Mtr.\n<\/p>\n<p>2.\tThe<br \/>\nlands of village Acchhwada, Taluka Dasada, District Surendranagar<br \/>\nwere acquired for the public purpose of Zinjuwada Branch Canal,<br \/>\nNarmada Canal Yojana. Notification under Section 4(1)  of the Act was<br \/>\nissued, which was published in the Official Gazette on 27.2.1992.<br \/>\nThereafter, the State Government made declaration under Section 6 of<br \/>\nthe Act, which was published on 5.3.1993. The interested persons were<br \/>\nserved with notices for determination of compensation payable to<br \/>\nthem. The claimants appeared before the Special Land Acquisition<br \/>\nOfficer and claimed compensation at the rate of Rs.10\/- per Sq. Mtr.<br \/>\nHowever, the Special Land Acquisition Officer offered compensation to<br \/>\nthe claimants at the rate of Rs.0.8 per Sq. Mtr. for  non<br \/>\nnon-irrigated lands and Rs.1.20 per Sq.Mtr. for irrigated lands.\n<\/p>\n<p>3.\tThe<br \/>\nclaimants, seeking higher compensation, submitted an application<br \/>\nunder Section 18 of the Act requiring the Special Land Acquisition<br \/>\nOfficer to refer their cases to the Court for the purpose of<br \/>\ndetermining the just and fair compensation.  Accordingly, the<br \/>\nreference was made to the Joint  District Court, Dhrangadhra;  where<br \/>\nthey were registered as Land Reference Case Nos.23 to 33 of 1998.\n<\/p>\n<p>4.\tOn<br \/>\nbehalf of the claimants, one Dashrathbhai Sadhu was examined at<br \/>\nExh.32.  The claimant in his deposition had referred an award passed<br \/>\nin Land Acquisition Reference No.1571 of 1987.  At his instance, the<br \/>\nsaid award is exhibited.  The said award is for the lands of village<br \/>\nVarmol for which notification under Section 4 was published on<br \/>\n10.11.1986.  The claimant deposed that the lands acquired in the year<br \/>\n1986 and the lands for which the Reference  Nos.23 to 33 of 1998<br \/>\nwere  filed, were  only at a very short distance. Varmol is the<br \/>\nadjoining village of village Acchhwada. Though the said witness was<br \/>\ncross-examined for the learned counsel for the acquiring<br \/>\nauthorities, nothing substantial could be elicited, nor the<br \/>\nassertions made by the witness could be demonstrated to be false.\n<\/p>\n<p>5.\tThe<br \/>\nclaimants had also placed reliance on the award passed in L.R.C.<br \/>\nNo.660 of 1998 for village Jinjunvada. The Notification under Section<br \/>\n4 was issued in the said case on 25.7.1986 and the compensation was<br \/>\ngiven at the rate of Rs.6\/- per Sq.Mtr.\n<\/p>\n<p>6.\tThe<br \/>\nappellant had examined one Mr. Mahadevbhai Narayanbhai Jhadav, Talati<br \/>\nof Acchhawada. The Talati had deposed that village Acchhawada,<br \/>\nVarmol, Jinjuwada are the adjoining villages.\n<\/p>\n<p>7.\tOn<br \/>\nappreciation of the evidence adduced by the parties, the Reference<br \/>\nCourt was of the opinion that the previous award of the Reference<br \/>\nCourt relating to the lands of adjoining village, was a relevant<br \/>\npiece of evidence and furnished good guidance for the purpose of<br \/>\ndetermining of the market value of the lands acquired in the instant<br \/>\ncase.  The learned Judge noticed that notification under Section 4(1)<br \/>\nof the Act was published in the Official Gazette on 04.10.1986 and<br \/>\n25.7.1986 for the lands acquired earlier;  whereas, in the instant<br \/>\ncase, the notification under the said Section was issued on<br \/>\n27.02.1992.  He, thereafter, calculated the reasonable rise in the<br \/>\nprice of the lands at the rate of 10% per annum. For earlier<br \/>\nacquisition of the lands, award at the rate of Rs.5.5 and Rs.6\/- per<br \/>\nSq. Mtr. respectively were passed. Considering that aspect, the Trial<br \/>\nJudge derived a figure of Rs.10\/- per Sq. Mtr.\n<\/p>\n<p>8.\tI<br \/>\nhave heard Ms. Trusha Patel, learned Assistant Government Pleader for<br \/>\nthe appellants and Mr. Thakar, learned Counsel for the claimants. Ms.