(J)\n\nCITATION<\/a>:\n 1995 SCALE  (5)1\n\n\nACT:\n\n\n\nHEADNOTE:\n\n\n\nJUDGMENT:\n<\/pre>\n<p>\t\t\t O R D E R<br \/>\n     Leave granted.\n<\/p>\n<p>     The  respondent  herein  on  supply  of  goods  to\t the<br \/>\nappellants raised bills which were partly cleared. Since the<br \/>\nbalance was  substantial  and  the  appellants\ta  statutory<br \/>\nauthority and  its representatives, the respondent moved the<br \/>\nHigh Court  of Orissa  in a writ Petition for a direction so<br \/>\nas to  recover the  balance outstanding.  The High  Court on<br \/>\nentertainment of  the Writ  Petition came  to grips  of\t the<br \/>\nmatter inclusive  of the  objection by the appellants that a<br \/>\ncivil  suit  was  the  appropriate  remedy.  Overruling\t the<br \/>\nobjection, the\tHigh Court  was moved  by the  fact that the<br \/>\nwrit petitioner\t before it,  i.e.,the respondent herein, had<br \/>\nundeniably supplied  the goods\tat the rate quoted by it and<br \/>\nthat the  appellants had  after taking delivery utilised the<br \/>\nsaid goods,  which factum was not disputed. It took the view<br \/>\nthat when  the facts were admitted, there was no justifiable<br \/>\nreason on  the part  of the appellants not to pay the amount<br \/>\ndue to\tthe respondent when it had supplied the goods to the<br \/>\nappellants. It\tis, in\tthese circumstances,  that the\tHigh<br \/>\nCourt ordered payment of the quoted price of goods supplied,<br \/>\nallowing the  writ petition. That view of the High Court has<br \/>\nbeen put to challenge here.\n<\/p>\n<p>     We do  not wish  either to comment on the step taken or<br \/>\nthe view  arrived at  by the High Court in these proceedings<br \/>\nsince we  find that  before the High Court the appellants in<br \/>\ntheir counter  had pleaded that since they had been put to a<br \/>\nloss of\t Rs.43,16,400\/- due  to high  quotations they  had a<br \/>\nright to  withhold that\t amount for  being paid-over  to the<br \/>\nrespondent. On\tthe other  hand, in  the  pleadings  of\t the<br \/>\nrespondent herein,  before the\tHigh Court,  as\t also  here,<br \/>\nclaim is  laid that a sum of Rs.66,09,669.36 was outstanding<br \/>\nand had been wrongly withheld. Interwining these two claims,<br \/>\nit would  become apparent that a sum of about Rs. 23 lacs on<br \/>\nthe parties&#8217;  own showing  is not  disputed to be due to the<br \/>\nrespondent towards  its claims.\t For this reason, we explain<br \/>\naway the  orders of  the High  Court by\t ordering  that\t the<br \/>\nappellants shall  pay without  prejudice a sum of Rs.23 lacs<br \/>\nto the\trespondent towards part clearance of the outstanding<br \/>\nbills and  sequally the\t orders of  the High  Court shall be<br \/>\nmeant to confine to the payment of Rs.23 lacs, which is more<br \/>\nor less\t not disputed,\tas payable.  Regarding\tthe  balance<br \/>\nclaim of  respondent, since it is disputed, it would have to<br \/>\nmove  the  civil  court\t claiming  it  in  a  regular  suit.<br \/>\nNecessarily accounting\twill be resorted to in that suit and<br \/>\nthe sums  of moneys already paid to the respondent inclusive<br \/>\nof the sum of Rs.23 lacs, as ordered to be paid today, would<br \/>\nhave to\t be reckoned  in finalizing  the accounts. We, thus,<br \/>\nmodifyingly clarify  the High Court&#8217;s orders confining it to<br \/>\nordering  the  above  payment  of  Rs.23  lacs\tleaving\t all<br \/>\nquestions open\tinclusive of  the claim\t to interest  on all<br \/>\npayments made  delayedly to  be\t settled  before  the  civil<br \/>\ncourt. The  appeal would  stand disposed  of accordingly.
