \/>\nand if he does so the trial court shall pass appropriate orders<br \/>\nexpeditiously after hearing the parties.\n<\/p>\n<p>\tContempt petition is disposed of accordingly.<br \/>\n\tNotice is discharged.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Supreme Court of India International Soc.
