L&amp;DO to convey factually correct information to the appellant\nin regard to the levy of misuse charges in respect of unauthorized installation of\nprinting machinery by the Indian Express Group and Bennet, Coleman &amp;\nCompany etc. In compliance thereof, Shri Tehlan had conveyed requisite\ninformation to the appellant vide letters dated 22.1.2009 &amp; 16.2.2009.\n\n2.       Dissatisfied with this, the appellant has filed non-compliance complaint.\nThe matter was heard on 25.8.2009. The appellant is represented by Shri Amit\nSharma. The public authority is represented by Shri Vijay Tehlan, Dy. L&amp;DO.\nIt is the forceful submission of Shri Tehlan that the Commission's order has been\ncomplied with in letter and sprit. On the other hand, it is the submission of Shri\nAmit Sharma that, no doubt he has received some information but he would\nfurther need the following :-\n(i)      inspection of files relating to United India Periodical Pvt. Ltd. and taking\n         extracts from these files; &amp;\n(ii)     inspection of files relating to the Indian Express Group and the Times of\n         India Group.\n\n3.     To this, Shri Tehlan would submit that he has no objection to point No. (i)\nabove, but he strongly objects to point No. (ii) above on the ground of this\ninformation being third party information, more so, when these parties have\nstrongly objected to disclosure of any information relating to them.\n\n4.      In view of the above, Shri Vijay Tehlan is hereby directed to allow the\nappellant or his representative to inspect the files relating to United India\nPeriodical Pvt. Ltd and to take extracts therefrom on payment of requisite fee.\nHowever, as regards the appellant's request for inspection of files relating to the\nother two groups mentioned above, it is open to the appellant to submit a detailed\nrepresentation before the Commission to justify his request. As and when such\nrequest is received, the Commission will take an appropriate decision thereon.\n\n5.
