KURIAKOSE, J.\n                     ----------------------------------\n                      W.P.(C) NO. 34077 of 2007\n                     ----------------------------------\n           Dated this the 10th day of December , 2007\n\n                               JUDGMENT\n<\/pre>\n<p>      The petitioner, a charitable trust, is aggrieved by Exts.P3 and P4<\/p>\n<p>orders passed respectively by the District Town Planner, Malappuram<\/p>\n<p>and the Secretary of the Malappuram Municipality turning down the<\/p>\n<p>petitioner&#8217;s request for permission to construct a residential apartment<\/p>\n<p>on their property covered by Wakf Deed No.1161\/2003 of S.R.O.<\/p>\n<p>Malappuram.      The District Town Planner has refused to grant<\/p>\n<p>permission on the reason that as per the notified town planning<\/p>\n<p>scheme, the property in question falls within the area of paddy field.<\/p>\n<p>      2.    A statement has been filed by the District Town Planner,<\/p>\n<p>justifying Exts.P3 and P4, which is only a consequential order. It is<\/p>\n<p>contended in the statement as follows:\n<\/p>\n<blockquote><p>            &#8221;     2. The Municipal Secretary vide letter No.BA<br \/>\n            339\/06-07     dated    10.1.2007    forwarded   the<br \/>\n            application to the District Town Planner for getting<br \/>\n            the opinion of the town planner as the site of the<br \/>\n            proposed construction falls within the area zoned<br \/>\n            for paddy fields as per the Government approved<br \/>\n            Master Plan for Malappuram Municipality.\n<\/p><\/blockquote>\n<p><span class=\"hidden_text\">WPC No.34077\/2007                 2<\/span><\/p>\n<blockquote><p>                 4. The Honourable High Court of Kerala in<br \/>\n           the judgment passed on 7.11.2005 in O.P.<br \/>\n           No.8740\/97 has stated that the Government has<br \/>\n           no    power    to   exempt    individual  building<br \/>\n           applications   from  the   provisions  of   zoning<br \/>\n           regulations        of      the        Government<br \/>\n           approved\/sanctioned Master Plans and detailed<br \/>\n           town     Planning   Schemes.        Subsequently,<br \/>\n           Government in several orders and letters viz.<br \/>\n           Orders No.54757\/MI\/05\/LSGD dated 22.12.2005,<br \/>\n           letter No.2011\/R3\/2003\/LSGD dated 2.1.2006,<br \/>\n           has directed to stop all procedure for accepting<br \/>\n           and processing the individual application for<br \/>\n           exemption from the approved Town Planning<br \/>\n           Schemes until further orders.&#8221;<\/p><\/blockquote>\n<p>      3. Heard Sri.Babu Paul, the learned counsel for the petitioner,<\/p>\n<p>Sri. Babu S.Nair, the learned Standing Counsel for the Municipality and<\/p>\n<p>Sri.Muhammed Anzar, the learned Government Pleader for the first<\/p>\n<p>respondent.    The learned counsel would make submissions on the<\/p>\n<p>basis of the pleadings raised by their respective parties.         The<\/p>\n<p>Government Pleader submitted that so long as the judgment of this<\/p>\n<p>court in <a href=\"\/doc\/1066044\/\">Sayeesh Kumar v. State of Kerala<\/a> (2005 (4) KLT 1027)<\/p>\n<p>holds the field, the Government will not be able to give permission to<\/p>\n<p>the petitioner to violate the zoning regulations in the master plan.<\/p>\n<p>But, as rightly pointed out by the learned counsel for the petitioner,<\/p>\n<p>Ext.P1 order was passed by the Competent Authority under Kerala<\/p>\n<p>Land Utilization Order as far back as in 26.11.1984 and pursuant to<\/p>\n<p>that order, the property has been completely reclaimed and is<\/p>\n<p><span class=\"hidden_text\">WPC No.34077\/2007                  3<\/span><\/p>\n<p>presently pakka garden land which means that notwithstanding its<\/p>\n<p>inclusion as paddy filed in the master plan the property is a garden<\/p>\n<p>land. Construction of farm houses, milk processing plants, which are<\/p>\n<p>probably with the    concurrence of the Chief Town Planner, in this<\/p>\n<p>property are     being   permitted even     as per the master plan.<\/p>\n<p>Considering     these facts and   considering all the reality that the<\/p>\n<p>property in question is as of now a garden land, I am inclined to grant<\/p>\n<p>relief.\n<\/p>\n<p>       Accordingly, I quash Exts.P3 and P4 and direct the 2nd<\/p>\n<p>respondent Municipality to reconsider the petitioner&#8217;s application for<\/p>\n<p>building permit and grant approval to the plan if the same is otherwise<\/p>\n<p>in order i.e in accordance with the Kerala Municipality Building Rules.<\/p>\n<p>Zoning of the property as paddy field as per the master plan will not<\/p>\n<p>be a ground for rejection of plan.\n<\/p>\n<\/p>\n<p>                                PIUS C.
