No.1144\/2005 whereby, the claim petition has been<br \/>\npartly allowed and the original opponents have been held liable to<br \/>\npay Rs.5,59,000\/- as compensation with proportionate costs and<br \/>\ninterest to the original claimant.\n<\/p>\n<p>2.\tThe<br \/>\nfacts in brief are that on 27.10.2005 while respondent no.1 herein,<br \/>\noriginal claimant, was driving his motor-cycle bearing No.<br \/>\nGJ-1-CG-8697 with his wife as a pillion rider, a car bearing No.<br \/>\nGJ-15N-2727 came from the opposite direction and dashed the<br \/>\nmotor-cycle. As a result thereof, respondent no.1 sustained severe<br \/>\nbodily injuries. Later, he filed the claim petition before the<br \/>\nTribunal claiming compensation of Rs.6.00 Lacs. After considering the<br \/>\nrecords of the case, the Tribunal partly allowed the claim petition<br \/>\nby way of the impugned award. Being aggrieved by the same, the<br \/>\nappellant-Insurance company has preferred the present appeal.\n<\/p>\n<p>3.\tHeard<br \/>\nlearned counsel for the appellant and perused the documents on<br \/>\nrecord. The impugned award passed by the Tribunal has been assailed<br \/>\nmainly on the grounds that the motor-cyclists ought to have been held<br \/>\nliable for contributory negligence and that the compensation has been<br \/>\narrived at without any basis.\n<\/p>\n<p>4.\tAs<br \/>\nper the say of the complainant, who happens to be the wife of<br \/>\nrespondent no.1, original claimant, the car in question came from the<br \/>\nopposite direction in full side. Before the Tribunal, the<br \/>\napplicant-Insurance Company has not examined the driver of the car,<br \/>\ni.e. respondent no.2 herein. No documentary evidence were produced by<br \/>\nthe applicant in support of its written statement. In view of the<br \/>\nabove, adverse inference was drawn against the applicant and<br \/>\nconsequently, the Tribunal held that respondent no.2-driver was<br \/>\nsolely negligent for the accident in question.\n<\/p>\n<p>5.\tSo<br \/>\nfar as the issue of quantum of compensation is concerned, the<br \/>\nTribunal has assessed the monthly income of the claimant at<br \/>\nRs.15,000\/-. It appears that before the Tribunal, the<br \/>\napplicant-Insurance Company has not cross-examined the original<br \/>\nclaimant on the issue of income. In the absence of the same, the<br \/>\nTribunal assessed the monthly income at Rs.15,000\/-.\n<\/p>\n<p>6.\tConsidering<br \/>\nthe facts of the case and the evidence on record, the assessment made<br \/>\nby the Tribunal is just, legal and reasonable. I am in complete<br \/>\nagreement with the reasoning given by the Tribunal in the impugned<br \/>\naward and hence, find no reasons to interfere in this appeal.\n<\/p>\n<p>7.\tFor<br \/>\nthe foregoing reasons, the appeal is summarily rejected.<br \/>\nConsequently, the civil application stands disposed of.\n<\/p>\n<p>[K.\n<\/p>\n<p>S.
