J.\n<\/p>\n<p>     This appeal  is filed  by the convicted accused against<br \/>\nthe judgment  of the  Punjab &amp;\tHaryana High Court in Crl.A.<br \/>\nNo. 57 of 1988 dismissing his appeal against the judgment of<br \/>\nthe Sessions  Court, Bhatinda  in Sessions  Case No.  108 of<br \/>\n1986.\n<\/p>\n<p>     The appellant  has been convicted under Section 302 IPC<br \/>\nfor causing  death of Balwant Kaur. The incident happened in<br \/>\nthe  house   of\t Balwant   Kaur.  To  prove  the  case,\t the<br \/>\nprosecution had examined her two sons Daya Singh and Kulwant<br \/>\nSingh who  have stated that the appellant along with another<br \/>\nNachhattar Singh  had killed  their mother  by giving  blows<br \/>\nwith kulhari  and gandasa.  The\t trial\tcourt  believed\t the<br \/>\nevidence of  both those\t witnesses and\tconvicted   both the<br \/>\naccused. On  appeal the\t High  Court,  though  believed\t the<br \/>\npresence of  two eye  witnesses at  the time of the incident<br \/>\ngave benefit  of doubt\tto the\tsecond accused on the ground<br \/>\nthat he\t had no reason or motive to kill Balwant Kaur. It is<br \/>\ndifficult to  appreciate the  reasoning of the High Court in<br \/>\nthis behalf  but as  he has  been acquitted  and there is no<br \/>\nappeal by  the State,  it is  not necessary to point out how<br \/>\nthat finding is not correct.\n<\/p>\n<p>     The High  Court has  held\tthat  both  Daya  Singh\t and<br \/>\nKulwant Singh  were present  in the house at the time of the<br \/>\nincident. Their presence in their own house at that time was<br \/>\nquite natural.\tIf they\t were present  in their\t house\tthen<br \/>\nobviously they\tcould have  seen the assault on their mother<br \/>\nby the\tappellant. Both\t the courts  below have\t thought  it<br \/>\nproper to  accept their\t evidence and  we see  no reason  to<br \/>\ndiffer from the finding recorded in that behalf.\n<\/p>\n<p>     The contention  raised on\tbehalf of  the appellant was<br \/>\nthat the witnesses could not have been in their house at the<br \/>\ntime when  the incident tool place. It was late evening time<br \/>\nand therefore  their returning\tto the house from their shop<br \/>\nat that\t time cannot be regarded as unnatural or improbable.<br \/>\nAs we  are of  the view\t that the  High Court  was right  in<br \/>\nconfirming the\tconviction of  the appellant on the basis of<br \/>\nthe evidence  of the two eye witnesses this appeal has to be<br \/>\ndismissed.\n<\/p>\n<p>     This  appeal   is,\t therefore,  dismissed.\t During\t the<br \/>\npendency of  the appeal\t the appellant was released on bail.<br \/>\nHis bail  is cancelled\tand he\tis ordered  to surrender  to<br \/>\ncustody to serve out the remaining part of the sentence.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Supreme Court of India Nachhattar Singh vs State Of Punjab on 3 March, 1998 Author: Nanavati.
