HAMEEDULLAH\nSARKARIA, RANJIT SINGH\n\nCITATION:\n 1976 AIR  730\t\t  1976 SCR  (3) 663\n 1976 SCC  (1) 657\n\n\nACT:\n     Probation of offenders Act, 1958-S. 6-Scope of.\n\n\n\nHEADNOTE:\n     On the question whether the provisions of the Probation\nof offenders Act 1958 should have been applied in this case,\n     Allowing the appeal,\n^\n     HELD:  (1)\t Even  though  the  point  relating  to\t the\napplicability of  s.6 was  not raised  before the Presidency\nMagistrate or  the High\t Court, this  Court is bound to take\nnotice of  the provisions  of  that  section  and  give\t its\nbenefit to the appellant, particularly since it is a section\nwhich is  intended for\tthe benefit  of juvenile delinquents\nreflecting the\tanxiety of  the Legislature  to protect them\nfrom contact or association with hardened criminals in jails\nand retrieve them from a life of crime and rehabilitate them\nis responsible and useful members of society. [665 B-C]\n     (2) Section  6 lays  down an injunction not to impose a\nsentence of  imprisonment on  a reason who is under 21 years\nof' age\t and is\t found guilty of having committed an offence\npunishable with imprisonment other the that for if unless it\nis satisfied that it would not be desirable to deal with him\nunder s.  3 or\ts. 4.  'This inhibition\t on the power of the\ncourt to  impose a sentence of imprisonment applies not only\nat the\tstate of trial but also at the stage of \"High, Court\nor any\tother court  when the case comes before it in appeal\nor revision\" s. 11 (i) [664-H]\n     In the instant case the appellant was below 21 years of\nage. The  appellant was\t at one time a well known child film\nactor  and   won  several   awards  for\t  acting  in  films.\nSubsequently he\t fell in  bad company and took to evil ways.\nThe offence  of theft  of two Sarees, though it could not be\nlightly ignored.  was of  minor. character  and this was the\nfirst offence  of the  appellant. It  Count be\tsaid that it\nwould not be desirable to deal with the appellant under s. 3\nor s. 4 of the Act. [665 G-H]\n\n\n\nJUDGMENT:\n<\/pre>\n<p>     CRIMINAL APPELLATE\t JURISDICTION: Criminal\t Appeal\t No.<br \/>\n129 of 1971 .\n<\/p>\n<p>     Appeal by\tSpecial Leave  from the\t Judgment and  order<br \/>\ndated the 4th March, 1971 of the Bombay High Court at Bombay<br \/>\nin Criminal Appeal No. 1502 of 1969.\n<\/p>\n<p>     R B. Datar and Rajen Yash Paul, for the Appellant.<br \/>\n     M. N Shroff, for the Respondent.\n<\/p>\n<p>     The Judgment of the Court was delivered by-<br \/>\n     BHAGWATI, J.  The appellant  and one  Mohd. Yusuf Gulam<br \/>\nMohd. were  charged for\t an offence under s. 379 read with s<br \/>\n34 of  the Indian  Penal Code  for snatching two sarees from<br \/>\none Govind  whilst he was carrying them from the show of his<br \/>\nmaster to  that of a washer and dyer. The learned Presidency<br \/>\nMagistrate, who\t tried the  case, accepted  the\t prosecution<br \/>\nevidence and found the appellant and Mohd. Yusuf Gulam Mohd.<br \/>\nguilty of the offence under s. 379 read with s. 34 and<br \/>\n<span class=\"hidden_text\">664<\/span><br \/>\nSentenced each\tof their to suffer rigorous imprisonment for<br \/>\nsix months.   It  does not  appear from\t the judgment of the<br \/>\nlearned Presidency Magistrate that, though the appellant was<br \/>\nonly seventeen years and three months old at the date of the<br \/>\noffence and the offence was not punishable with imprisonment<br \/>\nfor life, the attention of the learned presidency Magistrate<br \/>\nwas invited  to the  provisions of  s. 6 of the Probation of<br \/>\noffenders Act,\t1958.  