It is alleged that on<br \/>\n13.11.1992 there was an accident wherein the bus was dashed with one<br \/>\nTempo which was coming from opposite direction as a result of which<br \/>\ntepo driver had died. A departmental inquiry was instituted which<br \/>\nresulted in  penalty of stoppage of three increments with future<br \/>\neffect. The respondent filed first appeal which came to be dismissed<br \/>\nand he did not avail of second appellate remedy and raised a disputed<br \/>\nwhich was numbered as Reference  (IT) no.34 of 1996 before Industrial<br \/>\nTribunal, Surat. The Industrial Tribunal by the aforesaid judgement<br \/>\nand award  quashed and set aside the punitive order.\n<\/p>\n<p>3.\tHeard<br \/>\nthe learned Advocate for the petitioner and perused the relevant<br \/>\nrecords. As a result of this exercise it is evident that in the<br \/>\ninquiry it was proved that there was a negligence on the part of the<br \/>\nrespondent workman.  In spite of this finding the Tribunal has<br \/>\nallowed the reference in toto. When there is a negligence, the<br \/>\nTribunal ought not to have set aside the entire punishment by taking<br \/>\nthe negligence very lightly and ought to have imposed some punishment<br \/>\nupon the respondent.\n<\/p>\n<p>4.\tLooking<br \/>\nto the overall facts and circumstances and also the previous default<br \/>\non the part of the respondent, I am of the view that a penalty of<br \/>\nstoppage of one increment with future effect  would meet the ends of<br \/>\njustice. Accordingly a penalty of stoppage of one increment with<br \/>\nfuture effect shall be imposed upon the respondent. The judgement and<br \/>\naward of the Tribunal is modified accordingly. This order shall be<br \/>\nimplemented within a period of three months from the date of receipt<br \/>\nof writ of this order.
