BALASUBRAMANYAN, J.\n<\/p>\n<p>1.\t\tThe appellants were working as Drivers Grade-C in the<br \/>\nCentral Railways.  They, along with Drivers Grade-A and Drivers<br \/>\nGrade-B, were entitled to be considered for selection to the higher post<br \/>\nof Loco supervisors.   The appellants as drivers, in addition to the scale<br \/>\nof pay at Rs.150-240, were also entitled to a running allowance of 30%<br \/>\nof the salary which was liable to be added to their basic pay.   They were<br \/>\npromoted between the years 1970 and 1974 as Loco Supervisors in the<br \/>\nGrade of Rs.700-900.\n<\/p>\n<p>2.\t\tThe Railways accepted the recommendations of the IV Pay<br \/>\nCommission with effect from 1.1.1986.   This increased the pay of the<br \/>\nDrivers as well as their running allowance, being 30% of their basic pay.<br \/>\nCertain persons who were working as Drivers Grade-A were promoted<br \/>\nas Loco Supervisors in the year 1986.   The pay revision with effect from<br \/>\n1.1.1986 not only increased their pay, but also the running allowance of<br \/>\nthose working as Drivers as on that day, it being 30% of their increased<br \/>\nbasic pay.   This resulted in the appellants getting a lesser pay as Loco<br \/>\nSupervisors than those promoted after 1.1.1986 since they did not have<br \/>\nthe advantage of the increased 30% addition in their running allowance<br \/>\nand they had to be content with the 30% running allowance on their pay<br \/>\nprior to the pay revision.   Representations were made by the appellants<br \/>\npointing out that though they were promoted as Loco Supervisors earlier,<br \/>\nthey were getting lesser pay than those Drivers promoted subsequent to<br \/>\n1.1.1986 and some of whom were their juniors.   The General Manager<br \/>\ntook up their grievance and a circular was issued authorizing the<br \/>\nstepping up of the pay of the appellants.   The pay was thus stepped up<br \/>\nand arrears paid.   But subsequently in the year 1992, the said circular<br \/>\nwas withdrawn on the basis that Codal Conditions had to be fulfilled for<br \/>\ngetting stepped up pay and they did not fulfil that condition.   A person<br \/>\nsimilarly situated as the appellants along with certain others, approached<br \/>\nthe Central Administrative Tribunal, Jabalpur challenging the<br \/>\nwithdrawal of the stepped up pay.   The Administrative Tribunal upheld<br \/>\ntheir claim.   The decision of the Administrative Tribunal was<br \/>\nchallenged by the Union of India in this Court.   By Judgment dated<br \/>\n14.7.1997 reported as <a href=\"\/doc\/1259098\/\">Union of India and others vs. O.P. Saxena<\/a><br \/>\n(1997) 6 SCC 360,  this Court allowed the appeal, set aside the order of<br \/>\nthe Administrative Tribunal and dismissed the applications filed before<br \/>\nthe Administrative Tribunal by persons similarly situated as the<br \/>\nappellants.\n<\/p>\n<p>3.\t\tIn these cases the Central Administrative Tribunal, Bombay<br \/>\nrejected the challenge of the appellants to the withdrawal of the stepped<br \/>\nup pay.   The appellants challenged the said decision before the High<br \/>\nCourt of Bombay.   The High Court dismissed the writ petitions.   It is<br \/>\nthe dismissal of those writ petitions that are challenged before us.\n<\/p>\n<p>4.\t\tLearned counsel for the respondents, at the outset,<br \/>\nsubmitted that the question raised by the appellants is covered against<br \/>\nthem by the decision of this Court in <a href=\"\/doc\/1259098\/\">Union of India and others vs.<br \/>\nO.P. Saxena<\/a> (supra) and these appeals have only to be dismissed in the<br \/>\nlight of the said decision.   Learned counsel for the appellants in that<br \/>\ncontext argued that the decision in <a href=\"\/doc\/1259098\/\">Union of India and others vs. O.P.<br \/>\nSaxena<\/a> (supra) was distinguishable.   He alternatively contended that the<br \/>\nsaid decision requires reconsideration since this Court had assumed that<br \/>\nCodal Conditions, especially Rule 1316 of the Indian Railway<br \/>\nEstablishment Code (for short &#8220;the Code&#8221;), applied to persons similarly<br \/>\nsituated as the appellants and this erroneous assumption has led to the<br \/>\nconclusion in that case, which was also erroneous.   It was submitted that<br \/>\nthe said decision related to claims by those who were juniors to one Mr.<br \/>\nKareer who got promoted as a Loco Supervisor from Driver Grade-A<br \/>\nwhereas in the present case, the appellants were seniors to Mr. Kareer<br \/>\nwhen they were promoted as Loco Supervisors from the post of Drivers<br \/>\nGrade-C.   