The  appellant  preferred  an  appeal<br \/>\nagainst the  order of  conviction and  sentence to  the High<br \/>\nCourt of  p Bombay but the appeal was unsuccessful. The High<br \/>\nCourt took  the same  view of  the evidence  as the  learned<br \/>\nPresidency Magistrate  and confirmed  the conviction  of the<br \/>\nappellant under\t s. 379\t read with  s. 34.  So\tfar  as\t the<br \/>\nquestion of sentence was concerned, a submission was made on<br \/>\nbehalf of  the appellant  that since  he was  a young boy of<br \/>\nabout seventeen\t years and  three months  and this  was\t his<br \/>\nfirst offence,\tleniency should\t be shown  tow him.  But the<br \/>\nHigh Court  r observed\tthat age alone was not sufficient to<br \/>\ninvoke the mercy of the Court and the appellant had not done<br \/>\nanything since\tthe date of the offence to deserve the mercy<br \/>\nof the\tCourt and  it did  not, therefore, see any reason to<br \/>\ninterfere with\tthe sentence  of imprisonment passed against<br \/>\nthe appellant.\tIt appears that once again the provisions of<br \/>\ns. 6  of the  Probation of  offenders  Act,  1958  were\t not<br \/>\nspecifically brought to the notice of the High Court and the<br \/>\nsentence of  imprisonment was  maintained by  the High Court<br \/>\nwithout applying  its mind  to those  provisions. Hence\t the<br \/>\nappellant preferred  a petition\t for special  leave to\tthis<br \/>\nCourt and on that petition, this Court granted special leave<br \/>\nlimited to  the question  &#8220;whether  the\t provisions  of\t the<br \/>\nProbation of  offenders Act  should have been applied in the<br \/>\ncase&#8221;.\n<\/p>\n<p>     We are  concerned in  this appeal\twith  s.  6  of\t the<br \/>\nProbation of  offenders Act, 1958, for it is only under that<br \/>\nsection\t that  the  appellant  claims  the  benefit  of\t the<br \/>\nprovisions contained  in the Act. Subsection (1) of s. 6, on<br \/>\na plain\t grammatical reading  of its language, provides that<br \/>\nwhen any  person under\ttwenty-one years age is found guilty<br \/>\nof having committed an offence punishable with imprisonment,<br \/>\nbut not\t with imprisonment for life, the Court, by which the<br \/>\nperson is  found guilty,  shall not  impose any\t sentence of<br \/>\nimprisonment, unless  it is satisfied that, having regard to<br \/>\nthe circumstances  of the  case, including the nature of the<br \/>\noffence and  the character  of the  offender it would not be<br \/>\ndesirable to deal with him<br \/>\n<span class=\"hidden_text\">665<\/span><br \/>\nhim under  s. 3 or s. 4. This inhibition on the power of the<br \/>\nCourt to  impose a sentence of imprisonment applies not only<br \/>\nat the\tstate of  trial court  but also\t at the\t stage &#8220;High<br \/>\ncourt or  any other  Court when\t the case comes before it on<br \/>\nappeal or  in revision.&#8217;. Vide s. 11, sub-s. (1) of the Act.<br \/>\nIt  is,\t therefore,  obvious  that  even  though  the  point<br \/>\nrelating to  the applicability of s. 6 was not raised before<br \/>\nthe learned  Presidency Magistrate  or the  High Court, this<br \/>\nCourt is  bound to  take notice\t of the\t provisions of\tthat<br \/>\nsection and  give its benefit to the appellant, particularly<br \/>\nsince it  is a\tsection which is intended for the benefit of<br \/>\njuvenile  delinquents,\t reflecting  the   anxiety  of\t the<br \/>\nLegislature to protect them from contact or association with<br \/>\nhardened criminals in jails and retrieve them from a life of<br \/>\ncrime  and  rehabilitate  them\tas  responsible\t and  useful<br \/>\nmembers of society.