SEMA\n\nJUDGMENT:\n<\/pre>\n<p>J U D G M E N T<\/p>\n<p>ARIJIT PASAYAT, J.\n<\/p>\n<p>\tAppellants call in question correctness of the judgment<br \/>\nrendered by a Division Bench of the Calcutta High Court<br \/>\nholding that the writ petition filed by them is not<br \/>\nmaintainable. Accordingly, it set aside judgment of learned<br \/>\nSingle Judge who had entertained the writ petition and given<br \/>\nsome directions.\n<\/p>\n<p>\tThe dispute related to the allotment of 156 car parking<br \/>\nspaces. The appellants who are occupying B Type flats took<br \/>\nthe stand that the car parking spaces were to be allotted<br \/>\nonly to them and not to A type flat owners. Questioning the<br \/>\nlegality of a letter purportedly issued by the Housing<br \/>\nCommissioner dated 6th June, 1995 giving certain<br \/>\nclarifications about entitlement of A type flat owners a<br \/>\nwrit petition was filed with a prayer that the letter was<br \/>\nwithout any authority and even if any action has been taken<br \/>\nby the respondents-West Bengal Housing Board (hereinafter<br \/>\nreferred to as the &#8216;Board&#8217;) and\/or Samdrita Co-operative<br \/>\nHousing Society Ltd (in short the &#8216;Society&#8217;) in selling the<br \/>\nparking spaces or any issue connected thereto, it was<br \/>\ninoperative and invalid. Learned Single Judge accepted the<br \/>\nplea overruling the contention raised by the Board\/Society<br \/>\nand A type flat owners who were parties in the proceedings<br \/>\nabout maintainability of the writ petition and gave certain<br \/>\ndirections.\n<\/p>\n<p>\tThe order of the learned Single Judge was questioned in<br \/>\nLetters Patent Appeal before the Division Bench which by the<br \/>\nimpugned order held that writ petition would not lie against<br \/>\na society and the writ petition was therefore clearly not<br \/>\nmaintainable as no statutory action has been assailed.\n<\/p>\n<p>\tThe only question which arose for consideration was<br \/>\nwhether the covered car parking spaces could be sold to both<br \/>\nallottees of A and B type units or to B type unit only. A<br \/>\nnotice dated 21.5.1995 was issued by the Society proposing<br \/>\nto consider and discuss the matter at its Annual General<br \/>\nBody Meeting. Members of the Society in question comprised<br \/>\nof both type of allottees i.e.  A and B type units. The<br \/>\nprayer in the writ petition was to declare that the proposed<br \/>\nmeeting was convened without any authority.\n<\/p>\n<p>\tThe High Court by the impugned judgment held that a<br \/>\nmandamus would lie only if the duty imposed on the<br \/>\nrespondent-Society is of public nature and the writ of<br \/>\nmandamus could be issued for enforcing compliance with such<br \/>\npublic duty. Two exceptions as noted by the High Court were:\n<\/p>\n<p>(i) if the rights are purely of a private character and (ii)<br \/>\nif the body against which a mandamus is to be issued is<br \/>\npurely a private body with no public duty. It was noted by<br \/>\nthe High Court that the rights claimed by the writ<br \/>\npetitioners are purely of private character and the Society<br \/>\nis a private body with no public duty, and a writ Court<br \/>\nwould not embark upon enquiry into disputed questions of<br \/>\ntitle.  Accordingly, the writ petition was held to be not<br \/>\nmaintainable. It was noted that the question whether the<br \/>\nletter of the Housing Commissioner was an administrative<br \/>\ndecision or not was not required to be adjudicated as the<br \/>\nwrit petition was not maintainable and since he had not<br \/>\nadjudicated any dispute before him.\n<\/p>\n<p>\tIn support of the appeal, learned counsel for the<br \/>\nappellants submitted that the High Court has taken a very<br \/>\ntechnical view without realizing that the rights which the<br \/>\nwrit petitioners wanted to enforce are relatable to a scheme<br \/>\nframed by the Board and, therefore, non- observance of the<br \/>\nprovisions of the scheme amounted to breach of public duty.\n<\/p>\n<p>\tAccording to learned counsel for the respondents the<br \/>\nHigh Court has rightly held that the writ petition was not<br \/>\nmaintainable and that there was not even semblance of<br \/>\npublic duty.\n<\/p>\n<p>\tThe rival stands need consideration on the core issue<br \/>\nof maintainability of the writ petition, though several<br \/>\nother issues were raised by learned counsel for the<br \/>\nappellants. It is undisputed that the respondent-Society is<br \/>\na co-operative society constituted on agreement between<br \/>\nmembers thereof who had agreed to abide by the provisions of<br \/>\nthe West Bengal Co-operative Societies Act, 1983, the Rules<br \/>\nframed thereunder or the bye-laws framed by the Society. The<br \/>\nSociety is undisputedly not a department of the State and is<br \/>\nalso not a creature of a statute but merely governed by a<br \/>\nstatute. Only if it is established that the mandatory<br \/>\nprovision of a Statute has been violated, a writ petition<br \/>\ncould be maintainable.  Before a party can complain of an<br \/>\ninfringement of his fundamental right to hold property, he<br \/>\nmust establish that he has title to that property and if his<br \/>\ntitle itself is in dispute and is the subject matter of<br \/>\nadjudication in proceedings legally constituted, he cannot<br \/>\nput forward any claim based on the title until as a result<br \/>\nof that enquiry he is able to establish his title.  It is<br \/>\nonly thereafter that the question whether the rights in or<br \/>\nto that property have been improperly or illegally infringed<br \/>\ncould arise. The dispute as noted by the High Court<br \/>\nessentially related to the claims of two rival groups of<br \/>\nprivate individuals in relation to common car parking<br \/>\nspaces. Learned Single Judge gave certain directions, which<br \/>\neven touched upon the legality of the sale deeds. It was not<br \/>\nopen to be dealt with in a writ petition.  As observed by<br \/>\nthis Court in <a href=\"\/doc\/1532404\/\">U.P. State Co-operative Land Development Bank<br \/>\nLtd. v. Chandra Bhan Dubey and Ors. (AIR<\/a> 1999 SC 753) in<br \/>\nrelation to the question whether a writ petition would lie<br \/>\nagainst a Cooperative Society the question to be considered<br \/>\nis what is the nature of the statutory duty placed on it and<br \/>\nthe Court is to enforce such statutory public duty.  The<br \/>\nquestion as to entitlement of the members was to be<br \/>\ndiscussed in the Annual General Body Meeting. The writ<br \/>\npetitioners could not have questioned the decision of the<br \/>\nSociety to discuss the matter in the Annual General Body<br \/>\nMeeting. We, therefore, find no merit in this appeal. The<br \/>\nSociety is free to convene a General Body Meeting and to<br \/>\ndiscuss the rival claims regarding entitlement. We make it<br \/>\nclear that we have not expressed any opinion on that aspect<br \/>\nof the matter.