Since the claim is by those who were seniors to Mr. Kareer,<br \/>\nthe decision of this Court did not apply to the appellants.\n<\/p>\n<p>5.\t\tOn going through the decision in <a href=\"\/doc\/1259098\/\">Union of India and<br \/>\nothers vs. O.P. Saxena<\/a> (supra) we find that it is not possible to accept<br \/>\nthe distinction sought to be made by the learned counsel for the<br \/>\nappellants between those involved in the said decision and in the present<br \/>\ncase.   The appellants also opted to be promoted to the Stationary Post of<br \/>\nLoco Supervisors directly from the post of Drivers Grade-C and their<br \/>\npromotions were also made prior to 1.1.1986.   It was the claim of such<br \/>\npersons that was considered by this Court in the said reported decision<br \/>\nand this Court held that those who were promoted before 1.1.1986 did<br \/>\nnot satisfy the codal conditions and Rule 1316 of the Code Vol.II,<br \/>\ngoverning the principle of stepping up of pay.   This Court held that<br \/>\ngoing by Rule 1316, the persons promoted from Drivers Grade-C to the<br \/>\npost of Loco Supervisors before 1.1.1986 were not entitled to stepped up<br \/>\npay and could not claim the benefit of  the circular dated 8.4.1988 and<br \/>\nthe withdrawal of that circular regarding persons similarly situated in the<br \/>\nyear 1992 was justified.  The factum of seniority of Mr. Kareer was only<br \/>\nincidentally referred to.  The decision was not rested on that fact or<br \/>\naspect at all.\n<\/p>\n<p>6.\t\tThe argument that the codal conditions and Rule 1316 did<br \/>\nnot apply to the appellants and that they were assumed to apply in that<br \/>\ndecision, could not also be accepted.   The argument that it was assumed<br \/>\nthat Rule 1316 applied, is found to be not tenable.   The Court<br \/>\nconsidered the question whether Rule 1316 applied and noticed the<br \/>\nconditions to be fulfilled to enable the seniors to claim parity of pay with<br \/>\nthose subsequently promoted.   This Court held that the conditions were<br \/>\nnot satisfied in the case of persons similarly situated as the appellants<br \/>\nand based on it, the conclusion was arrived at that they were not entitled<br \/>\nto the stepped up pay.   This Court also noticed that the sources of<br \/>\nrecruitment to the post of Loco Supervisors in the case of drivers took in<br \/>\nDrivers Grade-A, Drivers Grade-B and Drivers Grade-C and hence the<br \/>\nsources were different and that made the principle of stepping up of pay<br \/>\ninapplicable.   Thus, we find that the decision of this Court in the <a href=\"\/doc\/1259098\/\">Union<br \/>\nof India and others vs. O.P. Saxena<\/a> (supra) cannot either be<br \/>\ndistinguished or taken to be based on an assumption regarding<br \/>\napplicability of Rule 1316.   We find that the claim of the appellants is<br \/>\nsquarely covered by the decision in <a href=\"\/doc\/1259098\/\">Union of India and others vs. O.P.<br \/>\nSaxena<\/a> (supra) necessarily justifying the rejection of their claim by the<br \/>\nCentral Administrative Tribunal and the High Court.  We are also in<br \/>\nrespectful agreement with the view that Rule 1316 has application and<br \/>\nthat the appellants do not satisfy the conditions of that Rule.\n<\/p>\n<p>7. \t\tHaving considered the arguments in that behalf and having<br \/>\ncarefully gone through the decision in <a href=\"\/doc\/1259098\/\">Union of India and others vs.<br \/>\nO.P. Saxena<\/a> (supra), we do not find any justification in doubting the<br \/>\ncorrectness of the said decision rendered by a Bench of three Judges.<br \/>\nOn a consideration of the relevant aspects, we find that this Court had<br \/>\nconsidered all the relevant aspects while rendering the said decision and<br \/>\nthere is no reason for not applying the ratio of the said decision or for<br \/>\ndoubting its correctness.   We are, therefore, of the view that the<br \/>\nargument that the said decision requires reconsideration, is without<br \/>\nsubstance.\n<\/p>\n<p>8.\t\tIn the light of the decision in <a href=\"\/doc\/1259098\/\">Union of India and others<br \/>\nvs. O.P. Saxena<\/a> (supra) the decision of the Central Administrative<br \/>\nTribunal as affirmed by the High Court of Bombay, challenged before<br \/>\nus, has only to be sustained.   We, therefore, confirm the decision of the<br \/>\nHigh Court and dismiss these appeals.
