JUSTICE CHANDRA MOHAN PRASAD<\/p>\n<p> Barin Ghosh          There is no dispute that the writ-petitioner<br \/>\n      &amp;<br \/>\nC.M.Prasad,JJ respondent was not an employee of the appellant, he was a<\/p>\n<p>                deputanist. His parent Department was Small Industries<\/p>\n<p>                Service Institute, a Central Government establishment.<\/p>\n<p>                There is also no dispute that it was the appellant who<\/p>\n<p>                requested the writ-petitioner to give consent for absorption<\/p>\n<p>                in the appellant in the post of Assistant Manager(Accounts)<\/p>\n<p>                in public interest. The writ-petitioner respondent gave his<\/p>\n<p>                consent to the proposal, subject to counting his service as<\/p>\n<p>                an employee of the Central Government for the purpose of<\/p>\n<p>                settlement of his pension. The appellant approached the<\/p>\n<p>                Central Government for its consent for absorption of the<br \/>\n<span class=\"hidden_text\">                   -2-<\/span><\/p>\n<p>writ-petitioner in the appellant in the post of Assistant<\/p>\n<p>Manager (Accounts) in         public interest. The Central<\/p>\n<p>Government on the other hand asked the appellant to return<\/p>\n<p>the writ-petitioner to his parent Organization. In the mean<\/p>\n<p>time, the Board of Directors of the appellant approved the<\/p>\n<p>proposal for absorption of the writ-petitioner in the post of<\/p>\n<p>Assistant Manager (Accounts). The deputation of the writ-<\/p>\n<p>petitioner expired on 7th September 1987. Despite such<\/p>\n<p>expiry, the writ-petitioner was not returned to his parent<\/p>\n<p>Organization. In the mean time on 14th August 1987, once<\/p>\n<p>again the appellant approached the Central Government to<\/p>\n<p>approve permanent absorption of the writ-petitioner in the<\/p>\n<p>appellant. Ultimately on 19th July 1988 the Central<\/p>\n<p>Government approved absorption of the writ-petitioner in<\/p>\n<p>the appellant in public interest but in the post of Accountant.<\/p>\n<p>On 21st July 1989, the writ-petitioner was informed about<\/p>\n<p>his absorption in the post of Accountant. This resulted in<\/p>\n<p>filing of the writ petition. The same has been allowed by the<\/p>\n<p>judgment and order under appeal and, hence, the present<\/p>\n<p>appeal.\n<\/p>\n<p>          It was the appellant who offered the writ-petitioner<br \/>\n<span class=\"hidden_text\">                  -3-<\/span><\/p>\n<p>the post of Assistant Manager (Accounts) upon his<\/p>\n<p>absorption in the appellant which offer was accepted. The<\/p>\n<p>appellant    at no point of time offered         the post of<\/p>\n<p>Accountant to the writ-petitioner, upon his absorption in the<\/p>\n<p>appellant. In the result, merely on the basis of approval of<\/p>\n<p>the   Central Government      for absorption of the      writ-<\/p>\n<p>petitioner as Accountant in the appellant in public interest,<\/p>\n<p>the appellant could not absorb the writ petitioner in the post<\/p>\n<p>of Accountant.\n<\/p>\n<p>        An     employment is a contract and remains         a<\/p>\n<p>contract all throughout. Unless the employee agrees, he<\/p>\n<p>cannot be absorbed in the post where he has been deputed.<\/p>\n<p>Neither the original employer, nor the subsequent employer<\/p>\n<p>can compel an employee to work in a post in which the<\/p>\n<p>employee concern did not agree to work.\n<\/p>\n<p>        The appellant having had offered the post of<\/p>\n<p>Assistant Manager (Accounts) to the writ-petitioner and the<\/p>\n<p>same having been accepted by the writ-petitioner, there was<\/p>\n<p>no just reason for the appellant not to appoint      the writ<\/p>\n<p>petitioner upon his absorption in the appellant in the post of<\/p>\n<p>Assistant Manager (Accounts). The same having been<br \/>\n<span class=\"hidden_text\">                                      -4-<\/span><\/p>\n<p>                     declared by the judgment and order under appeal, there is no<\/p>\n<p>                     scope of interference.
