Notification<br \/>\nunder s.4(1)  of the  Land Acquisition Act, 1894 (for short,<br \/>\n`the Act&#8217;)  was published in the State Gazette on August 29,<br \/>\n1980 acquiring\tan extent  of 46  acres 6 gunthas of land in<br \/>\nMiryalaguda town  in Nalgonda  Dist.  of  A.P.\tfor  planned<br \/>\ndevelopment by\tthe Andhra Pradesh Housing Board. Possession<br \/>\nthereof was  taken on  December 10,  1980 and  the award was<br \/>\nmade on\t August 18, 1983 determining the compensation at the<br \/>\nrate of\t Rs.65,000\/- per  acre and  deducted  1\/3rd  towards<br \/>\ndevelopmental  charges\t and  fixed   the  compensation\t  at<br \/>\nRs.43,000\/- per\t acre with statutory benefits. On reference,<br \/>\nthe Subordinate Judge Suryapet in O.P. No.20\/84 enhanced the<br \/>\ncompensation to\t Rs. 1,20,000\/- per acre, and deducted 1\/4th<br \/>\ntowards\t developmental\t charges  together   with  statutory<br \/>\nbenefits. On  appeal to\t the High Court, while upholding the<br \/>\nmarket value of the lands at Rs. 1,20,000\/- per acre, it had<br \/>\ndeducted 40%  of the  value of\tthe land  for  developmental<br \/>\ncharges and also that fixation of the market value was based<br \/>\non exhibit  X-1 to  X-3 sale  deed of  small extent  of\t one<br \/>\nguntha each.  Thus, these  appeals by  special leave against<br \/>\nthe judgment  and decree  of the  High\tCourt  in  A.S.\t No.<br \/>\n1833\/85 dated December 15, 1992 and batch.\n<\/p>\n<p>     Shri K.  Madhava Reddy,  the learned senior counsel for<br \/>\nthe appellant  placing reliance\t on Vijay Kumar Moti Lal Vs.<br \/>\nState of  Maharashtra, [(1981)\t2 SCC  719] and <a href=\"\/doc\/1893035\/\">Special Land<br \/>\nAcquisition  Officer,  Vishakapatnam  vs.  Smt.\t A.  Mangala<br \/>\nGowri,<\/a> [(1991)\t4 SCC  218] contended  that this  Court\t had<br \/>\nupheld deduction  of uniform  rate of  1\/3rd is required for<br \/>\ndevelopmental charges.\tThe High  Court, therefore,  was not<br \/>\nright  in  deducting  40%  of  value  towards  developmental<br \/>\ncharges. We  think that\t the contention is not well-founded.<br \/>\nThe High Court has noticed in its judgment thus :\n<\/p>\n<blockquote><p>     &#8220;However, as the sales under Exs. X-1 to<br \/>\n     X-3 are  for  very\t small\textents\t when<br \/>\n     compared to  the lands under acquisition<br \/>\n     and the  acquisition is  meant  for  the<br \/>\n     housing   scheme\tof   housing   board,<br \/>\n     necessary\tdeduction  will\t have  to  be<br \/>\n     given for developmental charges and also<br \/>\n     for taking\t into consideration the sales<br \/>\n     which  are\t  for  smaller\t plots\twhile<br \/>\n     considering the fixation of market value<br \/>\n     for the  lands under  acquisition\twhich<br \/>\n     are in a large extent.&#8221;<\/p><\/blockquote>\n<p>     In view  of this finding, the High Court had taken into<br \/>\nconsideration\tnot    only   the    requirements    towards<br \/>\ndevelopmental charges  but also\t when reliance\tis placed by<br \/>\nthe Court  in Ex.  X-1 to X-3, admittedly smaller extents of<br \/>\none guntha each which had fetched a market value at the rate<br \/>\nof Rs.\t1,20,000\/-, necessary  deduction need  to be  given.<br \/>\nTaking these  two factors  into consideration, ultimately it<br \/>\ndeducted   40%,\t   though   loosely   termed   as   &#8220;towards<br \/>\ndevelopmental charges&#8221;.\t This Court in <a href=\"\/doc\/859367\/\">Administrator General<br \/>\nof West\t Bengal vs.  Collector, Varanasi,<\/a> [AIR 1988 SC 943],<br \/>\nhas applied  the  twin\ttests  and  held  that\t50%  of\t the<br \/>\ndeduction should be made when the sale transaction relate to<br \/>\nsmaller extent\tof the\tlands were  found to  be genuine and<br \/>\nrelied on  to determine the market value of a large track of<br \/>\nland and  and 50%  deduction was  found to  be reasonable in<br \/>\nthat case.  The State  did not\tfile appeal against enhanced<br \/>\ncompensation or deduction.\n<\/p>\n<p>     In Bhagwathula Samanna and Others Vs. Special Tahsildar<br \/>\nand Land  Acquisition Officer,\tVishakapatnam  Municipality,<br \/>\n[AIR 1992 SC 2298], this Court had held that since lands are<br \/>\nin  developed\tarea,  no  deduction  towards  developmental<br \/>\ncharges be made. In Vijay Kumar Motil Lal&#8217;s and Mangal Gauri<br \/>\ncases [supra], the only question was regarding deduction for<br \/>\ndevelopmental charges.\tSales relating\tto smaller pieces of<br \/>\nland when  found to  be germane\t Gujarat High Court deducted<br \/>\n60% of\tthe value,  this Court\tin <a href=\"\/doc\/909226\/\">M\/s.\t Hasanali Khanbhai &amp;<br \/>\nSons &amp;\tOrs. v.\t State of  Gujarat<\/a> [C.A.  No. 3263\/79] dated<br \/>\nJuly 26,  1995, upheld\tthe deduction  of 60%  by  the\tHigh<br \/>\nCourt. When  genuine and  reliable sale\t deeds of      small<br \/>\nextents were  considered to determine market value, the same<br \/>\nwill not  form sole basis to determine market value of large<br \/>\ntrack of  lands. Sufficient  deduction\tshould\tbe  made  to<br \/>\narrive at  the just  and fair market value of large track of<br \/>\nland. In  that view  of the  law, we  are of  the considered<br \/>\nopinion that  ratio in\tthe cases in which it was dealt with<br \/>\nonly about deduction of developmental charges of undeveloped<br \/>\nlarge extent  of land  does not\t render\t any  assistance  in<br \/>\ndeciding the  principle followed  by the  High Court in this<br \/>\nmatter.\t In   view  of\t the  judgment\t of  this  Court  in<br \/>\nAdministrator General  of West Bengal&#8217;s case [supra] and all<br \/>\nsubsequent decisions,  we do  not think\t that it is a proper<br \/>\ncase for interference.\n<\/p>\n<p>     The appeals are accordingly dismissed.