\n<\/p>\n<p>     Here, we  find that  whatever  date  be  taken  as\t the<br \/>\nrelevant date  for determining\tthe applicability  of s.  6-<br \/>\nwhether the  date of the offence or the date of the judgment<br \/>\nof the\tlearned Presidency  Magistrate or  the date  of\t the<br \/>\njudgment of  the High  Court-the appellant  was below twenty<br \/>\none years age. The offence of which he is found guilty is an<br \/>\noffence under  s. 379  read with  s. 34 and it is clearly an<br \/>\noffence\t punishable   with   imprisonment   but\t  not\twith<br \/>\nimprisonment for  life. The   conditions  requisite for\t the<br \/>\napplicability of  s. 6 are, therefore, plainly satisfied and<br \/>\nunder s.  6, Sub-s.  (1) it is not competent to the Court to<br \/>\nimpose ant sentence of imprisonment on the appellant, unless<br \/>\nthe  Court   is\t satisfied   that,  having   regard  to\t the<br \/>\ncircumstances of  the case,  including\tthe  nature  of\t the<br \/>\noffence and  the character of the appellant, it would not be<br \/>\ndesirable to  deal with\t him under  s. 3 or s. 4. It is true<br \/>\nthat sub-s.  (2) of  s. 6  requires that  for the purpose of<br \/>\nsatisfying itself  whether it would not be desirable to deal<br \/>\nwith the appellant under s. 3 or s. 4, the Court is required<br \/>\nto call for a report from the Probation officer and consider<br \/>\nthe report,  if any, but we do not think it necessary in the<br \/>\npresent case  to call  for any\treport\tfrom  the  Probation<br \/>\nofficer nor  to remand\tthe case  to the  learned Presidency<br \/>\nMagistrate for\tpassing an  appropriate order  after calling<br \/>\nfor a  report from the Probation officer and considering it.<br \/>\nWe  have   on  record  the  antecedent\thistory\t giving\t the<br \/>\nbackground of the appellant. The appellant was at one time a<br \/>\nwell known  child film\tactor and  he actually\twon  several<br \/>\nawards\tfor  acting  in\t films.\t It  appears  that  at\tsome<br \/>\nsubsequent stage  he fell  in bad  company and\ttook to evil<br \/>\nways The  offence which\t he is\tconvicted is,  no doubt,  an<br \/>\noffence as  theft which cannot be lightly ignored, but it is<br \/>\ncomparatively of  a minor characters in that only two sarees<br \/>\nwere snatched  away from  the hands of Govind, perhaps under<br \/>\nthe stress  of economic necessity. Moreover, this is a false<br \/>\noffence of  the appellant.  We are,  therefore, not  at\t all<br \/>\nsatisfied<br \/>\n12-L925SupCI\/75<br \/>\n<span class=\"hidden_text\">666<\/span><br \/>\nthat it\t would not  be desirable  to deal with the appellant<br \/>\nunder s.  3 or\t s.  4 and  consequently,  the\tsentence  of<br \/>\nimprisonment passed on the appellant must be set aside.\n<\/p>\n<p>     We accordingly  set aside\tthe sentence of imprisonment<br \/>\npassed on  the appellant  and direct  that he be released on<br \/>\nhis entering  into a  bond wit\tone surety in the sum of Rs.<br \/>\n500\/ to\t appear in the Court of the Presidency Magistrate to<br \/>\nreceive sentence,  whenever called  upon to  do so  within a<br \/>\nperiod of  six months  and during  that period\tto keep\t the<br \/>\npeace and  be of  good\tbehaviour.  The\t learned  Presidency<br \/>\nMagistrate is  directed to  take the necessary bond from the<br \/>\nappellant and the necessary surety bond from a surety to his<br \/>\nsatisfaction.
