HANSARIA\n\nJUDGMENT:\n<\/pre>\n<p>JUDGMENT<\/p>\n<p>1995 (2) SCR 1145<\/p>\n<p>The following Order of the Court was delivered :\n<\/p>\n<p>Leave granted.\n<\/p>\n<p>The only question is whether the respondents are eligible to be considered<br \/>\nfor appointment as Clerks in &#8216;A&#8217; Class offices on the admitted position<br \/>\nthat they are not matriculates with first division. The High Court in W.P.<br \/>\nNo. 11553\/93 by judgment dated 14.7.94 found them to be eligible.<br \/>\nAdmittedly, the respondents are dependents of ex-servicemen. The Government<br \/>\nwhile reserving the posts for ex-servicemen, have prescribed qualifications<br \/>\nfor the posts in Class &#8216;A&#8217; offices, as under :-\n<\/p>\n<p>&#8220;Qualifications of the posts of Clerks, Steno-typists and Stenographers in<br \/>\nall &#8216;A&#8217; class offices.\n<\/p>\n<p>Name of the Post            Qualifications<\/p>\n<p>Clerks\t1.\tMatric 1st. Div.\/Higher Secondary IInd<br \/>\nDivision\/Intermediate IInd Div.\/Graduates or equivalent (For Ex-servicemen<br \/>\nMatric only)<\/p>\n<p>2.     Knowledge of Hindi upto Matric standard.\n<\/p>\n<p>3.     Hindi\/English typing at a speed of 25\/30 words per minute<br \/>\nrespectively.\n<\/p>\n<p>Steno-typist\t1.\tMatric 1st Div. Higher Secondary Second<br \/>\nDivision\/Graduate or equivalent (For Ex-Servicemen Matric only)<\/p>\n<p>2.    Knowledge of Hindi upto Matric Standard.\n<\/p>\n<p>3.    English shorthand at 80 w.p.m. and transcription thereof at 11 w.p.m.\n<\/p>\n<p>4.    Hindi shorthand at 64 w.p,m. and transcrip-tion thereof at 11 w.p.m.\n<\/p>\n<p>Stenographer\t1.\tMatric 1st Div.\/Hr. Sec. Hnd Div.\/Inter-mediate<br \/>\nIInd Div.\/Graduate or equivalent (For Ex-servicemen Matric only)<\/p>\n<p>2.     Knowledge of Hindi upto Matric standard.\n<\/p>\n<p>3.    English shorthand at 100 wpm and transcription thereof at 20 wpm.\n<\/p>\n<p>4.    Hindi shorthand at 80 wpm and transcription thereof at 15 wpm.&#8221;\n<\/p>\n<p>For class &#8216;B&#8217; offices, it was prescribed thus:\n<\/p>\n<p>&#8220;Qualification for the post of Clerks, Steno-typists and Stenographer in<br \/>\nall offices other than &#8216;A&#8217; class offices :\n<\/p>\n<p>Name of the Post                         Qualifications<\/p>\n<p>Clerks\t1.\tMatric\/Higher Secondary or equivalent.\n<\/p>\n<p>2.    Knowledge of Hindi upto Matric standard.\n<\/p>\n<p>3.     Hindi or English typing at a speed of 25\/30 wpm respectively.\n<\/p>\n<p>Steno-typist\t1.\tMatric\/Hr. Secondary or equivalent.\n<\/p>\n<p>2.    Knowledge of Hindi upto Matric Standard.\n<\/p>\n<p>3.    Hindi shorthand at 64 w.p.m. and transcription thereof at 11 w.p.m.\n<\/p>\n<p>OR<\/p>\n<p>English shorthand at 80 w.p.m. and transcription thereof at 15 w.p.m.\n<\/p>\n<p>Stenographer\t1.\tHindi : Hr. Secondary or equivalent.\n<\/p>\n<p>2.    Knowledge of Hindi upto Matric standard.\n<\/p>\n<p>3.    Hindi shorthand at 80 wpm and transcription thereof at 15 wpm.\n<\/p>\n<p>OR<\/p>\n<p>English shorthand at 100 wpm and transcription thereof at 20 wpm.