The petitioner Nos. 1 and 2 – Kanya Lal Dassi and
\nGouri Shanker Dassi, and petitioner No.3- M.K.Dassi, left
\nbehind their two storied building with attic and a single
\nstoried building with attic alongwith land appurtenant thereto
\nrespectively, at village Ganjwara of Tehsil Anantnag in
\nDistrict Anantnag-Kashmir, when they had to migrate
\ntherefrom because of the militancy in Kashmir valley. Their
\nhouses and land were occupied by the Security Forces
\n(CRPF) in mid 1990s.\n<\/p>\n
Vide its decision No.1203-14\/LRA\/Rent\/2002 dated
\n30.01.2002, the State Government assessed Rs.3330\/- and
\n904\/- per month as rent payable for their houses
\nrespectively.\n<\/p>\n
According to the petitioners, the State Authorities
\n2<\/span>
\nassessed rent payable for their houses alone and no
\nrent was assessed for the land appurtenant thereto, which
\ntoo was occupied by the Security Forces. Rs. 46384\/- is
\nstated by the petitioners to have been received by petitioner
\nNos. 1 and 2 vide Draft No.97657 dated 08.02.2003 drawn
\non the Jammu and Kashmir Bank Limited, as part payment
\ntowards the rent of their houses. Petitioner No.3 was not,
\nhowever, paid anything towards the rent of his building in
\noccupation of the Security Forces.\n<\/p>\n
Relying on the provisions of the Jammu and Kashmir
\nMigrant Immovable Property (Preservation, Protection and
\nRestraint on Distress Sales) Act, 1997, the petitioners seek
\ndirections against the respondents to free their residential
\nhouses from the unauthorized occupation and pay them
\ncompensation for the unauthorized occupations period at
\nthe rate double the market rate of rent.\n<\/p>\n
Compensation for the damage caused to their
\nproperties by the Security Forces too is claimed in the Writ
\nPetition.\n<\/p>\n
The Deputy Commissioner, Anantnags response to
\nthe petitioners Notice dated 12.06.2002 for payment of rent
\nis relied upon by the petitioners to support the case set up in
\n3<\/span>
\nthe Writ Petition. A copy of the communication has been
\nplaced on records.\n<\/p>\n
Despite availing numerous opportunities, allowed to
\nthem to file Objections to the Writ Petition, the State
\nrespondents have opted not to file their Response thereto.
\nI have heard learned counsel for the parties and
\nconsidered their submissions.\n<\/p>\n
On facts, there does not appear any dispute on the
\nquestion that the properties of the petitioners, who are
\nmigrants, have been taken possession of by the Security
\nForces. From the admission of petitioner Nos.1 and 2, it
\ncomes out that they had received part payment of the rent,
\nwhich had been assessed payable for their houses in
\noccupation of the Security Forces.\n<\/p>\n
The case set up by the petitioners and the
\nsubmissions of the learned State counsel are, therefore,
\ndealt with in view of the above factual position.
\nIn terms of the provisions of Section 4 of the Jammu
\nand Kashmir Migrant Immovable Property (Preservation,
\nProtection and Restraint on Distress Sales) Act, 1997, the
\nAct hereafter, the District Magistrate, Anantnag is deemed
\nto have taken over the possession of the properties of the
\n4<\/span>
\npetitioners. He was required to take requisite steps on the
\npetitioners Complaint regarding illegal occupation of their
\npremises, as contemplated by the provisions of Section 5 of
\nthe Act.\n<\/p>\n
Looking to the facts and circumstances of the case as
\nthey so appear from the material placed on the records by
\nthe petitioners claiming them to have received rent in part
\nfor the premises in occupation of the Security Forces, their
\nClaim for freeing their properties from the occupation of the
\nSecurity Forces needs to be determined first by the
\nCompetent Authority under the Act, in that, it is the Authority
\nwhich is empowered to go into all these questions as to
\nwhether or not the possession of the Security Forces was
\nunauthorized, and if so, to take requisite action for eviction
\nof the properties in their occupation, And it is only after
\ncoming to the conclusion that the migrants property was in
\nunauthorized occupation that issue of payment of
\ncompensation may be determined.\n<\/p>\n
As the District Magistrate has not yet considered the
\npetitioners grievance for initiating action under Sections 5
\nand 13 of the Act, so a direction needs to be issued to him
\nto discharge his statutory obligations under the Act
\n5<\/span>
\nThis Writ Petition is, therefore, disposed of with a
\ndirection to the District Magistrate, Anantnag to consider the
\npetitioners Claim for taking appropriate action in terms of
\nthe provisions of Sections 5 and 13 of the Act in respect of
\ntheir properties, and to take all such measures, as may be
\nnecessary, to implement the provisions of the Act.
\nUntil such proceedings were initiated and concluded by
\nthe District Magistrate, he is required to ensure that the rent
\nas assessed for the petitioners buildings, along with arrears,
\nwas paid to the petitioners, within a period of eight weeks.
\nThe State functionaries shall ensure payment of
\narrears of rent to the petitioners within period referred to
\nherein above.\n<\/p>\n
The rent so paid and already received by the
\npetitioners, shall be adjusted in the compensation, if
\nassessed payable to the petitioners, in terms of the
\nprovisions of Section 13 of the Act.\n<\/p>\n
The District Magistrate is directed to pass requisite
\norders in respect of the petitioners claims, within a period of
\nfour months, after hearing the respondents and those in
\noccupation of the premises. The petitioners shall enjoy
\nliberty to file fresh Representation with the District
\n6<\/span>
\nMagistrate supplying him all such material or evidence on
\nwhich they may like to rely upon to seek consideration of
\ntheir Claims.\n<\/p>\n
