Justice V.GIRI\n\n Dated :24\/01\/2008\n\n O R D E R\n                                V.GIRI, J\n\n                              -------------------\n\n                           W.P.(C).1140\/2008\n\n                             --------------------\n\n           Dated this  the  24th day of January, 2008\n\n\n                             JUDGMENT\n<\/pre>\n<p>      Petitioner   is   at   present   working   as   Nursing<\/p>\n<p>Superintendent             Grade-I          in         General         Hospital,<\/p>\n<p>Thiruvananthapuram.   She was promoted to the said post<\/p>\n<p>under   Ext.P1   order   dated   31.8.2007.     Prior   to   her<\/p>\n<p>promotion   thereunder,   she   was   working   as   Nursing<\/p>\n<p>Superintendent   Grade-II   and   was   posted   in   the   Taluk<\/p>\n<p>Hospital, Thripunithura.    According  to the  petitioner,  she<\/p>\n<p>had sought for a posting in Eranakulam District and made<\/p>\n<p>repeated requests in this regard to the DHS.  She submits<\/p>\n<p>that     the   persons   juniors   to   her   had   also   sought   for   a<\/p>\n<p>posting   in   Eranakulam   District   and   were   given   such<\/p>\n<p>posting   accepting   their   request   and   ignoring   the   request<\/p>\n<p>made by the petitioner.\n<\/p>\n<\/p>\n<p>2.    Petitioner  further    contends  that  she  had  worked  in<\/p>\n<p>Thiruvananthapuram earlier for 5 = years from 28.3.1978<\/p>\n<p>to 17.7.1983.   Posting   at Thiruvananthapuram   visits her<\/p>\n<p>with   some   difficulties.     Her   husband   is   an   ex-serviceman<\/p>\n<p>W.P.(C).1140\/2008<\/p>\n<p><span class=\"hidden_text\">                                   2<\/span><\/p>\n<p>who   was   disabled   and   discharged     on   account     of   such<\/p>\n<p>disability.  Petitioner refers to Ext.P2 in this regard.  She<\/p>\n<p>has    two more  years  to retire.    She  submits  that as per<\/p>\n<p>the guidelines governing  transfer,  she is entitled to get<\/p>\n<p>a posting in Eranakulam District.\n<\/p>\n<\/p>\n<p>3.    I.A.1230\/2008     has  been   filed  producing   therewith<\/p>\n<p>Exts.P7   to   P9   representations   made   before   the   DHS<\/p>\n<p>pointing   out   these   aspects.     Learned   counsel   for   the<\/p>\n<p>petitioner submits that copies of Exts.P7 to P9 have been<\/p>\n<p>submitted   before   the   Government   as   well.   It   is   also<\/p>\n<p>submitted   that   there   is   an   open   vacancy   presently<\/p>\n<p>available at Eranakulam, it having arisen on 31.12.2007.<\/p>\n<p>Learned   Government   Pleader,   on   instructions,     submits<\/p>\n<p>that it has  not been filled up so far.\n<\/p>\n<\/p>\n<p>4.    After having gone through the writ petition as also<\/p>\n<p>I.A.1230\/2008 and having heard the learned counsel for<\/p>\n<p>the   petitioner     and   the   learned   Government   Pleader,<\/p>\n<p>writ petition is disposed of directing the first respondent<\/p>\n<p>W.P.(C).1140\/2008<\/p>\n<p><span class=\"hidden_text\">                                    3<\/span><\/p>\n<p>to consider Exts.P6 to P9 and take a decision thereon in<\/p>\n<p>accordance   with   law.     Petitioner&#8217;s   application   may   be<\/p>\n<p>considered   along   with   the   applications   of   other   eligible<\/p>\n<p>applicants   sought   for   a   posting   in   Eranakulam   District.<\/p>\n<p>Decision in this regard may be taken as early as possible<\/p>\n<p>at   any   rate   before   the   existing   open   vacancy   in<\/p>\n<p>Eranakulam   District   in                 the   post   of   Nursing<\/p>\n<p>Superintendent Grade-I is filled up.
