IN E' GROUP.\n TE~IE COURT MADE THE FOLLOWING:\n\n\n\nORDER\n<\/pre>\n<p>The petitiort:er&#8217;s grievance is over the Court&#8217;s perm.i:s&#8217;siTon<\/p>\n<p>granting further time to the respondent No.2   ~<\/p>\n<p>out the amendment.\n<\/p>\n<p>2. The respondent Nos.2 and   <\/p>\n<p>amendment of their written statemeiit. The Triai  its v i&#8217;<\/p>\n<p>order, dt.24.03.2006 ailowed the  iirther,,.i\u00a7as they<br \/>\ndid not amend the written  the prescribed<br \/>\ntime&#8212;frame, they fi1\u00a2d.lt11\u00a2  reasons for not<br \/>\namending the   and sought the<\/p>\n<p>extension of&#8217;-.tim_e&#8211;  the amendment. The Trial<br \/>\nCourt by its   granted one days time to<br \/>\namend th,e_%:g:.iA}ritten  by imposing a cost of RS500\/~.<br \/>\n order, this petition is presented.<\/p>\n<p>3;&#8211;FS1&#8217;i the learned Counsel for the petitioner<\/p>\n<p>Tsgubrriits   Order Vi Rule 18 of CPC the amendment<\/p>\n<p> hecarried out within the time fixed in the order itself<\/p>\n<p> &#8217;14 days from the date of the order. If no time is<\/p>\n<p>&#8211;Vpreseribed in the order its<\/p>\n<p> then the party shall not be<\/p>\n<p>permitted to amend after the expiration of such 14 days. He<\/p>\n<p>has also relied on the judgment of this Court in the cahsertof<\/p>\n<p>SR1 NJIANUMANTI-IARAYA v. SMT.MARIYA\u00a7IvI~3.l{;&#8217;S._&#8217;__j: &#8216;ifs; <\/p>\n<p>OTHERS, reported in 2008(3) KCCR 1465,  &#8221;  <\/p>\n<p>that if a party fails to early out the  e<\/p>\n<p>not entitled to the bene\ufb01t of amend1n_ent.V&#8221;  <\/p>\n<p>4. The facts of the Vreportetilmcaseujand this &#8216;case are<br \/>\nentirely different. In the instant ca  ithe:_:aft&#8217;idxa-grit for seeking<br \/>\nthe extension of  file ..statement was filed<\/p>\n<p>and the Trial   \u00e9ijaiiting only one days<\/p>\n<p>time and that too ha-cost of Rs.500\/\u00bb. The order<br \/>\nallowing the  amendment is absoluteiy<\/p>\n<p>su4.stainab}e_.\n<\/p>\n<p>A   in-View of the inconvenience suffered by the<\/p>\n<p>V&#8217;vv..x15etitioner&#8221;\u00ab\u00ab._ on&#8217; &#8216;account of the inaction on the part of<\/p>\n<p>  and 3 in the matter, the cost imposed is<\/p>\n<p> &#8216;torhe raised from Rs.OO\/&#8211; to Rs.2,500\/&#8211;.<\/p>\n<p>\u00a7<\/p>\n<p>6.