<br \/>\nPatel submitted that the applications to make the reference were time<br \/>\nbarred and hence, they should not have been entertained. She has<br \/>\nfurther contended that the claimants had not produced sale bills or<br \/>\npurchase bills to show the expenditure incurred by the claimants for<br \/>\nfertilizers, seeds, medicines, etc. She further contended that even<br \/>\napart from the above bills, no document is produced to prove that the<br \/>\nlands in dispute were of equal fertility, potentiality and having<br \/>\nequal facilities as compared to the lands for which L.A.R. No.1571 of<br \/>\n1987 and L.A.R. No.660 of 1998 were passed. She had contended that<br \/>\nthe learned Trial Judge had not discussed the aspect as to how the<br \/>\nsaid awards were comparable.  She has further contended that the<br \/>\ncross-examination of the claimant  revealed  that no land of the<br \/>\nvillage of which the lands were acquired was sold at higher price.<br \/>\nEven valuation made in Jantri is not considered.  She tried to<br \/>\ncontend that the award passed in LAR No.1571 of 1987 was not<br \/>\ncomparable. She has further contended that even if  the said award is<br \/>\ncompared, the claimants would not be entitled to compensation at the<br \/>\nrate of Rs.10\/-. On calculation, as  she submitted, the market price<br \/>\nwould not be more than Rs.8\/- per Sq.Mtr.\n<\/p>\n<p>9.\tIn<br \/>\nresponse to her contentions, Mr. Thakar had submitted that as the<br \/>\nlands of earlier reference were  of adjoining village, it could<br \/>\nsafely be presumed that the awards were comparable. He had further<br \/>\ncontended that the Civil Court had rightly compared the award passed<br \/>\nin LAR No.660 of 1998 and had rightly awarded  Rs.10\/- per Sq.Mtr. He<br \/>\n further contended that the applications filed to make the reference<br \/>\nwere not time barred. He had submitted that the learned Civil Judge<br \/>\nhas considered this aspect and only after close scrutiny, the Civil<br \/>\nJudge has held that the applications were filed in time.\n<\/p>\n<p>10.\tThis<br \/>\nCourt has also considered the record and proceedings supplied by the<br \/>\nlearned counsel for the claimants  which includes the documentary<br \/>\nevidence adduced by the parties before the Reference Court. Having<br \/>\ngone through the entire record, I am of the opinion that the<br \/>\ncompensation awarded by the learned Civil Judge was absolutely just<br \/>\nand proper. The learned Civil Judge has rightly considered the awards<br \/>\npassed in LAR Case No.1571 of 1987 and LAR Case  No.660 of 1998 as<br \/>\nthe same were comparable in facts and circumstances of the present<br \/>\ncase. The said references were for the lands of the adjoining<br \/>\nvillages, having similar fertility,  potentiality and facilities.<br \/>\nEarlier awards  cannot be discarded on the ground that it is not for<br \/>\nthe lands of the same village. What is required to be considered is<br \/>\nthe similarity  in facilities, fertility and potentiality.\n<\/p>\n<p>11.\tIt<br \/>\nis well settled principle of law that the previous award passed by<br \/>\nthe Reference Court relating to the lands of adjoining village, if<br \/>\nhas attained finality, is a very good piece of evidence for the<br \/>\npurpose of determining  market value of similar lands acquired from<br \/>\nthe same village subsequently. In the facts and circumstances of the<br \/>\npresent case, this Court is of the opinion that the Reference Court<br \/>\ndid not commit any error in enhancing the compensation. The Civil<br \/>\nCourt has passed a well reasoned judgment. This Court, therefore,<br \/>\nfinds no reason to interfere with the award passed by the Reference<br \/>\nCourt in L.A.R. No.23 to 33 of 1998.\n<\/p>\n<p>12.\tFor<br \/>\nthe foregoing reasons, the above captioned appeals are dismissed.<br \/>\nThere shall be no order as to costs. The Registry is directed to draw<br \/>\nthe decree in terms of this judgment immediately. The remaining<br \/>\namount of compensation, if not disbursed, may be disbursed to the<br \/>\nrespective claimants after verification of their identity.\n<\/p>\n<p>13.\tOffice<br \/>\nis directed to send R &amp;
