                          The       following    prayer     of   the<\/p>\n
                 petitioners in this writ application:\n<\/p>\n
                          \"This       is    an   application     for\n                          issuance         of    an       appropriate\n                          writ\/writs,                 order\/orders,\n<\/pre>\n
                          direction\/ directions in the nature
\n                7<\/span><\/p>\n
        of     mandamus          for       commanding          and
\n        directing                   the            respondent
\n        authorities            to    regularize\/           absorb
\n        the        services         of    the     petitioners
\n        against       Class         IV    post,    which       are
\n        vacant in the district cadre as per
\n        the         Government            directions           and
\n        letters\/          Memos           issued      by       the
\n        respondent authorities from time to
\n        time         for         the        purposes            of
\n        regularization              of    the services         of
\n        like the petitioners, i.e. seasonal
\n        employee of Malaria department and
\n        further a direction may be given to
\n        the         respondents             authority           to
\n        regularize\/ absorb the services of
\n        the petitioners on vacant posts of
\n        Class       IV    by     preparing         the     panel
\n        amongst the seasonal employees who
\n        are working for so many years on
\n        different             programmes        in        Malaria
\n        Department              for         spraying            to
\n        eradicate         Malaria         and Kalazar          and
\n        accordingly            petitioners           be     given
\n        all the consequential benefits of a
\n        Govt. employee for which they are
\n        legally          entitled         and      for     other
\n        necessary         relief\/          reliefs        on   the
\n        basis            of         the         facts          and
\n        circumstances of the case.”\n<\/p>\n
now in view of authoritative pronouncement<\/p>\n
of the Apex Court in the case of Secretary,<\/p>\n
State of Karnataka vs. Uma Devi, reported in
\n                                    8<\/span><\/p>\n
            2006(4) SCC 1, has to be considered if there<\/p>\n
            be a scheme and that too by one time scheme<\/p>\n
            after taking into account as to whether the<\/p>\n
            initial      engagement            of   the     petitioners      was<\/p>\n
            made after following the mandate of Articles<\/p>\n
            14 and 16 of the Constitution of India.\n<\/p>\n
                         In that view of the matter, this<\/p>\n
            case    is        remitted         back    to     the    Principal<\/p>\n
            Secretary, Health, to examine the so called<\/p>\n
            claim        of        the        petitioners       for        their<\/p>\n
            regularization              in     service.     Such     decision,<\/p>\n
            however,          would           be    strictly        taken     in<\/p>\n
            conformity         with          the   judgment    of    the    Apex<\/p>\n
            Court in the case of Uma Devi (supra) within<\/p>\n
            a   period        of       six    months   from    the    date   of<\/p>\n
            receipt\/ production of a copy of this order.\n<\/p>\n
                         With the aforementioned observation<\/p>\n
            and direction, this application is disposed<\/p>\n
