Appellant was<br \/>\npresent at NIC Studio, Sonbhadra, while the respondent-Appellate<br \/>\nAuthority was present at NIC Studio, Sidhi. Commission conducted the<br \/>\nhearing from its New Delhi office.\n<\/p>\n<p>2.    Appellant, through his RTI-application dated 02.01.2009,<br \/>\nrequested the CPIO to allow him inspection of documents relating to<br \/>\ncorrespondence with the dependents of late Shri Satya Dev Pandey,<br \/>\nex-Foreman, Beena, who passed away on 09.02.2003.\n<\/p>\n<p>3.    Appellant was informed by the CPIO, Shri R.R. Singh, Sr.Mining<br \/>\nEngineer, NCL, Singrauli, through a communication dated 05.01.2009<br \/>\nthat appellant&#8217;s request was forwarded to the Department concerned<br \/>\nand that desired information would be supplied to him on receipt of the<br \/>\nsame from that Department.\n<\/p>\n<p>4.    On 04.02.2009, CPIO furnished a reply to the appellant on the<br \/>\nbasis of information received from the Deputy CPM (MP\/Recruitment),<br \/>\nNorthern Coalfields Limited, Singrauli that no correspondence was<br \/>\nestablished with the dependents of late Shri Satya Dev Pandey.\n<\/p>\n<p>5.  In the first-appeal, the Appellate Authority upheld            the<br \/>\ncommunication which was provided to the appellant by the CPIO.\n<\/p>\n<p>6.     Now in his second-appeal, appellant has made reference to<br \/>\ncorrespondence which respondents have had on 18.06.2003, 28.06.2003<br \/>\nand 29.08.2003 with him following the death of appellant&#8217;s father late<br \/>\nShri Satya Dev Pandey.\n<\/p>\n<p>7.    While the appellant claims that respondents had furnished to him<br \/>\nwrong and misleading information, it is the Appellate Authority&#8217;s plea<br \/>\nthat the appellant&#8217;s RTI-application made no mention about where his<br \/>\nAT-17072009-04.doc<br \/>\n<span class=\"hidden_text\">                                                            Page 1 of 3<\/span><br \/>\n late father, Shir Satya Dev Pandey worked. Due to non-availability of<br \/>\nthis important information, the CPIO and the Appellate Authority sought<br \/>\nthis information from the office where, according to their belief, it<br \/>\nmight have been held. But the reply they received from that office was<br \/>\nthat no such information was held by them.\n<\/p>\n<p>8.    Respondents claimed that only after appellant filed his second-<br \/>\nappeal and made references to certain correspondences, which were<br \/>\nentered into between the dependents of late Shri Satya Dev Pandey and<br \/>\nthe office of the public authority, did the Appellate Authority and the<br \/>\nCPIO came to know that late Shri Satya Dev Pandey was a Foreman at<br \/>\ntheir Beena Project. It was again only after the second-appeal filed by<br \/>\nthe appellant, that respondents \u23af Appellate Authority and CPIO \u23af<br \/>\nbecame aware that this information was likely to be held by the Beena<br \/>\nProject of the public authority. Accordingly, the matter was referred to<br \/>\nDeputy CPM (Recruitment), Beena on 05.01.2009 by the CPIO and on<br \/>\nreceiving his reply on 28.01.2009, CPIO furnished the requisite<br \/>\ninformation to the appellant on 04.02.2009.\n<\/p>\n<p>9.    It is, therefore, the submission of the respondents that they never<br \/>\nprovided wrong or misleading information to the appellant. They were<br \/>\nin fact misled by the failure of the appellant to properly inform CPIO<br \/>\nabout the last place of work of his late father.\n<\/p>\n<p>10. In view what has been submitted by both sides, I do not think any<br \/>\npurpose would be served by prolonging this matter further about fixing<br \/>\nresponsibility. I find merit in the respondents&#8217; submission that the<br \/>\nappellant himself had omitted to properly mention where his late father<br \/>\nworked which confused them about where the requested information<br \/>\nmight have been held. RTI Act expects not only that respondents<br \/>\nshould provide held information to the applicants but also that the<br \/>\napplicants would exercise due diligence in formulating their queries for<br \/>\nprecise and verifiable information. That has not happened in this<br \/>\nparticular case.\n<\/p>\n<p>11. However, considering the fact that appellant&#8217;s main request was<br \/>\nfor inspection of the correspondence between the dependents of late<br \/>\nShri Satya Dev Pandey and the public authority \u23af which is now known<br \/>\nto be the Beena Project held by Deputy CPM (MP\/Recruitment) \u23af it is<br \/>\ndirected that the respondents allow the appellant to inspect all these<br \/>\ndocuments on a day and time which may be intimated to him within the<br \/>\nnext three weeks of the receipt of this order. Appellant shall be<\/p>\n<p>AT-17072009-04.doc<br \/>\n<span class=\"hidden_text\">                                                              Page 2 of 3<\/span><br \/>\n allowed to take copies of the inspected documents on payment of the<br \/>\nrequisite fee.\n<\/p>\n<p>12.