\n<\/p>\n<p>In the year 1979 while giving benefit of reservation to the children of Ex-<br \/>\nServicemen, by proceedings dated March 21, 1979, it was stated thus:\n<\/p>\n<p>&#8220;It has been observed that due to non-availability of suitable candidates<br \/>\nfor the reserved quota, the recruitment of Ex-ser-vicemen to the civil<br \/>\nposts is not being made to the desired extent. In view of this, it has been<br \/>\ndecided that the dependent sons and daughters of Ex-servicemen, who fulfill<br \/>\nall the conditions of qualifications, age etc. prescribed for various<br \/>\nposts, should also be considered on merits for the posts reserved for the<br \/>\nEx-servicemen to the extent of non-availability of suitable Ex-servicemen.<br \/>\nThis entitlement would be available to one dependent child only.&#8221; (Emphasis<br \/>\nsupplied)<\/p>\n<p>A reading of these conditions would clearly indicate that if the ex-<br \/>\nservicemen are considered for appointment in &#8216;A&#8217; Class offices, they may be<br \/>\nmere Matriculate only. The qualification of First Division in Secondary or<br \/>\nSecond Division in Intermediate is necessary for general candidates. With<br \/>\nregard to the appointments in &#8216;B&#8217; Class offices this condition was not<br \/>\nincorporated. For children of ex-servicemen, they are required to fulfill<br \/>\nall the conditions of qualifications prescribed for the posts and be<br \/>\nconsidered on merits for appointment to the unfilled posts reserved for ex-<br \/>\nservicemen.\n<\/p>\n<p>Respondents contend that since the advertisement, Annexure R-l, dated<br \/>\n7.9.91, does not prescribe any distinction between &#8216;A&#8217; class and &#8216;B&#8217; class<br \/>\noffices and had only mentioned about Matriculation as the respon-dents had<br \/>\nsecured Matriculation, they are eligible on par with the ex-ser-vicemen for<br \/>\nappointment in &#8216;A&#8217; class posts. We find no force as the advertisement dealt<br \/>\nwith Clerks in general; it did not say about Clerk in &#8216;A&#8217; class office. It<br \/>\nhas already been seen that in case ex-serviceman is not available and there<br \/>\nexists vacancy reserved for ex-serviceman, the depend-ent i.e. son or<br \/>\ndaughter of ex-exservicemen, is eligible for consideration to appointment<br \/>\nbut subject to the candidates possessing qualifications prescribed for the<br \/>\nposts. One of the conditions is that in case of the dependent, he shall<br \/>\nalso be required to be a Matriculation with First Division or Intermediate<br \/>\nwith Second Division. Such candidate alone is eligible for appointment in<br \/>\n&#8216;A&#8217; class office. The benefit of mere Matriculation is available to the ex-<br \/>\nservicemen only. Dependent&#8217;s son or daughter cannot be considered to be an<br \/>\nEx-serviceman, The benefit of giving reservation to the dependents is only<br \/>\nto see that the posts reserved for ex-ser-vicemen may not be allowed to be<br \/>\nlapsed for non-availability of ex-servicemen.\n<\/p>\n<p>Considered from this perspective, we are of the view that the respon-dents<br \/>\nare not entitled for appointment in &#8216;A&#8217; class offices since they do not<br \/>\nhave First Division in Matriculation nor that they are ex-servicemen.\n<\/p>\n<p>The appeals are accordingly allowed but in the circumstances without costs.<br \/>\nThe writ petitions filed in the High Court stand dismissed.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Supreme Court of India Subordinate Services Selection &#8230; vs Bir Singh And Anr.\/Ram Niwas And &#8230; on 27 March, 1995 Bench: K.
