Lakshmanan &amp; Altamas Kabir\n\nJUDGMENT:\n<\/pre>\n<p>JUDGMENT<br \/>\nO R D E R<br \/>\nWith<br \/>\nCivil Appeal No. 4069\/2003 &amp;<br \/>\nCivil Appeal No. 9108\/2003<\/p>\n<p>Heard Shri Soli J. Sorabjee learned senior counsel for the<br \/>\nappellant, Mr. P.P.Rao learned senior counsel for the<br \/>\ncontesting respondents and Mr. G. Bikshapathy learned senior<br \/>\ncounsel for the other respondents. The matters were heard at<br \/>\nlength on an earlier occasion. These are listed for final hearing<br \/>\ntoday before us. After some discussions all the parties to these<br \/>\nproceedings agree that the order impugned in these<br \/>\nproceedings passed by the High Court in D.B. Civil<br \/>\nMiscellaneous Application No.2556 and 2557\/2002 dated<br \/>\n27.11.2002 and D.B. Civil Writ Petition No. 4869\/2001 dated<br \/>\n30.07.2002 be set aside and a sole arbitrator be appointed to<br \/>\nresolve the entire dispute between the parties. We, therefore<br \/>\nset aside the order passed by the Division Bench of the High<br \/>\nCourt in DBCMA. No.2556 and 2557\/2002 dated 27.11.2002<br \/>\nand DBCWP No. 4869\/2001 dated 30.07.2002. No costs. All<br \/>\nthe Civil Appeals 4066-4067\/2003, 4069\/2003 and<br \/>\n9108\/2003 are disposed of accordingly.<br \/>\nIn view of the agreement between the parties we appoint<br \/>\nHon&#8217;ble Mr. Justice D.P.Wadhwa, C-25, Panchsheel Enclave,<br \/>\nNew Delhi &#8211; 110017, retired judge of this Court as the sole<br \/>\nArbitrator to resolve the entire dispute between parties to<br \/>\nthese proceedings. We order accordingly.<br \/>\nWe make it clear that this order is passed in the special<br \/>\nand peculiar circumstances of the case and it shall not be<br \/>\ntreated as a precedent. We request the arbitrator to dispose off<br \/>\nthe matter and make his award within three months from the<br \/>\ndate of entering upon the reference. The sole Arbitrator may<br \/>\ntake the assistance of a Chartered Accountant. The parties to<br \/>\nthis action will bear the costs to the Arbitration proceedings<br \/>\nequally. The sole Arbitrator is at liberty to fix his fees in<br \/>\nconsultation with both the parties. The Venue for Arbitration<br \/>\nis at Delhi.
