Justice J.M.JAMES\n\n Dated :17\/07\/2006\n\n O R D E R\n                          J.M.JAMES, J.\n                            --------------\n                         B.A.4051\/2006\n                          ------------------\n      DATED THIS THE 17TH DAY OF JULY, 2006\n\n\n                            O R D E R\n<\/pre>\n<p>            The   petitioner   is   a   licensee,   for   conducting<\/p>\n<p>granite stone quarry, in the property of one   Kodakkadan<\/p>\n<p>Mohammed.  However, he was found in possession of five<\/p>\n<p>kilograms of sulphar.  The petitioner submitted that as he<\/p>\n<p>was  licensed,   he  was  conducting  the  quarrying,  through<\/p>\n<p>explosion of the granite.  The prosecution submits that the<\/p>\n<p>petitioner,   though   was   permitted   to   quarrying,   was   not<\/p>\n<p>legally   authorised   to   possess   such   explosive   substances.<\/p>\n<p>Manjeri   Police   registered       crime   No.395\/2006   under<\/p>\n<p>Section 5 of Explosives Substances Act, 1908,   and under<\/p>\n<p>Section 9 (b)(1) of the Explosives Act, 1884.   The counsel<\/p>\n<p>submits   that   as   the   petitioner     was   possessing   sulphar,<\/p>\n<p>section   9(b)(1)     of   the   Explosives   Act   alone   will   be<\/p>\n<p>effective,   and   as   the   petitioner   was   not   having   any<\/p>\n<p>materials for making any explosives substances, section 5<\/p>\n<p>of the  Explosives   Substances   Act  cannot  be  resorted to.<\/p>\n<p>B.A.4051\/2006<br \/>\n<span class=\"hidden_text\">                                   2<\/span><\/p>\n<p>Yet   another   contention   of   the   counsel   is   that   in   such<\/p>\n<p>circumstances, the offence alleged under the Explosives<\/p>\n<p>act is triable by the Magistrate court and the petitioner is<\/p>\n<p>hence entitled for bail.   The application is filed,   under<\/p>\n<p>Section 438 Cr.P.C.\n<\/p>\n<p>      2.     After hearing both sides, I direct the petitioner<\/p>\n<p>to surrender before the investigating officer   of Manjeri<\/p>\n<p>Police   Station,   on   21.7.2006   between   10.00   a.m   and<\/p>\n<p>11.00 a.m.   The petitioner shall be interrogated by the<\/p>\n<p>investigating officer and thereafter, be produced before<\/p>\n<p>the Judicial Magistrate of First Class-I,  Manjeri, as per<\/p>\n<p>the   law.     If   the   investigating   officer   requires   the<\/p>\n<p>petitioner   for   further   interrogation,   he   may   move   an<\/p>\n<p>application before the Court below for the custody of the<\/p>\n<p>petitioner,   which   shall   be   heard   by   the   learned<\/p>\n<p>Magistrate   and   appropriate   orders   shall   be   passed<\/p>\n<p>according to the law.\n<\/p>\n<p>      3.     If the petitioner move an application for bail,<\/p>\n<p>on production, the learned Magistrate shall also hear him<\/p>\n<p>as   well   as   the   Prosecutor   and   pass   orders   on   that<\/p>\n<p>B.A.4051\/2006<br \/>\n<span class=\"hidden_text\">                                     3<\/span><\/p>\n<p>application.
