Justice M.SASIDHARAN NAMBIAR\n\n Dated :16\/09\/2009\n\n O R D E R\n              M.SASIDHARAN NAMBIAR,J.\n            ===========================\n            CRL.M.C.No.2873       OF 2009\n            ===========================\n\n    Dated this the 16th day of September,2009\n\n                        ORDER\n<\/pre>\n<p>    Petitioner, the first accused in S.C.42\/1996 of<\/p>\n<p>Additional Sessions Court II, Ernakulam was convicted<\/p>\n<p>and sentenced for the offences under sections 323 and<\/p>\n<p>324 of Indian Penal Code.   Under Annexure A1 judgment<\/p>\n<p>in Crl.A.140\/1998, the conviction was confirmed.   This<\/p>\n<p>petition is filed under section 482 of the Code of<\/p>\n<p>Criminal  Procedure,  for  a  direction  to  the  first<\/p>\n<p>respondent  to  consider   and  dispose     Annexure  2<\/p>\n<p>application filed by the petitioner under section 433<\/p>\n<p>of Code of Criminal Procedure expeditiously and also<\/p>\n<p>for a direction to the Sessions Court not to execute<\/p>\n<p>the sentence till the disposal of Annexure 2 petition.<\/p>\n<p>    2.   Learned counsel appearing for the petitioner<\/p>\n<p>and the learned Public Prosecutor were heard.<\/p>\n<p>    3.   The learned counsel submitted that Annexure 2<\/p>\n<p>petition was filed before the Government, under section<\/p>\n<p>433 of Code of Criminal Procedure and till a decision<\/p>\n<p>is taken on Annexure 2 application, petitioner may not<\/p>\n<p>be arrested and sent to prison.        Learned counsel<\/p>\n<p><span class=\"hidden_text\">Crl.M.C.2873\/2009              2<\/span><\/p>\n<p>submitted that the Division Bench decision      of this Court<\/p>\n<p>in <a href=\"\/doc\/912930\/\">Moideenkoya v. Secretary<\/a> to Government (2008(4) KLT 257<\/p>\n<p>is not applicable to the facts of the case as what was<\/p>\n<p>considered in that case is only      the powers under Article<\/p>\n<p>226 of the Constitution of India and this petition is filed<\/p>\n<p>under section 482 of Code of Criminal Procedure and       this<\/p>\n<p>court can grant an order not to execute the sentence till<\/p>\n<p>the disposal of the application filed under section 433 of<\/p>\n<p>Code of Criminal Procedure to prevent abuse of process of<\/p>\n<p>the court and to secure justice.\n<\/p>\n<p>      4.   Learned Public Prosecutor submitted that Annexure 2<\/p>\n<p>application is under consideration of the Government and<\/p>\n<p>appropriate order will be passed in accordance with law<\/p>\n<p>after getting a report from the Superintendent of Police,<\/p>\n<p>Ernakulam.      Learned Public Prosecutor also submitted that<\/p>\n<p>petitioner is not entitled to get an order, restraining the<\/p>\n<p>execution of the sentence, till a decision is taken on<\/p>\n<p>Annexure 2 application.\n<\/p>\n<p>      5.    The question whether petitioner is to be granted<\/p>\n<p>the   benefit    under  section  433   of  Code  of   Criminal<\/p>\n<p>Procedure, is within the prerogative of the Government.<\/p>\n<p>Petitioner is not entitled to contend that he is entitled<\/p>\n<p>to get the benefit under section 433 of the Code of<\/p>\n<p>Criminal     Procedure.     This  court  cannot   direct   the<\/p>\n<p><span class=\"hidden_text\">Crl.M.C.2873\/2009               3<\/span><\/p>\n<p>Government to grant commutation under section 433 of the<\/p>\n<p>Code    of   Criminal  Procedure.    Though  learned  counsel<\/p>\n<p>appearing for the petitioner submitted that the Division<\/p>\n<p>Bench decision is not applicable, I cannot agree with the<\/p>\n<p>submission.        When  the   conviction  and   sentence   is<\/p>\n<p>subsisting, as it is finally decided, the fact that a<\/p>\n<p>petition is pending under section 433 of the Code of<\/p>\n<p>Criminal Procedure is not a ground to stay the execution of<\/p>\n<p>the sentence,     though what is sought for is only to refrain<\/p>\n<p>from repeating the warrant of arrest.       Under that guise,<\/p>\n<p>prayer is not to execute the sentence. Petitioner is not<\/p>\n<p>entitled to such an order.
