              Heard learned counsel for the appearing parties.<\/p>\n
              Leave granted.\n<\/p>\n
              These   Appeals   have   been   filed   against   the <\/p>\n
     impugned common judgment of the High Court of Madras dated <\/p>\n
     23.12.2010.\n<\/p>\n
              The   facts   have   been   stated   in   the   impugned <\/p>\n
     judgment and hence we are not repeating the same here.<\/p>\n
                                             :1:<\/span><\/p>\n
            Mr. K.K. Mani, learned counsel appearing for some <\/p>\n
of the appellants in these Appeals, submitted that since no <\/p>\n
bail   application   was   pending   when   the   detention   order   in <\/p>\n
question   under   Section   3   of   the   Tamil   Nadu   Prevention   of <\/p>\n
Dangerous Activities of Bottleggers, Drug-Offenders, Forest <\/p>\n
Offenders,   Goondas,   Immoral   Traffic   Offenders,   Sand <\/p>\n
Offenders,   and   Slum   Grabbers   and   Video   Pirates   Act,   1982 <\/p>\n
was   passed,   hence   the   detention   order   in   question   was <\/p>\n
illegal as the appellant was already in jail in a criminal <\/p>\n
case on the same facts.  Hence, there was no likelihood of <\/p>\n
his release.\n<\/p>\n
            It appears that there is some conflict of opinion <\/p>\n
on the aforesaid point.\n<\/p>\n
            Mr.   K.K.   Mani,   learned   counsel,   has   relied   on <\/p>\n
judgments   of   this   Court   in    T.V.   Sravanan   alias   S.A.R. <\/p>\n
Prasana   Venkatachaariar   Chaturvedi    Vs.    State   through <\/p>\n
Secretary   and   Anr.,     (2006)   2   SCC   664;  A.   Shanthi   (Smt.) <\/p>\n
Vs.    Govt.   of   T.N.   and   Ors.,   (2006)   9   SCC   711;   and <\/p>\n
Rajesh   Gulati    Vs.    Govt.   of   NCT   of   Delhi   and   Anr. <\/p>\n
(2002)   7   SCC   129,   wherein   it   was   held   that   if   no   bail <\/p>\n
application   was   pending   and   the   detenue   was   already,   in <\/p>\n
fact, in jail in a criminal case, the detention order under <\/p>\n
the preventive detention is illegal.  <\/p>\n
                                           :2:<\/span><\/p>\n
            On   the   other   hand,   Mr.   Altaf   Ahmed,   learned <\/p>\n
senior counsel appearing for the State of Tamil Nadu, has <\/p>\n
relied on the judgments of this Court in   A. Geetha   Vs. <\/p>\n
State   of   T.N.   And   Anr.    (2006)   7   SCC   603;   and  Ibrahim <\/p>\n
Nazeer    Vs.    State   of   T.N.   and   Anr.,     (2006)   6   SCC   64, <\/p>\n
wherein it has been held that even if no bail application <\/p>\n
is pending but if in similar cases bail has been granted, <\/p>\n
then this is a good ground for the subjective satisfaction <\/p>\n
of the detaining authority to pass the detention order.<\/p>\n
            Mr.   K.K.   Mani,   learned   counsel,   has,   however, <\/p>\n
submitted   that   in   the   decisions   cited   by   him   it   was <\/p>\n
mentioned in the detention order that in similar cases bail <\/p>\n
had   been   granted.     Despite   this   the   detention   order   has <\/p>\n
been held to be illegal.\n<\/p>\n<\/p>\n
            There seems to be conflict between the decisions <\/p>\n
cited by Mr. K.K. Mani, learned counsel, and the decisions <\/p>\n
cited by Mr. Altaf Ahmed, learned senior counsel.   Hence, <\/p>\n
in our opinion, the matter should be considered by a larger <\/p>\n
bench for resolving this difference of opinion.<\/p>\n
                                     :3:<\/span><\/p>\n
            Let the papers of these Appeals be placed before <\/p>\n
Hon’ble  the  Chief  Justice  of  India  for constituting a <\/p>\n
larger bench.  Since the period of detention is expiring on <\/p>\n
17.04.2011,   we  would   request  Hon’ble   the  Chief   Justice  of <\/p>\n
India   to   constitute   a   larger   bench   at   the   earliest <\/p>\n
otherwise these Appeals would become infructuous.<\/p>\n
            Any   prayer   for   temporary   relief   may   be   made <\/p>\n
before the larger bench.\n<\/p>\n<\/p>\n
