What has been refused<br \/>\n      to be disclosed in Parliament, if made public at this stage, may<br \/>\n      be considered to be a breach of privilege.<\/p>\n<blockquote><p>      Of course, the Commission does not have the jurisdiction and<br \/>\n      would not choose to pass a verdict as to whether it will actually<br \/>\n      amount to either breach of privilege or contempt of the<br \/>\n      Parliament because it is for the Parliament to decide and<br \/>\n      determine that. The Commission can only see and examine<br \/>\n      whether the concerned Public Authority denying the information<br \/>\n      has a prime facie apprehension as to whether disclosure of<br \/>\n      information in the given case may amount to commission of<br \/>\n      contempt or breach of privilege and if a prime facie case is so<br \/>\n      made out, the Commission has to uphold the same.\n<\/p><\/blockquote>\n<blockquote><p>      Parliament may, however, examine the matter in the light of the<br \/>\n      provisions of the Right to Information Act and the objectives that<br \/>\n      this legislation intends to achieve of bringing transparency and<br \/>\n      accountability in the working of all public authorities. In this case,<br \/>\n      the Commission would like to make a reference, and to request<br \/>\n      the Hon&#8217;ble Speaker of the Lok Sabha, Shri Somnath Chatterjee<br \/>\n      to consider the issue and decide as to whether it would be a<br \/>\n      breach of privilege if the information, which has been refused to<br \/>\n      be disclosed to Parliament by the Executive at one point of time,<br \/>\n      is now disclosed to an applicant under the Right to Information<br \/>\n      Act, 2005.\n<\/p><\/blockquote>\n<blockquote><p>      Needless to say, if eventually an order of disclosure of<br \/>\n      information is issued after the matter of Parliamentary privilege<br \/>\n      is decided by the Hon&#8217;ble Speaker, because it cannot be denied<br \/>\n      that the information sought is with regard to a private property,<br \/>\n      hence before disclosing any information on record in this regard<br \/>\n      CPIO will still be required to give a written notice to the third<br \/>\n      party i.e. the erstwhile Maharaja of Udaipur, of the request and<br \/>\n      invite the third party to make a submission in writing or orally,<br \/>\n      regarding whether the information should be disclosed, and on<\/p>\n<p><span class=\"hidden_text\">                                        1<\/span><br \/>\n       this basis take a decision on the disclosure of information<br \/>\n      keeping in view that should the third party claim invasion of<br \/>\n      privacy u\/s 8(1)(j), the CPIO will have to take a considered<br \/>\n      decision after keeping in view such objection, considering that<br \/>\n      there is a public activity involved in this matter i.e. the accession<br \/>\n      of the State to the Indian Union and also to the fact that more<br \/>\n      than twenty years have expired since such accession.\n<\/p><\/blockquote>\n<blockquote><p>      The appellant has indeed contended that the information being<br \/>\n      more than 20 years old must be disclosed under sub-section (3)<br \/>\n      of Section 8 of the Right to Information Act, 2005 which reads as<br \/>\n      under:-\n<\/p><\/blockquote>\n<blockquote><p>             Section 8(3)<br \/>\n             Subject to the provisions of clauses (a), (c) and (i) of sub-<\/p><\/blockquote>\n<\/blockquote>\n<blockquote><p>             section (1), any information relating to any occurrence,<br \/>\n             event or matter which has taken place, occurred or<br \/>\n             happened twenty years before the date on which any<br \/>\n             request is made under section 6 shall be provided to any<br \/>\n             person making a request under that section<\/p>\n<p>             Provided that where any question arises as to the date<br \/>\n             from which the said period of twenty years has to be<br \/>\n             computed, the decision of the Central Government shall<br \/>\n             be final, subject to the usual appeals provided for in this<br \/>\n             Act<\/p>\n<p>      From the above, it is clear that the provisions of Section 8(3) are<br \/>\n      subject to the provisions of Section 8(1) (c) and, as such, even if<br \/>\n      the information relates to an incident or event which has taken<br \/>\n      place, occurred or happened 20 years before, still if it is decided<br \/>\n      that the disclosure amounts to the breach of privilege of<br \/>\n      Parliament, it cannot be disclosed.&#8221;\n<\/p><\/blockquote>\n<blockquote><p>      Accordingly, we have received the following remarks from Dy.\n<\/p><\/blockquote>\n<p>Secretary, Lok Sabha Secretariat, Privilege &amp; Ethics Branch dated 17-7-08 in<br \/>\nwhich he has submitted as follows:\n<\/p>\n<blockquote><p>      &#8220;It has been observed that as per the communication of Director,<br \/>\n      Judicial and CPIO of Ministry of Home Affairs dated 31st October<br \/>\n      2007 addressed to the applicant, Shri Basanti Lal Singhvi,<br \/>\n      &#8220;Saheliyon-Ki-Bari&#8221;, the property regarding which information<br \/>\n      has been sought by the applicant, is a State Property. The<br \/>\n      information south through USQ No. 655 in 1967 pertained to<br \/>\n      private properties that remained with rulers at the time of<br \/>\n      accession. The principle (that details of &#8230; private property of<br \/>\n      the ruler should not be matter of public disclosure) on which<br \/>\n      information was denied to Parliament, in reply to USQ 655 does<br \/>\n      not, therefore, appear to be applicable to Saheliyon-Ki-Bari<br \/>\n      which, as per the admission of the Government is a State<br \/>\n      Property. It seems to be debatable whether provisions of<\/p>\n<p><span class=\"hidden_text\">                                       2<\/span><br \/>\n        Section 8(1) (c) of the Right to Information Act, 2005 may be<br \/>\n       invoked under these circumstances.\n<\/p><\/blockquote>\n<blockquote><p>       Further the applicant, who desires this information in connection<br \/>\n       with a case pending in a court has, in this application dated 9th<br \/>\n       March 2007 to the CIC, categorically stated that if it is not<br \/>\n       possible for the Government to disclose the information to him, it<br \/>\n       may be made available directly to the court in which his case is<br \/>\n       pending.\n<\/p><\/blockquote>\n<blockquote><p>       In the event of the Government acceding to the said request<br \/>\n       made by the applicant vide his letter dated 9th March, 2007,<br \/>\n       there would be no &#8220;public disclosure&#8221;.\n<\/p><\/blockquote>\n<blockquote><p>       This has the approval of Hon&#8217;ble Speaker, Lok Sabha.&#8221;<\/p><\/blockquote>\n<p>       From the above it is clear that the disclosure of information sought in<br \/>\nthe present application will not, in the view of Speaker, Lok Sabha, breach the<br \/>\nexemption from disclosure granted u\/s 8 (1) (c) CPIO Shri NN Perumal<br \/>\nDirector MHA will now provide the information sought by appellant Shri<br \/>\nBasanti Lal Singhvi will now be disclosed to him within 20 days of the<br \/>\ndate of receipt of this decision notice, allowing for 5 days for issue of<br \/>\nnotice to the third party and a further 10 days for the third party to<br \/>\nrespond.\n<\/p>\n<p>       The appeal is, therefore, allowed.
