No.9143 of 2011\n                  NAND KISHORE SHARMA, son of Shri Yogendra\n                  Singh, resident of Village-Ahiyapur, P.S.-Bihta, District-\n                  Patna..                                      ...Petitioner\n                                           Versus\n                  THE STATE OF BIHAR....                     ...Opposite Party\n                                        -----------\n<\/pre>\n<p>                  For the Petitioner : Mrs. Soni Shrivastava, Advocate<br \/>\n                  For the State      : Mr. Umanath Mishra, A.P.P.\n<\/p>\n<p>                                     &#8230;&#8230;&#8230;&#8230;&#8230;\n<\/p>\n<p>\n3   27.04.2011             Heard learned counsel for the petitioner the<\/p>\n<p>                 State and also perused the report kept at Flag &#8216;X&#8217;.<\/p>\n<p>                             The petitioner seeks bail in a case registered<\/p>\n<p>                 under Sections 304(B) and 201\/34 of the Indian Penal<\/p>\n<p>                 Code.\n<\/p>\n<p>                             The prayer for bail of the petitioner, who<\/p>\n<p>                 happens to be the husband of the victim (deceased), had<\/p>\n<p>                 earlier been rejected twice. Firstly, vide order dated<\/p>\n<p>                 26.11.2009 passed in Criminal Miscellaneous No.<\/p>\n<p>                 25421 of 2009 and thereafter again on 25.08.2010<\/p>\n<p>                 passed in Criminal Misc. No.21216 of 2010. However,<\/p>\n<p>                 on that occasion, since the petitioner was only in<\/p>\n<p>                 custody for more than two years, the trail court was<\/p>\n<p>                 directed to take every steps for expeditious disposal of<\/p>\n<p>                 the trial, preferably, within six months and liberty was<br \/>\n<span class=\"hidden_text\">                  2<\/span><\/p>\n<p>granted to the petitioner to renew the prayer for bail if<\/p>\n<p>the trial is not concluded within such period.<\/p>\n<p>            It is submitted on behalf of the petitioner<\/p>\n<p>that now more than 8 months have elapsed since the<\/p>\n<p>aforesaid order dated 25.08.2010 and the report is on<\/p>\n<p>record which shows that only one witness has been<\/p>\n<p>examined on behalf of the prosecution.           Learned<\/p>\n<p>counsel for the petitioner has produced certified copy of<\/p>\n<p>the evidence of the PW-1 to show that even this witness<\/p>\n<p>has not supported the case of the prosecution. It is<\/p>\n<p>submitted on behalf of the petitioner that the wife of the<\/p>\n<p>petitioner had died due to prolonged illness and, in fact,<\/p>\n<p>the factum of the death had been communicated to the<\/p>\n<p>family members of the deceased immediately and they<\/p>\n<p>have participated in the cremation. However, on the<\/p>\n<p>next day, they for the reasons best known to them, the<\/p>\n<p>family members of the deceased became hostile and<\/p>\n<p>lodged First Information Report wherein entire family<\/p>\n<p>members of the petitioner have been roped in. Learned<\/p>\n<p>counsel further submits that the petitioner has remained<\/p>\n<p>in custody since 7.7.2008, i.e., for more than two years<\/p>\n<p>and nine months and there is no likelihood of the trial<br \/>\n<span class=\"hidden_text\">                  3<\/span><\/p>\n<p>being concluded in near future.\n<\/p>\n<p>          Having     regard     to   the   facts   and   the<\/p>\n<p>circumstances of the case specially considering the<\/p>\n<p>period of incarceration of the petitioner for more than<\/p>\n<p>two years and nine months and also considering           that<\/p>\n<p>only one witness could be examined till the report of the<\/p>\n<p>concerned Court, flagged at &#8216;X&#8217;, the petitioner, Nand<\/p>\n<p>Kishore Sharma, is directed to be released on bail on his<\/p>\n<p>furnishing bail bond of Rs.10,000\/-(Rupees Ten<\/p>\n<p>Thousand) with two sureties of the like amount each to<\/p>\n<p>the satisfaction of the A.D.J., 1st, Danapur, Patna, in<\/p>\n<p>connection with Sessions Trial No.2456 of 2008,<\/p>\n<p>arising out of Bihta P.S. Case No.161 of 2008, with a<\/p>\n<p>further condition that        the petitioner shall remain<\/p>\n<p>present on each and every date during the course of the<\/p>\n<p>trial in the court below.
