SIRI JAGAN, J.\n\n                      ----------------------------------\n\n                        W.P.(C)NO.20138 OF 2007\n\n                     ------------------------------------\n\n              DATED THIS THE 2nd DAY OF JULY, 2007\n\n\n                                   JUDGMENT\n<\/pre>\n<p>       The petitioner applied for admission to the MBA Course of the 1st<\/p>\n<p>respondent   University   in   the   4th  respondent&#8217;s   College.     As   per   the<\/p>\n<p>prospectus issued inviting applications for admission, it was made clear<\/p>\n<p>that those who are appearing for the final year examination that year<\/p>\n<p>of the qualifying course also may apply subject to the production of the<\/p>\n<p>mark   list   before   the   last   date   for   admission.     Accordingly,   the<\/p>\n<p>petitioner   secured   admission   to   the   4th  respondent&#8217;s   College.     He<\/p>\n<p>completed   the   1st  semester   and   when   he   was   about   to   write   the<\/p>\n<p>examination he was told that he cannot writ the examination because<\/p>\n<p>he had not passed the qualifying examination before the last date fixed<\/p>\n<p>for   admission   namely,   31.10.2006.     The   petitioner   submits   that   this<\/p>\n<p>happened   only   because   of   the   negligence   on   the   part   of   the   Calicut<\/p>\n<p>University in not taking the supplementary for the Vth   semester of the<\/p>\n<p>qualifying   examination   in   time.     The   petitioner   would   submit   that   as<\/p>\n<p>and when the supplementary examination was conducted he wrote  it<\/p>\n<p>and passed the same pursuant to which he produced the consolidated<\/p>\n<p><span class=\"hidden_text\">W.P.(c)No.20138\/07                           2<\/span><\/p>\n<p>mark   list   also.     However,   the   University   takes   a   stand   that   the<\/p>\n<p>petitioner   has   not   passed   qualifying   examination   on   the   last   date<\/p>\n<p>fixed for admission and therefore he was not validly admitted.  The<\/p>\n<p>petitioner therefore seeks the following reliefs.<\/p>\n<pre>             \"         i)     issue   writ   of   certiorari   quashing\n\n             Exhibit P10 order.\n\n                      ii)     issue a writ of mandamus or any other\n\n<\/pre>\n<p>             writ, direction or order directing the respondent 1<\/p>\n<p>             to 3 to register the petitioner&#8217;s name on the roll of<\/p>\n<p>             admission   for   MBA   2006-2008   (Batch)   of   1st<\/p>\n<p>             respondent   University,   accepting   Exhibit   P1   to<\/p>\n<p>             Exhibit P3 certificates.\n<\/p>\n<p>                      iii)    Direct   the   2nd  and   3rd  respondents   to<\/p>\n<p>             place Exhibit P12  representation before  Syndicate<\/p>\n<p>             of   M.G.   University   at   the   earliest   session   of   the<\/p>\n<p>             Syndicate to consider necessary relaxation of rigid<\/p>\n<p>             procedure so far adopted in denying admission to<\/p>\n<p>             the petitioner in the 1st respondent University.<\/p>\n<pre>\n\n                                      And\n\n                       iv)    to   issue   such   other   reliefs   as   this\n\n<\/pre>\n<p>             Honourable Court may deem fit and proper in the<\/p>\n<p>             facts and circumstances of the case.&#8221;\n<\/p>\n<\/p>\n<p>       2.         However,   for   the   present   the   petitioner   would   be<\/p>\n<p>satisfied with a direction to the Vice Chancellor to consider and pass<\/p>\n<p>orders on Ext.P12 expeditiously.\n<\/p>\n<\/p>\n<p>       3.         The learned standing counsel for the University submits<\/p>\n<p>that   since   Ext.P10   order   has   been   passed   by   the   Vice   Chancellor<\/p>\n<p>regarding the petitioner&#8217;s entitlement, it is only appropriate that the<\/p>\n<p>Syndicate   considers   Ext.P12.     Accordingly,   there   would   be   a<\/p>\n<p><span class=\"hidden_text\">W.P.(c)No.20138\/07                   3<\/span><\/p>\n<p>direction to the Syndicate of the University to consider Ext.P12 in its<\/p>\n<p>next meeting and pass appropriate orders thereon.<\/p>\n<p>       The writ petition is disposed of as above.\n<\/p>\n<\/p>\n<p>                                           S.
