It has also been submitted that so far as the<br \/>\n\tillegal construction is concerned, the District Collector has passed<br \/>\n\tthe order on 13.08.2008 for removal of illegal construction in the<br \/>\n\tmargin area.  However, in the very order, one month time has been<br \/>\n\tgiven to the petitioner to remove the same failing which the City<br \/>\n\tSurvey Superintendent, Vijapur, is ordered to remove the<br \/>\n\tconstruction and therefore, it was required for the District<br \/>\n\tCollector to wait till the period of one month is over.  It is also<br \/>\n\tsubmitted that against the said order passed by the District<br \/>\n\tCollector for non-regularisation of the illegal construction and<br \/>\n\tremoval of the said construction, the petitioner has preferred the<br \/>\n\tmatter before the State Government and the same is pending.<br \/>\n\tTherefore, as the cinema is to be discontinued pursuant to the<br \/>\n\timpugned order for cancellation of licence, the present petition.\n<\/p>\n<p>It<br \/>\n\tappears that the District Collector on 13.08.2008 has passed the<br \/>\n\torder (Annexure-D), whereby the construction is not regularised.<br \/>\n\tHowever, he has granted one months time to remove the construction.<br \/>\n\tTherefore, it was required for him to wait till the period of one<br \/>\n\tmonth is over if he was to act on the basis of alleged illegal<br \/>\n\tconstruction made by the petitioner for cancellation of the licence.\n<\/p>\n<p>It<br \/>\n\tappears that he has passed the impugned order dated 14.08.2008 with<br \/>\n\timmediate effect.\n<\/p>\n<p>Further,<br \/>\n\tthe fact remains that against the order dated 13.08.2008, the<br \/>\n\tpetitioner has preferred revision before the State Government and<br \/>\n\tagainst the order dated 14.08.2008, which is impugned in the present<br \/>\n\tpetition, the petitioner has also to prefer appeal\/revision before<br \/>\n\tthe State Government.\n<\/p>\n<p>Under<br \/>\n\tthese circumstances, in case if the illegal construction is not<br \/>\n\tremoved by the petitioner or any stay order is not granted by the<br \/>\n\thigher authority known to law, so far as removal of the illegal<br \/>\n\tconstruction is concerned, it would be required for the petitioner<br \/>\n\tto remove the same upon expiry of the period of one month and the<br \/>\n\tpetitioner cannot claim the right beyond the same so far as<br \/>\n\tcancellation of licence to run the cinema is concerned.  However,<br \/>\n\tthe same may not preclude the State Government in<br \/>\n\trevisional\/appellate jurisdiction to stay the order for cancellation<br \/>\n\tof the licence, if such a case is made out.\n<\/p>\n<p>Hence<br \/>\n\tthe following order shall meet with the ends of justice:\n<\/p>\n<p>The<br \/>\n\torder of the District Magistrate dated 14.08.2008 (Annexure-A) shall<br \/>\n\tremain suspended till 13.09.2008.\n<\/p>\n<p>In<br \/>\n\tthe event the order dated 13.08.2008 is not stayed by the State<br \/>\n\tGovernment in revisional jurisdiction, which pertains to<br \/>\n\tnon-regularisation of the illegal construction, it would be required<br \/>\n\tfor the petitioner to remove the same as per the Order dated<br \/>\n\t13.08.2008 of the District Collector or in any case, the order dated<br \/>\n\t14.08.2008 passed by the District Collector for cancellation of the<br \/>\n\tlicence may start running in operation from 14.09.2008 onwards,<br \/>\n\tunless the very order for cancellation of the license dated<br \/>\n\t14.08.2008 is stayed by the higher authority known to law viz. the<br \/>\n\tState Government in revisional\/appellate jurisdiction.\n<\/p>\n<p>It<br \/>\n\tis made clear that the State Government in revisional jurisdiction<br \/>\n\tagainst the order dated 13.08.2008 of the District Collector for<br \/>\n\tnon-regularisation of the construction or the State Government in<br \/>\n\trevisional\/appellate jurisdiction against the order dated<br \/>\n\t14.08.2008, shall be in a position to independently exercise the<br \/>\n\tpower without being in any manner influenced by any observations<br \/>\n\tmade by this Court in the present order.\n<\/p>\n<p>The<br \/>\n\tpetition is disposed of in terms of the aforesaid direction.  No<br \/>\n\torder as to costs.  The present order shall not operate as a bar to<br \/>\n\tthe petitioner to move the State Government for earlier hearing of<br \/>\n\tthe revision and\/or interim relief, in any case.
